Hello Good Day, My name is Lilian. I have a complex question about my EB2 NIW application. I have three kids living with me whom I have adopted as mine because they lost their parents, now that I am filling forms for EB2 NIW do I add them as my children? what is the implication. Do I go and prepare adoption document for them? I have just a daughter and both my daughter, I and my husband have international passports, these three children just joined us in 2023. Please advice me on the best way to go about this, do I go ahead to fill in their names as well or do I leave them behind? kindly let me know how to solve this. Thank You. |

MLNaz: This is not an immigration advise, for entertainment purpose only!. Speak with an attorney!! Firstly,You will have to make the adoption process in Nigeria legal. Contact a reputable attorney that deals with adoption process in your state. Verify and double verify to get all the necessary adoption papers to avoid getting slammed with accusation of child trafficking. Consider the timeline of getting this process completed to guide how your filing may go. If i was you, i will start the process like tomorrow. As for adding the adopted kids, they will be considered your dependent since you and your partner are currently responsible for their upkeep. You will need to document evidence of relationship surrounding the circumstance of adoption and general family activities. As for your biological kids, DNA testing may be required Two scenarios to discuss with your attorney of cost implication I. start the legal adoption process, add the adopted kids as dependents from the start of I-140 uscis petition. Downside: if adoption process fails, you can have dependents withdrawn at NVC stage or redress whatever caused rejection of adoption process. MLNaz: If you have already filed your I-140 petition, two options viz: I. You should be able to add them as derivatives at NVC stage if you so desire,so long all documentation of their legal adoption is available (Considering how fast NIW gets approved if you use premium service, see if this option is possible/feasible for the family). Caveat: NIW 140 premium processing timeline if you can afford it is usually within 45-60 days. transfer from USCIS Sending to NVC can be between 15 calendar days to as ridiculous as 3 months or more. NVC processing is a function of backlogs (there is a website you can check to se what the average timeline is on weekly basis) as well as providing all the documents required on time. upon completing the NVC documentary requirement, you face Interview scheduling wait time which depend on your local consulates interview availability. II. if the above route is not feasible, you may look into option of applying for them when you get to the US. I am not well versed on this process. the process is not as complicated, so long you can get the required adoption papers. (you can check family based groups on facebook to see those who have gone through adoption process legally in Nigeria to get an idea of process) other resources: search *** "US intercountry adoption process Nigeria" as a guide when speaking with a consultant |

mechango: Contact NVC via enquiry form or email to enquire what is required to remove your dependent/ derivative ( in this case your friend's spouse). NVC support team will guide the person. Remember to include the applicant NVC number for proper identification. |

Benwems:My EB2 NIW was obtained by using the services of Chen attorney with a PhD in STEM, some publications and citations. I have experience in industry and academia. |

Approval of EB2 NIW usually takes some months, except you pay for express which is less than a month. Mine was approved within four months. Then you apply for immigrant Visa after the approval. This is where it takes longer time depending on the US Consulate that will conduct your interview. Benwems: |

MLNaz:If you have the legal papers for adopting them as yours long before you file your case, I think you should be fine. This is not expert advice, though. For expert advice, I'll recommend you reach out to an immigration attorney for expert advice. |

Hi , I have a question about the eb2 niw. I have a masters in physics so I guess I qualify for the advanced degree option. I have 2 certifications in energy management,my work experience is as a physics lecturer for 3 years. I then moved to the USA but decided against pursuing PhD and instead up skilled in machine learning operations and now I am currently working as a machine learning operation engineer. My question is, can I use my past achievements as my qualification if my endeavor is more related to machine learning. Since I just started working in machine learning I don’t as yet have significant achievements there. I am working towards a machine learning certifications. Any advice would help as I am stuck on how to prove prong 2 , how I am well positioned to be able to execute my endeavor |
