I think a clarification is needed on subject of electronic transmission of result & I would want those with the knowledge & operation of the election procedures & the electoral law to shed more light on this. My Question therefore goes thus; is the upload of photograghed form EC08 of INEC the same as Electronic transmission of results?


I recall during the 2019 elections where i was a Presiding Officer, we were mandated to enter & submit the votes scored by each political party into the card reader.. Was something similar done into the BVAS( which is the technological device used to replace the card reader) in addition to the upload of snapped form EC08.

Trust the Mods can help push this to the front page for wider input.

Physical delivery results was used to announce the results though they cross checked with the electronic transmitted results before making the final results

The court, the Judges have repeated themselves on same issue.

This is the reason heavy fine awaits Obi and his lawyers.
Presenting the same case that has been settled on many occasions.

INEC CAN AMEND OR VARY ITS REGULATIONS’

Delivering judgment on Friday, a three-member panel of the court of appeal led by Abubakar Umar agreed with the submissions of the APC.

The court held that Section 50(2) and Section 60(5) give INEC “very wide discretionary powers” to determine how it transmits or transfers election results.


“As I had demonstrated earlier in this judgment, the Electoral Act gives the 43rd respondent (INEC) discretion on how it carries out its assignment including how it transmits or transfers the result of election from polling units,” Umar stated.

So which electronics transmitted result did inec cross check with before making their final result? And what happen when there is a changes from the result inec gave all political party agent at the poling unit is now different from the one inec use to declare the winner?

The BVAS tallies and send the results by each party to INECs server. That's is different from the snapshot of the report that gets uploaded to the viewing portal.

That is the 100% reason, the Inec mandated every political party to have an agent in the polling unit.
It is now left for the party agent to present such descrepamcy in the court.

The question now is?

Has any party presented such occurrence in the ongoing Tribunal?
Because Tribunal does not rely on hearsay or beer Parlour gist, they only rely on evidence

Results were announced before they were uploaded on the server. Whereas the announcement was that electronic transmission of results will happen directly from the polls before collation at the LGA level but that's not what transpired. It was either there was no network, wrong code, server down, etc. that we heard. Nobody is arguing about understanding what electronic transmission of results means. We're saying that INEC broke its own law just for their preferred candidate to emerge as the winner and that's very wrong.

The next electoral law should allow citizens to vote with their mobile phones. Period!

Did you read what you typed? So, what results did they cross'checked 18000 blurred, mutilated and descripant results with? What results did INEC cross-checked pictures of lovers with?
See, all these hallucinations will not save Tinubu. The INEC back-end server results are not in sink with announcements hence INEC claimed server glitch that choosed to affect only presidential results on a day both NASS and presidential elections were held with the same device. It is like saying, you device malfunctioned on same platform when you want to text your manager, but wirksvwhen you text your girlfriend.

It is the irreconcilable results Mahomod Yakubu hurriedly mumbled up to fraudulently announce the drug baron as president-select.Meanwhile, INEC have long decided on electronic transmission of results. This is what gave the citizens of this nation hope but the hope was dashed when INEC made a volte face during the presidential electio.

We wish to reassure Nigerians that the electronic transmission of result has come to stay. It adds to the credibility and transparency of the process when citizens follow polling unit level results on the INEC Result Viewing (IReV) portal on real-time on Election Day. There will be no change or deviation in subsequent elections. So why the volte face?

Article 38 on Electronic Transmission of Results and Upload of Results to INEC’s Result Viewing Portal (IReV) states: “On completion of all the Polling Unit voting and results procedures, the Presiding Officer shall: (i) Electronically transmit or transfer the result of the Polling Unit, direct to the collation system as prescribed by the Commission.

“(ii) Use the Bimodal Voter Accreditation System (BVAS) to upload a scanned copy of the EC8A to the INEC Result Viewing Portal (IReV), as prescribed by the Commission.

“(iii) Take the BVAS and the original copy of each of the forms in tamper-evident envelope to the Registration Area/Ward Collation Officer, in the company of security agents. The Polling Agents may accompany the Presiding Officer to the RA/Ward Collation Centre.”
