They have to present evidence that maybe she is an agent of a rival company, she has a grudge against the company or that she knowingly lied against the company in order to harm then.
Where Erisco lawyers made the mistake is filing a criminal case. In a criminal case they would have to prove premeditation and malicious intent for her posts, and beyond all reasonable doubts. If it was a civil case, these conditions need not be met, all Erisco has to prove is that her posts caused grave damage to the company. This is why someone can be found liable for a crime but not criminally. Trump was liable for raping Eugene Carrol but not criminally guilty. Same with O J Simpson and his murdered wife.

This case is a no brainer and instituted just to lock the lady up.

Freedom of speech is entirely different from what she did, there are records ok. She agreed to apologize but later decline and dare Erisco to go to Court.

Court will not pass judgement base on sentiment and emotion; she had the opportunity to free herself but she was headstrong and this is the reason why we all are still here, thank you.
Once again, HER OPINION.. Her opinion has nothing to do with NAFDAC or SON.
Nigeria has not descended to a level where an opinion can become a crime.

Even if she has a case of human rights abuse, the fact she was found wanting on cyber stalking and other liable offences should have made her tow the peaceful resolution. Her case on fundamental rights abuse won't stop the same court in convicting her for her offences. There's a reason the popular say that the law is an ass. Where your rights stop is where someone else started,she doesn't need the drag, she has ran out of money hence her lawyer pleading for crowd funding, she has lost a baby in the process, her peace of mind has eluded her, her husband and family will be watching there movement because police is even against them. Is this all worth the "strong head" of not apologizing. Had it been he is influential and have someone close to BAT you might have a case. I am sad to say this but the court will make mince of her and even if she got pardoned she will have few months in jail. This is an issue that could have been resolved a long time ago, only if she had not taken back her apology i guess due to bad advice, she made a post about the product been sugary as if that was not enough she went as far as saying the product kills, and that people should go ahead and bring the product down haba, if she wasnt paid to do all this then she is wicked forgive me for saying that but she is wicked.

You're being too 'intelligent' for your own good.

If you think a product might be unsafe, say so, and the company would defend its product. But to outrightly say the product is killing people, you would have to show the people that have died from consuming it.

There's a huge difference between Bad review and Defamation.

Yes, she has lost a lot as you pointed out,but what of Erisco himself and his company, how much have they lost. Can you quantify the loss in monetary terms. Even Erisco, his staff and family would suffer some psychological stress as a result of dragging by the public. The longer this case persists the worse for the image of his company and thus his sales. Remember he invested billions in the tomato product, which he is yet to recoup.

Sorry to say this, but Chioma Egodi is a dark soul, if anything was wrong with the product, she should have gone to NAFDAC, or any regulatory agency, she seems feet to address the concerns. Going to Facebook was to destroy and malign Erisco products. Do you know the billions spent in there, initially they asked her to apologize she refused (because of a VERY VERY DARK HEART & PULL HIM DOWN SYNDROME) . If I was Erisco , I will pull string behind. Recall that the CEO of Erisco Foods, Eric Omeofia, had alleged in 2023 that a negative product review by a customer, Chioma Egodi, negatively impacted his business when she claimed that the Nagiko Tomato Mix she bought had too much sugar.

Okoli’s lawyer, Inibehe Effiong, told the court that his client suffered miscarriage in the course of the case and eventually lost her baby.

Okoli is standing bordering on conspiracy and cyberstalking leveled against her.

This erisco tomato paste matter should not have escalated to this extent in my opinion. The extent it has gone now is not helpful for an amicable resolution at all.

This is a lesson to everyone to be careful about the advice people give to you, especially if it's a legal opinion.

If you post a comment or say something the other party consider as offensive to his or her brand ,if your comment is a well-intentioned advice but ,unfortunately, taken wrongly, please just delete the comment(s), apologize to the one who took your feedback in a wrong way and move on with your life. If you're right, you will eventually be justified by posterity and one day the person who feels wronged today will credit you as the one who gave a truly sincere feedback yet you apologized for peace to reign. You become the bigger and more matured party eventually.

I will encourage her husband, family and lawyer to help her out of the current predicament. Let all the parties please explore amicable resolution options if it's not too late yet. It's good that she's being given the opportunity to defend herself so that justice can prevail.

The fact remains that the tomato paste she reviewed was sugary to her based on her taste buds, but she got it wrong by generalising. Even if NAFDAC conducted an interview it will still contain sugar but their report may show that the sugar level is within a safe range.
To Chioma, it could be sugary because she is not used to eating sugar and to Erisco Foods and NAFDAC report it may not be sugary because they are using an approved safe threshold.

This saga is an unfortunate situation for both parties involved. Erisco could have leveraged the publicity from the incident to promote the very product that was being criticized, turning it into an opportunity. Or they could have simply ignored the lady and moved on. The woman at the time did not even have the sort of online followers or influence to do any real damage to the product. The whole thing would have blown over in a week or two However, the owner's ego hindered his ability to recognize this potential, and his media team failed to guide him toward making the right decision. Consequently, the company now faces additional losses due to the impact of cancel culture.

On the other hand, the lady in question had a chance to walk away freely by issuing a simple apology. Instead, she decided to align herself with the agenda of a media-hungry, aspiring human rights lawyer. Her former lawyer had secured a deal that would have allowed her to issue an apology letter and avoid further consequences. But she fired him and hired Inibehe Effiong who has helped her complicate the case beyond what it should be. Now, instead of being released from detention, she faces imprisonment because the Erisco owner has vowed to pursue the matter to its conclusion. While I sympathize with her situation, she bought this upon herself.

This issue might end up destroying the company altogether. His reputation and that of his company is being destroyed. It has gone international, CNN and other international media are following the case.
From CNN analysis Erisco would have a difficult time proving the libel case against Chioma Okoli. She did not even write that the Tomato is Killing people, she wrote " tell your brother to stop Ki***ing people with his product ". please note the three asterisks. Killing is not an eight letter word.

I learn Erisco instituted both criminal and civil case. Also chioma Okoli Haa instituted her own civil case against Erisco.
