Mind you, An Act only take predominance over a judicial decision when such Judicial division is inconsistent with any of the sections or provisions of the Act... In this case, there is no inconsistency between the decision in Aoko v. Fagbemi and the Marriage Act because no section of the marriage Act makes Adultery an offence except the criminal code and penal code that provides punishment for the offence of Bigamy.

Section 15 subsection 2 paragraph B of the Matrimonial Causes Act only make Adultery a ground for dissolution of marriage (divorce) to be granted.. Also Section 31 of the Matrimonial Causes Act further provides that a party to a marriage can only claim damages for adultery if such an act is not condoned and was not perpetrated for up to three years before such a claim is made.

Take note too that a Judicial decision can only be set aside by a judicial decision made by a superior court against a lower court or against itself [in the case of a Supreme court decision being reversed on the ground that the earlier one was made in error (Per Incurium) ]... In this case, there is no judicial decision by the supreme court till date that have set aside the decision in this Aoko v. Fagbemi's case and so, it still remain binding on all court(s) in Nigeria most especially in Southern Nigeria.

The statement in bold is not true.

Section 370 of the Criminal Code Act states thus:
‘Any person who, having a husband or wife living, marries in any case in which such marriage is void by reason of its taking place during the life of such. husband or wife is guilty of a felony, and is liable to imprisonment for seven years’.
Its equivalent provision in the Penal code of Northern Nigeria is Section 384 subsection 1.
Looking at the above said provision of the law, the offence of Bigamy can only be charged or enforced against only the party that consented or convenanted under the marriage Act and not against a third party who one of the spouse had adultery with.

The headline is quite misleading.

In divorce proceedings especially where adultery is alleged, there are two respondents that is the person whom the alleged adultery was committed with. (In this instance, Yul and Judy are the two respondents.) If this is proved successfully, damages in that amount May is requesting for will be awarded to her or less. If May can prove that the adultery was committed during the pendency of the marriage, very good too.

If Yul married Judy under the act without legally dissolving the marriage between him and May, he would be seen to have committed bigamy punishable with seven years imprisonment under the criminal code. Adultery is a crime under the Penal Code of the Northern states of Nigeria and is not recognised as a crime in the southern part of Nigeria.

At best, Yul can only marry Judy under Native law and custom which I am guessing he has already done.

Matrimonlal Law aside, its good as May has filed for divorce. Let everybody move on. For those of you hailing Yul, I have nothing to say. Everyone has an opinion till it actually happens to you expressing the opinion or to someone close to home.
