A former member of the Nigerian Senate, Ita Enang, has urged the National Assembly to file a lawsuit against the federal government over the signing of treaties.

He was reacting to the recent signing of the Samoa agreement by the President Bola Tinubu-led administration.

The agreement, generally referred to as the Samoa agreement, was signed on 28 June at the Organisation of Africa, Caribbean and Pacific States (OACPS) Secretariat in Brussels, Belgium.

Details of the agreement indicated that the partnership is between the European Union and its member states on one hand, and members of OACPCS on the other.

Negotiations on the agreement began in 2018, and it was signed on 15 November 2018 by all 27 EU member states and 47 of the 79 OACPS states.

The African Regional Protocol on the matter consists of two parts – framework for cooperation and areas of cooperation that include inclusive and sustainable economic growth, environmental and human rights protection, among others.

Reacting Tuesday on Channels TV’s Political Paradigm, Enang said an agreement pursuant to a treaty must be made to pass through the National Assembly before being signed by the government.

He alleged that since 2002 the federal government had not been carrying the National Assembly along.

He said: “Even if it is an agreement pursuant to a treaty, so long as the interest of Nigeria is involved, it has to be laid before the National Assembly. I’m urging the National Assembly to take this matter to court.

“It’s not fighting the executive, because it will be helping Nigeria to determine whether all these treaties from 2002 till today, which is 22 years, which Nigeria has been signing without it being ratified by the National Assembly, some binding states, which those states are not a party to, because treaties of a certain character have to also pass through to the state houses of assembly and be approved by them before it can be finally passed by the National Assembly.

“They should take this matter for interpretation, either to the Supreme Court, its original jurisdiction. The National Assembly now has committees on treaties, which are standing committees, not in my time when it was ad hoc, just to address.

“The National Assembly or the Attorney General of the Federation, just like they have done in certain cases like the local government should go to court to interpret whether treaties ought to be laid before the National Assembly before they can become a law and if it is not, what is the legal status of the treaties, conventions and protocols which Nigeria has entered into, even the ones that grant loans, because if it is not lawful, then it is at the risk of countries or institutions, which has granted Nigeria money.”

Enang served as Senior Special Assistant to ex-President Muhammadu Buhari on Legislative Duties.

What has the treaty amounted to in 22 years? Why does he think this National Assembly has the balls to sue the Federal Government? Lastly, why is he hoping the judiciary would be fair in their judgment?

And how does that help the common man on the street or put food on the table of the poor?

There is something seriously wrong with black African nations. It's like a curse against any form of progress and development. Whenever black African nations take 2 step forward, they also take another 10 steps backwards.

Sign or no sign, the politicians in Abuja won't become poorer. Their allowances and every other juicy largesse would be intact.

If you are talking about the LGBTQ stuff, Nigeria was one of the countries back in November 2023 that declined to sign because of the LGBTQ insertion. The document was revised after Nigeria and some other Islamic countries protested and refused to sign. It was the revision with exclusion of the LGBTQ that was later signed a few days ago.

The NBA has debunked the LGBTQ stuff on the new document, BBC has debunked it, Premium times as debunked it. Perhaps, Nigerians are waiting for Jesus to come down from heaven to debunk it too.

A lot of you don't know nada, you just talk. That agreement is tied to access to foreingn loans. The current government of Tinubu has boxed itself into a situation where it can sell Nigeria for any loan right now, to correct its exonomic policy blunders, under very terrible conditions that will make Buhari appear like a genius.

That agreement is signd and nothing can be done about that. The country is on her knees and almost collapsing and you guys are talking about culture....culture kor, tradition nii.

Interestingly Nigeria is among the countries in Africa with low debt compared to its GDP.

When a new thing comes up to peoples hearing, it becomes a fad for newspapers and others to quote it as a reference point for those with little understanding of such terms to carry on the fallacy.

The truth is, Debt to GDP ratio is an irrelevant measurement for developing nations to gauge their prudence as regards loan structuring. In fact, no one uses it except the creditors to gauge the capability of a country to squeeze its national resources to repay loans in the case of default or loan recall. its is more like the measure of a collateral when you want to take loans. For the Banks, they are more interested in your ability to generate funds to pay principal+ interest, the collateral is a fall back security in case you default. To that extent, more focus is usually on the debt to revenue and more on repayment terms. To buttress this, check the Debt/GDP ratio of Japan, USA, China and other big economies of the world... and these are countries that give loans to other governments either bilaterally or through agencies like IMF/World Bank. In fact, recent studies on developmental economics have rubbished that ratio as a reference for anything other than the measure of a capability to payback when in default.

Read the recent report from the DMO and the alarm on Nigeria's rising Debt to revenue ratio.

The terms under which Nigeria have been collecting recent loans are very terrible, they smack of desperation to cover a self inflicted damage and its akin to selling the future of Nigerians to sustain the profligacy of the current politicians
