Firstcitizen: On a serious note. There are certain things that are anomalies within our legislation. And that's why I said your jurisprudence is weak. Don't be "chai-ing" there. Stop and dwell on what I am saying. Globally and within our inherited common law system, libel and slander are recognized as civil wrongs, torts for which one sues. To criminalize them is to bastardize the law of torts. One may as well begin to criminalize other torts such as misinformation which traumatizes someone. There are also laws in our books which are dormant. An example is the law against bigamy, which, being against our polygamous cultures, lies dormant and unused. Therefore only a jurisprudentially weak lawyer will conclude that the criminalization of libel and slander is not anomalous. This is more so as there are delicate aspects of determination involved, such as what the accused believed to be true (a subjective thing) matters of opinion, etc. I repeat, your jurisprudence is weak. |

Firstcitizen: I laugh in mandarin. This section of the the law is so ambitious its unenforceable. It can only be employed to witch hunt the poor, vulnerable and helpless. What dies "anyone who defames" means? Is this statement; Firstcitizen: Defamatory? What about this one?; Firstcitizen: If we compile all the defamatory published statements by firstcitizen on this site, he will face more than a century in jail. It's akin to the bigamy Law under Section 370 of the Penal Code I attached below. It is unenforceable. Dispute millions of Nigerians having second, third or even fourth wife, nobody has been jailed because of bigamy. The Penal Code was made during the colonial era to serve the interests of the colonialists, has become obsolete and irrelevant. If our legislature are actually interested in doing their jobs instead of pursuing constituency projects and allowances, they should have repealed and replace most of the Penal Code. In addition, I just learnt that the Penal Code only applies in Northern Nigeria, the law that applies in southern Nigeria is the criminal code. Both laws are said to be different.

Firstcitizen: My dear, you have very limited understanding of law. An arrest is only the beginning of a process. It ends with a conviction by a court. In fact thats not really the end. It goes on to actual imprisonment or other penalties and possible appeals. The reason you have criminal cases prosecuted by a Commissioner of Police in many instances is because that is part of law enforcement. Capital olodo. |

There's something called cause and effect, a product does not need to directly cause harm for it to be harmful. Exhibit one: Vegans accuse meat eaters of eating carcinogenic items aka red meat. We have over 100 scholarly and well researched studies that shows red meat is carcinogenic. We have thousands of people that die each year due to cancer from bad diet. Are you saying as a meat company, you would sue such a vegan? Exhibit two: Climate change is real A climate activist claims that deisel factory is polluting the air causing climate chnage which can result in people dying. If you're the owner of that factory, will you arrest the activist even tho there are empirical evidence that confirms air pollution is having a disastrous effect on climate. In summary, the charges does not correlate with the offense, it is hogwash and nonsenstical and can only succeed in a dystopian country like Nigeria! |
