Let us assume this is what they are still unmarried in that "separate state". Only when one of them commit adultery, the other is free to divorce the other and get may choose to get married or remain unmarried. Also, death of one of the spouses give the surviving partner the freedom to remarry. That's the Christian teaching on the subject of marriage when divorce and remarriage is considered.
