Only the Federal High Court and no other court has the jurisdiction to determine cases of tenures and vacancies of House of Assembly, Governors and President and not the State High Courts (Rivers State High Court Inclusive).

Thanks boss for the clarification..

The final court in Nigeria where a House of Assembly tussle case would end is the Supreme Court. According to the Supreme Court (Additional Original Jurisdiction) Act, 2002,

So the Fubara is not shaking one bit because their DEFECTION TO APC has spoilt all their chances already.

The judiciary remains the last hope of the citizens.
The battle is over!
Wike should forgive Fubara for the sake of Rivers people while Fubara should allow peace to reign!

Nothing supreme Court can do here. All Fubara needs is to shop for a Federal High Court Judge to declare there seats vacant.

But I doubt if Fubara has made such plans.

There will be no need for anyone to pursue this case further.
My advice is that Gov. Fubara focuses on ensuring that he puts continues with the yet to be completed projects on ground and do others that meets the needs of the people. He should decrease the unemployment gap by employing more persons into the various sectors of the State Civil Service.
Priority should be given to Agriculture and agro allied produce and products. Put to useful use all the Health Centres built by the CRA administration that are yet to be in use and same with the Model Primary Schools. Just make the entire State a infrastructural and developmental hub.

This is just a jurisdiction matter . Makes me wonder why the federal high court in Kano which lacks same jurisdiction is pronouncing judgment on matters of traditional rulers . Well Supreme Court will do the needful

The Nigerian judiciary should be shut down. The whole system has been hijacked by bad politicians bent on turning the law on its head. The constitution is clear on the defection of elected officials, our judiciary is actually very stupid.

God will punish all of them and their supporters.

But where exactly in the judgement does it say Amawhule should remain speaker? Or Is the op trying to be disingenuous?

If the Court had said otherwise, would you have said the above? Justice is not a one-way traffic.

Who can explain this to us in a layman form?

Who is winning, Wike or Sim

You know it is the governor that controls the state courts. Don't say I told you o. So, the court of appeal is saying it is the High court that have jurisdiction. High court has said before that Wike team are still house of assembly members. So Wike has given Fubara a bad knockout.
