"Criminal Punishments for Defamation

Under Section 392 of the Penal Code Law, any person who defames another shall be punished with imprisonment for a term that may extend to two years, or with a fine, or with both. The Penal Code Law further extends the punishment of any person who prints or engraves a matter knowing it to be defamatory with imprisonment for a term that may extend to ten years, a fine or both, while the sale of printed or engraved material containing defamatory matter is punished with imprisonment for a term that may extend to five years, with a fine, or both.

By the provisions of Section 375 of the Criminal Code Act, any person who publishes any defamatory matter is guilty of a misdemeanor and is liable to imprisonment for one year; and any person who publishes any defamatory matter knowing it to be false, is liable to imprisonment for two years. A defendant who publishes a defamatory matter with the intent to extort is guilty of a felony and is liable to imprisonment for seven years."

All of these are anomalies.
These things remain civil wrongs as fundamentally conceived in our legal system.

One day these anomalous provisions will be set aside.

Olodo.

On a serious note. There are certain things that are anomalies within our legislation. And that's why I said your jurisprudence is weak. Don't be "chai-ing" there. Stop and dwell on what I am saying.

Globally and within our inherited common law system, libel and slander are recognized as civil wrongs, torts for which one sues. To criminalize them is to bastardize the law of torts. One may as well begin to criminalize other torts such as misinformation which traumatizes someone.

There are also laws in our books which are dormant. An example is the law against bigamy, which, being against our polygamous cultures, lies dormant and unused.

Therefore only a jurisprudentially weak lawyer will conclude that the criminalization of libel and slander is not anomalous. This is more so as there are delicate aspects of determination involved, such as what the accused believed to be true (a subjective thing) matters of opinion, etc.

I repeat, your jurisprudence is weak.

I laugh in mandarin. This section of the the law is so ambitious its unenforceable. It can only be employed to witch hunt the poor, vulnerable and helpless.

If we compile all the defamatory published statements by firstcitizen on this site, he will face more than a century in jail.

It's akin to the bigamy Law under Section 370 of the Penal Code I attached below. It is unenforceable. Dispute millions of Nigerians having second, third or even fourth wife, nobody has been jailed because of bigamy.

The Penal Code was made during the colonial era to serve the interests of the colonialists, has become obsolete and irrelevant.
If our legislature are actually interested in doing their jobs instead of pursuing constituency projects and allowances, they should have repealed and replace most of the Penal Code.

In addition, I just learnt that the Penal Code only applies in Northern Nigeria, the law that applies in southern Nigeria is the criminal code. Both laws are said to be different.

My dear, you have very limited understanding of law. An arrest is only the beginning of a process. It ends with a conviction by a court. In fact thats not really the end. It goes on to actual imprisonment or other penalties and possible appeals.

The reason you have criminal cases prosecuted by a Commissioner of Police in many instances is because that is part of law enforcement.

You are the confused one, and if you studied law there is a real problem if you don't know the difference between the Nigerian Legal System and the law.

I expect that this will fly over your head as well.

You're being too 'intelligent' for your own good.

If you think a product might be unsafe, say so, and the company would defend its product. But to outrightly say the product is killing people, you would have to show the people that have died from consuming it.

There's a huge difference between Bad review and Defamation.

Again a product does not need to directly cause harm for it to be harmful......I've given you a simple narrative and it is the same argument vegans use, read more about it!

you sound too shallow and unlearned. If you have diabetes and buy a product that is not good for your health, whose fault? The product's active ingredients were clearly written on the tin. There are many tomato mix out there in the market. If a particular one is not good for you, leave it and buy the one that is.

We can compare degrees and career achievement in order to know which one of us is a dumbo! Just like the warning smokers are liable to die young, it still does not change the fact that the product can cause you to kpai earlier than expected!

That's exactly what she's sued for. i.e to come forward and defend her review.

It's not so simple the way you deposit it up there. You have to now show the nexus with that particular product with empirical evidence, i.e any known case of death as a result of consuming that product.

Does everybody that takes sugar have diabetes? No

Was Sugar content stated on the tomato mix can? Yes

Did Chioma read the content before buying or even before reviewing? I doubt!

Was Chioma intended to buy "tomato paste or tomato mix" ?

.......So you can see the fact that Chioma doesn't need Sugar or indeed too much sugar doesn't mean everybody doesn't need it.

Do you know the sugar content in most of the fizzy/carbonated drinks is almost half of the bottle itself?

Again a consumer has the right to review the product or services consumed! This is non debatable! There's something called cause and effect, a product does not need to directly cause harm for it to be harmful.

Exhibit one:
Vegans accuse meat eaters of eating carcinogenic items aka red meat.

We have over 100 scholarly and well researched studies that shows red meat is carcinogenic.

We have thousands of people that die each year due to cancer from bad diet.

Are you saying as a meat company, you would sue such a vegan?

Exhibit two:

Climate change is real

A climate activist claims that deisel factory is polluting the air causing climate chnage which can result in people dying.

If you're the owner of that factory, will you arrest the activist even tho there are empirical evidence that confirms air pollution is having a disastrous effect on climate.

In summary, the charges does not correlate with the offense, it is hogwash and nonsenstical and can only succeed in a dystopian country like Nigeria!

Hope you are following up on that guy who got arrested that accused E-money concerning Junior Pope stuff?
People just catching cruise online just to make some money off people's life situation which majority of the times are false.

I'm not vouching for anyone, I'm voucing for the ACT! It is consumer's right to be able to critique items or services they paid for! You cannot silence people all because you don't like their review.

Some decades back, everyone taught smoking was cool and fashionable, now we know better thanks to research and people voicing out on the dangerous effects of smoking.......If we went by your analysis, we would have questioned their motive rather than look at the product itself!
