oselokak: lawyer or not that is not what i'm all about. Material misrepresentation carries 10yrs ban, when you claimed to have the money in your bank account but in reality you have removed the money that is misrepresentation. The embassy has the right to verify any document you submitted because you signed the disclaimer authorising them to do that. Every single yr we argue this here and people like you will turn up to encourage fraud with all sorts of false claim. This is not going to happen here this year. 1 Like |

justwise:Mr moderator, don't threaten me with a ban. I just answered a simple question. Someone asked if he can submit a POF statement days after it's maturity and I answered YES. The answer is YES regardless of what all u guys are saying. For example, u can submit a bank statement of June 1 to June 29 for the visa application today July 15. It's surprising u guys can't interpret a simple rule boldly stated on the UKVI website even with an example. And I never told the young man to remove his POF. Please don't threaten me with a ban Mr moderator, read and comprehend. Attached again is what's stated on the UKVI website. 1 Like

justwise:Hallelujah! We are finally joining issues. Material Representation: The UKVI laws (which someone screenshot and posted) asked for 1. A bank statement of 28days. 2. To be submitted within 31 days of the 28 days. That is the information submitted. Proof that I have XYZ amount on let’s say 28/2/2024. That is what the bank is asked to verify. The veracity or correctness of said statement. Can the bank pry into my statement afterwards? Please let me quote verbatim the CBN rules of Customer’s Bill of Rights and Duties ( a quick search on google can direct your footsteps) account details by the bank as well as intrusion into your account by third party. In other words, your bank must not divulge your account information to a third party; the bank must also protect your information from unauthorised access by a third party. There are, however, exceptions to this right as follows: 1. Where the bank is required by law to make disclosure; and 2. Where the customer consents to the disclosure. In 1. These are situations of fraud other other issues where a court issues an order after hearing the suit 2. A customer consents only to the extent of the statement submitted not forever and ever . If it were so , then any embassy can arbitrarily ask for updates of balances in perpetuity or even prior to the date. A customer’s consent is to the details he has submitted and for nothing else. Hence the reason for the request for reprints of statements after submission. A misrepresentation would occur when one falsifies the information he submitted. If peradventure I am issues with a visa or during the pendency of the application I need to use to touch 5k from the money to purchase airtime And then repay for school fee payment, would that be misrepresentation? Do you see how that sounds? I am well aware that Nigerians look for corners and shortcuts to circumvent the law and it would sound easier to just throw the baby of the facts out with the bath water, but that does not in any way change the facts or the law. This is not meant as a manual to teach any body unscrupulous practices but simply to correct a misinformation. If you read my earlier posts, I have said it IT IS SAFER TO LEAVE FUNDS PENDING THE APPLICATION because a visa will be refused if the visa officer is unsatisfied that the funds to support the education is unavailable if a reprint is asked for. But the declaration that a 10 year ban follows withdrawal of funds is a fallacy and untrue. Get the distinction so that you may be able to advice people better in the future 1 Like |

heykims: You started all this. You even went as far as posting stories of the Teesside students here. Last year you got your visa after terminating your POF for three weeks and you thought if the postal applied the same principle this year he would get his visa. With the current wave of Nigerians dropping out of schools making the news it is funny you would even mention what you did last year so someone can copy it in 2024. Be your brother’s keeper! |

heykims: I guess this is your only interpretation of deception (is when you submit a falsified document and not about the information you gave in your application if the money (POF) is available? In the law you quoted, I guess it was stated there verbatim that you can withdraw the POF after 28 days. It's funny as you are trying to bend the rules to favor you. I will expect that from an immigration lawyer. |
Re: Uk Student Visa/tier 4 Pbs - Your Questions Answered Part 9 by justwise(m): 12:04pm On Jul 15 |
oselokak: Yes. 1. airline ticket is NOT part of your maintenance money 2. Your maintenance money is to be used in the UK, the calculation is based on your monthly expenditure in the UK, so when you take out some in Nigeria AFTER submitting your visa application you have misrepresented your true financial condition. 3. UKiv is not aware that you have touched that money after submitting your application. So you have lied about the total amount avaliable in that bank account. |

oselokak: The last time I checked I haven't mentioned you and there's a reason for that. Or are you the same person with Heykims I quoted?! Few weeks ago, you have been the one asking people about their POF and if they kept it till they got their visas etc. I really don't have time for an argument. People should do what's right! |
