You earlier explained a scenario where let's say the applicant leaves Canada after extending his visitor visa to visitor record and then reapplies for visitor visa outside Canada...you said siuch extension to visitor record could be a trust issue for earning visitor visa . What about if the visitor record (extendion) is still valid in Canada and the spouse of the student wants to convert to SOWP with spouse PGWP and full time offer, how can an ongoing extension be a blocker for incountry applicantion for SOWP in this case if they have requested extension via visitor record? Pls enlighten us. House34: |
Re: Canada Visit/tourist Visa Discussion. by House34: 2:06am On Jul 28 |
Jeboy: Extending could be an issue if, after spending one year in Canada, you depart and suddenly return within a short period, even if your visa is still valid. I understand your question, but most of those loopholes are being blocked by IRCC. What people do is, after completing a course, they flagpole at the land border to get a PGWP instantly, and the husband gets an SOWP if the wife has a valid job offer. However, that option is now closed as PGWP via flagpoling has been stopped. Additionally, any other category of flagpoling is now done only at selected border crossings, unlike in the past when you could go to any border crossing. This means you have to apply inside Canada online and wait up to 3 to 6 months as the processing time could change. During this period, the main applicant is allowed to work pending the outcome of the PGWP, but the spouse cannot apply for an SOWP until the PGWP in approved . So, imagine a guy arrives in Canada with his wife, a student on a 1-year diploma course, and he arrives on a visitor visa. After 6 months, he manages to extend his stay, which is not guaranteed but at the discretion of the IRCC officer. Let's assume he is successful and gets another 6 months, making it one year. Then, the wife graduates, applies for a PGWP, and is waiting for the PGWP. What will happen to the guy after one year when his wife's PGWP is not ready yet. Again, I advise anybody coming to Canada as a student to think beyond that one-year course. You can only get a PGWP once, and after one year, if you are not nominated for PR or cannot get an LMIA, then that's the end. This is part of the issue many students are currently facing after a 1-year PGWP. What most students are doing now is either going for a master's or another one-year diploma program, which is not cheap, especially with the current job situation in Canada. IRCC noticed many students are changing schools, so they announced a new rule to change courses or schools inside Canada; you have to apply for a new visa, unlike in the past where you just notified IRCC of the change in writing without needing to apply for a new visa. All these changes are coming into effect soon. I wish all the students good luck; it really is not as easy as people at home think, being an international student in Canada. Sometimes, the law could be interpreted differently depending on the officer. I know a guy last year who arrived with a visitor visa and whose wife was a diploma student. At that time, the spouse of a diploma student was still entitled to an SOWP. However, the officer he met asked him why most people do not apply for an SOWP in their home country but come to Canada on a visitor visa and rush to the land border for an SOWP. The officer asked the guy what he told them at the airport when questioned, and the guy said he was visiting his wife. The officer refused his request and told him to go back to Nigeria and apply for an SOWP. Someone suggested he change his border entry and go to another entry point. He wasted a lot of money flying to another province, but the initial officer had already made a note on his file. When he arrived at another land border, the officer asked him only one question: "You applied last week and were refused and told to go home, but why are you here again" The officer asked for a copy of his return ticket, which he provided. The officer stamped his passport with a date just three weeks away, matching the date on his return ticket, and told him that if he did not depart Canada on or before that date, he would be illegal. 6 Likes |

Biamoz: You can use either of the two, but the new portal is less paperwork compared to using the GcKey. |

Try study route for Masters for her if u re capable. It means 27k CAD living expenses for both of you plus school fees averagely above 30k CAD. That will give her SP and you SOWP for the period of study and then after study 3yrs PGWP for her and 3 yrs SOWP for you. This is if she has BSc and 2.1 which most uni in Canada requires. Get someone who can give you good guidance on documentstion, it's not just about having d money Digriz: |

Hello all, I hope everyone is doing well. I recently submitted a visit visa application. I made an error when completing the form - "Application for Visitor Visa (Temporary Resident Visa) Made Outside of Canada (IMM5257)". I selected my country of citizenship as Niger instead of Nigeria. I noticed this mistake on my biometrics letter after submitting my application. I have reached out to the support team twice about this but haven’t received any feedback yet. A friend mentioned that I can proceed to book my appointment. Do you think I should proceed with booking or wait for a response from them? Thank you. |
