When I heard that Woke is constructing buildings in Abuja with the approval of Tinubu, I knew something is in the offing that worked in his favor. Well the matter is not ending here. It will go to Supreme Court, just to buy time.
I'm surprised that nothing was said about the local government tenure extension.
I thought it was the Appeal Court in Port Harcourt that was handling the Matter, how come it was the Appeal Court in Abuja that gave judgement?

Isn't what FUBARA went to court against other members electoral matters

Its purely a constitutional affair. Electoral matters are strictly for elections as conducted by inec, and they start from properly constituted tribunals which are outside the regular courts but are in equivalence with the high courts.

Fubaras case against them is a non electoral matter.

Fubara does not have any authority to recognize or derecognize
Just like the speaker does not have authority to recognize or derecognize Fubara

Imagine if the Ppresident says he does not recognize Fubara

Only the courts have such powers

Otherwise we would have anarchy

Let us wait and see what the police will do

That is the body that matters
The police not Fubara because that is the body with enforcement power
The Appeal court

INVALIDATED ALL THE RESTRAINING ORDERS issued by the state High Court
Which simply means .......
I think it is obvious
Crap. Total crap. In case you're not aware, it is the governor, just like the president that makes a proclamation for the constitution of the legislature .
It is the governor, just like the president that has executive powers and not the police. The police take orders from the president cause we have a central policing system.
Fubara as the chief executive of the state under advice from his AGF has the powers and authority to derecognise the members who defected until the court says otherwise. Judicial precedent that says legislators that defect lose their seats have not been vacated by this appeal court judgement. What this judgement simply says is that the SHC does not have the jurisdiction to hear the case. It does not validate their defection as in order.
The president cannot decide to recognize or derecognize Fubara because he is validly elected governor of the state. If he is removed by impeachment even if done wrongly, the president can use that as excuse to derecognize him until a court says otherwise.

So you all thought Fubara didn’t know the FHC has jurisdiction over the case only ! They wanted to impeach him he had to stop them and cause a problem to push them out thus using the state high court temporarily before approaching the Supreme Court . He knows how long this will take .The appeal court never instructed him to recognize the 24 law makers on legality .they only said he should take it to a FHC .. The 24 ousted law makers will continue to remain outside till the court of jurisdiction decides until it gets to Supreme Court . The 24 law makers no better than to celebrate until then .

How can appeal court decide a case not before it? FUBARA SHOULD HAVE APPEALED BUT FAILED TO DO SO Until this Appeal court stops further litigation on the matter

You advise him to approach a court ...

Same way these ones can also impeach him and advise him to approach the court..

Then there will be wahala everywhere.

For me, I think the best now is to find a political solution...Gov. Fubara can't win this case unless the PDP National backs him against Wike and the 25 Lawmakers.
Well, legislature cannot impeach a gov all by themselves.
Secondly, Fubara does not need PDP to back him to declare legislative seats vacant.
He just needs a willing FHC judge

Lol. They said the decision of the state high court declaring that Amaewhule is no longer speaker and the 27 members are no members of the Rivers state house of assembly is null, void and of no effect whatsoever. That is, the 27 members remain members and Amaewhule remains the speaker.

He will be impeached sooner than later. If he’s sensible, he should seek peace. He has lost already.

People are celebrating over a case that hasn't even started. Appeal court simply said that the case cannot be heard by a state high court.. what does that mean? It simply means that parties should go to the proper court for the CASE TO BE START PROPERLY... πŸ˜‚
This case go looooooonnngggggg... πŸ˜‚

If the court says the declaration of his seat vacant is null and void, what else do you want to hear.

Martins remains the speaker of the house and can comfortably resume sitting with the other lawmakers.

It's simple
The declaration by the court not declaration of the seat. You need to know that the declaration was done by Ehie and it is the legal seal that's broken.
I hear there's a pending case in an FHC already on the same matter
