This is a very hard question. If the delegates who are suppose to represent the party nationally did not give Obi a waiver, who did? It means Obi is not a member of LP.

But even if delegates voted, the presidential primary happened over one year ago and can no longer be challenged.

Your first statement I can affirm to be true, the court at the time of the primaries and INEC had come to recognize the Abure lead faction as the true leadership of the party and Obi was selected unopposed with other contenders stepping down.

If this letter is true it will not affect Obi, but other candidates in SE who have a legal contest ; if the jurisdiction of the court handling the case is correct and the case had been filed in good time may have to vacate their seat if it can be proven there was no consensus in the primaries. Otti might still be spared but senate and HOR seats can be in danger

Isn't this an indictment on inec and the govt ?you didn't monitor yet you ratify the product of the primaries to the extent they participated in your election and won ...were inec jazzed ? At this point is important to say that the chairman if inec should be jailed ..infact all elections he conducted is fake and lacks credibility

If you know the constitution of the country you called your own, you should know that section 285 (9) categorized this as pre-election matter which can only be initiated 14 days after the election of congress members.
you don't even know what is called pre election matters.

Yes this letter would have no effect on Obi and most labour party victories including Otti because the time for filling pre election matters is long passed. But any existing pre election matter already filed in good time and in court is under danger. This may affect one or two legislative victories at state or national

But the same Obi is challenging the election that was held months ago. The Nigerian constitution does not recognize independent candidacy, so therefore, a party must nominate a candidate, a process that must follow every laid down guidelines as spelt out by the electoral acts 2022 as amended. It applies to every party, not just LP. So, if any political parties does not follow due process in it's conduct of party delegate nominations or candidate nominations, then, that party is in trouble.
So, LP threw the first few punches, don't expect the other side to turn the other cheek.
