Let them enjoy 40 years, not 4 years
Na the Nigerian people go suffer all of these unconstitutional proclamations. By the time these folks are done, that Constitution will be dirtier than tissue paper. undecided

Headline and body don’t say the same thing to me.

Article seems to state the tenure can be elongated in 6 month tranches from the current 3 years up onto 4 years in cases of war or other special cases. It doesn’t read as a blanket extension for every LG.

The responsibilities at the LG level are so much simpler to achieve than those at the State and FG levels. Matching each LG Councilman with the same level of power that the one State governor in the same state has is a terrible idea because the ones who will bear the consequences are the people. undecided

↪The Justice, however, said that in respect of the six Area Councils of the Federal Capital Territory, Abuja, there is template legislation by the National Assembly.
He said that by way of sections 108, 109, 110, and 113 of the Electoral Act (2022), the dissolution (tenure of area councils), the vacation of seats of members, removal of the chairman or vice chairman, recall, etc. were addressed. And elections to the area councils are promptly conducted or held by the Independent National Electoral Commission.
“It is, therefore, unfortunate that some states do not even bother about conducting elections into local government councils as required by the relevant laws of their Houses of Assembly.
“Under Section 135(3) of the Constitution, the tenure of four years for the president, provided for by Section 135(2) thereof, shall be extended for periods not exceeding a period of six months at any time by a resolution of the National Assembly if it is not practicable to hold elections.
“By the same token, by a law of a State House of Assembly, the tenure of local government councils can be legally extended for any reason, such as insecurity or war, if it becomes impracticable or impossible for elections into the local government councils to be conducted.

“The mandate given to an elected local government council is the mandate of the electorate of that local government area, and if the tenure is extended, it is the people’s mandate that is extended.
“If the tenure of a local government council is truncated, as it is the norm now, it is an illegal termination of the electorate’s mandate, and it is not to be encouraged but roundly condemned.
“By the doctrine of separation of powers, it is the constitutional duty or function of the Legislature to make laws, which include amendments and repeals, and the duty of the judiciary is to interpret the laws to achieve the intended purpose of the legislation,” he said
.
Ust imagine how the justices twist the law as they see fit. That Constitution has so far been made a joke of by the Supreme Court of the land. What other evidence does one need to realize that the courts are not on the side of the people of Nigeria but the whims of the politicians? undecided

State governors seizure of local government authorities powers and funds led to states having the state capital as only livable city. Imo state is typical example.

The seizure is a criminal offense. Skirting around this fact by tossing out the constitution is not the best approach to resolving an obvious problem of corruption in the system. During the last 25 years, each time the government resorted to using this approach in dealing with problems of corruption in the system, the result has almost always been a further crippling of the position of the electorates in their government. A better approach would be for the electorates to call for the impeachment of implicated governors followed by their prosecution. As it is, these governors are still looting the system without

As it is, that Constitution is no longer the backdrop of the Nigerian democracy but merely a side document, a joke! undecided

Garbage said that LGAs in Nigeria, unlike branches of incorporated bodies or entities, are constitutionally the third tier of government in the Federation.

Garbage said something, we are listening.

They are yet to agree if their own 3 member is not the authentic one or the 26+ is the authentic one. Probably he is at liberty to choose which court and judgment to adhere to. At the appropriate time I guess, the enforcer will be sent when it's all clear.

Let's just hope that is not the language used by the SP court.
Let's hope it's the media that has used that phrase "to enjoy'

Cus if it's the Supreme Court then highly pathetic.

That is not an actual judgement per se. The judge just interpreted a law written down in past times according to the electoral laws. The laws of the State are supposed to mirror the extant laws of the FG and the FCT.
In effect the laws amended by the 26 member is in order if the 3 member are the illegals.
By this interpretation and understanding the court judge who sacked the elected chairmen will be found wanting.
The judiciary and the NJC needs a thorough cleansing and clean up in the entire federation.
