adedammy009: As usual oga mi, take this suggestion based on personal permutation from trends noticed lately. I. Question is are we getting another batch of IL this month? vs embassy used September early ths month slot for the recent IL dispatched for backlog clearance? We can only wait to see by the 3rd week of this month after IR/CR folks have received their IL. II. If we get another batch by end of this month, we may see 2/3 months cleared at a time e.g January 2023 through March 2023 DQ candidate whose PD is current. If we don't get this month then We are left with IL for maybe 2 months worth of DQ candidates per month from October, November - January . Then we are back to short rationing come february, when we start to see increased Student visa application/ short staffed consulate to cover all this application, etc III. considering the first 2 months of the fiscal year usually come with increased allocation. Other factors that will play a role is the Visa bulletin Priority date movement for October through December 2023. Going by current rate of 2- 3 months progression of PD for Eb-2 Visa ROW since the last retrogression, We may see IL for January through march (conservative based on applicants still on Queue) EDIT: reading again, figured the last sentence may be confusing ====> increased rate of current date in visa bulletin, may clog up the IL allocation per us consulate again . I doubt PD for EB-2 ROW will go past January 2023 by december 2023. Eb-3 may return back to late 2022/ early 2023. IV. strongly believe April DQ candiates should get IL latest Nov/December for January/ February interview (conservative speculation). 1 Like |

olig:Mr/ms Olig this your question na consular officer / charlie oppenheim we go gaz send am to . I will give it a try. I. It can be argued for fiscal year 2023 considering after DQ you are in line for visa availability/number.This means your visa is/was counted for that fiscal year (In an ideal world with lil -no backlog) by Department of state and NVC for when you get IL (usually 6 weeks tops). II. Back to earth with different scenarios of short-staffed consulate, erratic IL allocation,etc It usually amount to waste of visas to be used. Two things can happen, the wasted numbers will be used as benchmark (margin of error percentage for such situation doesn't go above 10% except in cases like pandemic or freak accident event) for allocation of total employment based visa for the new fiscal year at the discretion of the team. III. All interviews hopefully result in Visa issued. All Visas issued in October 2023 going forward should count towards Fiscal year 2024. IV. While answering this , I see where the follow up question may become why use up visas for a new year when it obviously should have been captured in the past fiscal year? and are we left with reduced amount of visas.?? To the above follow-up question i say; The allocation is dynamic, it isn't rigid. As for reduced visa number, i am an optimist in the sense that from rough estimate both family and Employment based for Nigeria has not exceeded 7% cap because we are not issuing enough immigrant visas (if you think contrary; look at the visa issuance statistics for end of fiscal year 2022 and what will come out for 2023 for india, phillipine, brasil, etc compare them to the allocation we are getting per country not post). This may change in the next 24-48 months if Lagos is still the only consulate doing IV for Nigeria. The number of EB-2 NIW from Nigeria has shot up in crazy fold, so I anticipate backlogged visa allocation worse than what we are seeing currently for Eb-2 (NIW and employer petitioned) applicant based in Lagos. Totally off the question:- Is it possible for us members here to ask ( Iof course after you have completed your visa interview proceedings to) visa officers to join the thread. Back in the day, pre-instagram and twitter gaining grounds.One or two visa officers were on nairaland usa thread. but they logged off due to scheduling etc. I figure if the employment based immigrants keep pestering them (volunteer if you are confortable enough since the interview is mostly chitchat ) at least one will return. Thank you for the detailed information. Or are you the "scout" ? Just curious why they chose to confuse us . My curiosity aroused from the number of months covered in the recent IL issuance (based on information availableon this platform). Similar to your views, one could have 2 thoughts; either they roll out IL based on the remaining/unused 2023 FY slot (and possible rollover from other categories) OR they are issuing IL based on the coming (2024) FY. Please has anyone here either: 1. Travelled to the US on vacation with their existing B1/B2 visa after submitting their application for EB1 or EB2? What was your POE experience like? Did you have to hold additional documents to prove you were only visiting? 2. Applied for a B1/B2 visa renewal after submitting their application for EB1 or EB2? Was it granted? Any answers that can give me an idea how useful my B1/B2 visa will be after submission of my migrant visa application will be very useful please. I need to visit later in the year, but I am ready to submit my migrant application now and I'm trying to decide if i should just hold on with the submission. Note that my plan is just to visit and then come back and follow through till my migrant visa application sails through. 1 Like |

MaryAndrews: POE can't see any pending applications for other visa categories. They assess on the category that you entered the US with. Besides you haven't submitted your migrant application and you'll probably have at least one year wait before your interview. Biko take your trip as planned and renew if it expires. |

MaryAndrews:For context..I had a pending migrant visa ..no interview date in sight for a few years I had many B1B2 visas in between. I was never asked about any migrant visas at POE. All questions were based on visit visa I entered the US with.. |

mayowa94:I do not think you can have a PD before your petition is received. The Sept 2022 date is what exactly? Priority date (PD) is actually the date USCIS acknowledges the receipt of your petition. Therefore, if your petition was received on August 24, 2023, then I think your PD should be a day or 2 after August 24, 2023. Guess there is something I don't understand. mayowa94: Hi, I would guess that what you mean is that your labor certification was filed in September 2022. Hence, your priority date is September 2022. You need to provide a better context when asking questions, cos lots of folks here probably skipped the labor certification process because we filed our I-140’s under the National Interest Waiver (NIW) category. Back to your question. If I understand you correctly, your I-140 application was received by USCIS on Aug. 24, 2023 and it was filed with premium processing. All things being equal, you should receive a response soon. Per USCIS, premium processing usually takes within 15 calendar days, but in some cases, could take up to 45 calendar days. adedammy009: For folks that a company filed for them (not NIW), they have to go through a PERM labor certification process. The labor certification (usually a long process) has to first be approved before they can go ahead to file their I-140 with USCIS. The priority date for these category of people is usually the date their their PERM labor certification was received by the US department of labor. October visa bulletin is out. EB2 ROW -JULY 08 2022 PD EB3 ROW - DEC 01 2021... at this rate, retrogression is unlikely except there is some miscalculation mid fiscal year on DOS part. Adjustment of Status For all employment-based preference categories, you must use the Dates for Filing chart in the Department of State Visa Bulletin for October 2023. 1 Like |

mayowa94: That’s a long shot!, I really can’t answer that, there are lots of factors to consider. Are you applying from within the US or outside? If you’re within the US, was your application concurrently filed (I-140 and I-485 together)? Generally, people say adjustment of status (for those applying for greencard within the US) is faster than consular processing (applying from outside the US). |
