Sometimes I wander if there is any integrity left in the judicial system of this country.

If policy don't take part in the election, would that means the election is illegal.

Is police now inec that is supposed to conduct an election.

Why not direct inec not to conduct the election If your judgement has no bigmanphobia and the favoured me agenda.

Aweee, I strongly disagree with you blindly supporting what’s not right. A proper omoluabi should always stand up for what’s right. It’s not just about about blindly following our own without true criticism for a good cause.

The order of the federal high court on it own is even juvenile. The FHC did not say election should not hold but says police should not provide security and INEC should not release voters' register to RSIEC.
Now, see the juvenile in the order. You didn't say election should not hold but still went ahead to tell an institution to provide security for the election you didn't stop not to provide security, which is its statutory duty. The judge certificate need to be seized from him asap.
Again, it was even wrong for him to entertain any suit as regard the local government election because the highest court of the land had given express judgement to all states to conduct election within three months of their judgement. Why would any lower court feign ignorance of such judgement of the supreme court. He should have blatantly rejected the suit for an order to wanting to jeopardise the conduct of the local government election as there is a superior order of the highest court of the land. He should have told them, he cannot give such order until they place unnotice those that will be affected by the order. That would have shown he is following the rule and he knows what he is doing.
There is no point repeating myself. We will see how it goes post the election.

So to you the courts can bar the police from providing security for Amy part of the Federation? Next the courts can also bar the army fr defending any part of Nigeria if invaded?

that the police would refrain from providing security during the elections, citing compliance with a Federal High Court order.

This means that police will do their work of providing normal security in the state, but will not dispatch officers to take part( of course security wise in the election)

The NBA are using sense to make it sound like the court said police should stop work.

Are elections done everyday? Are elections not a special process that usually demand police presence?

So the police is saying that court has told them not to take part in it. The police never said they would neglect their normal duties of general security.

Whether the courts were right or not is not the issue here.

Be like say english hard for many people.
It's not about elections per se, its about providing security if and when there is a breakdown of law and order. So what the court is saying is that if there was a crime being commited or there is break down of law and order during the elections, the police should not step in and make arrests.
Even if its a birthday party and there is a possibly of a breakdown of law and order, the police should just be onlookers and not interfere.

The Police is meant to provide security whether there are elections or not. that is all the NBA said, even if they don't provide security for polling units they are to protect citizens nonetheless, it is a constitutional role that even the biased court should know and differentiate in clear terms from election security. Comprehension isn't that difficult

Nigga hush! No court can stop the police from carrying out it's constitutional role. The only reason police is against this and behaving like this is cause they want to and the court order is just a nice reason for them to give. Again, if there is a break down of law and order, of cos the proper thing to do is to reach out to the police either by calling or going to the station.

Even if it's a birthday party and something goes wrong, it's to call the police.

But this court order is very specific ( the L.G.A elections)

Once again the courts have no say where and when elections are held. The courts cannot set date and time for federal, state or local government elections. It can only litigate about the legality of elections after they have been held.

It's like setting the date of your birthday or wedding, and the courts ordering the police not to provide security at the venue. You might have asked for police protection because your enemies have insisted that you must not celebrate your birthday on a certain date, and that they would cause mayhem if you do.

NBA is talking nonsense. I agreed with you 100%. NBA became fractionalized, political and irrelevant to national politics beginning from Jonathan era. All the human rights lawyers along their axis, very popular SAN Lawyers defended Jonathan government ridiculously. One of them defended Yahaya Bello against EFCC on print and electronic media recently.
The election of Paul Usoro, Olumide Akpata and this present Osigwe are purely political.

When Afe Babalola and his kinsman Wole Olanipekun from Ekiti both very experienced Lawyers were fined for challenging Supreme Court judgement in Bayelsa few years ago I know something happened in the background. People said Mary Odili acted against IMO Supreme Court judgement. It is not surprising that NBA can ask Police to provide security for an election the Court had restricted INEC from participating . Is there no difference between maintenance of order and security as encapsulated in the constitution and defending illegality.

In 2015, Presidential election was postponed on Security Reason. Events have been suspended or postponed based on Security report . It is the duty of Police and DSS to determine the security situation of an environment. It is the duty of the Court to give judgement and the duty of Law Enforcement agencies to enforce court judgement.

I believe you and the other person are in the same room or might even be the same person. The analysis he gave you is for kindergarten pupils.

The Interpretation of Laws is done by Judiciary and not Social Media miscreants. The duty of Law Enforcement agencies is to enforce Laws delivered by the Judiciary. If the judgement is not fair to any party it can only be challenged in Law Court anything contrary is against the law as delivered by the last Court of competent jurisdiction.

The police won't support that illegal election in disobedience to the court. This present NBA leadership is desperate to create the impression that they are working. Better focus on tackling the issue of seal and stamp.

The court and the police. Both seem to be working in concert to prevent Rivers State Election commission appointed by the governor from conducting local government elections.
It is unconstitutional for the courts to order the police not to perform their constitutional duty of providing security and its unconstitutional for the police to obey an unconstitutional court to obey an unconstitutional order.
The courts cannot order the police to commit an murder and the police cannot commit murder based on a court order.

The police is not in any position to support any election - legal or illegal. They are only to provide security to elections or any other situation that requires security. There are ample provisions within the law to determine the legality or otherwise of election after they have been held.

It was not the courts or the police that suspended the 2015 elections. It was INEC itself that rescheduled the elections based on advice by the government. The courts and police don't have any role in determining when elections are to be held.

Are you guys insinuating that INEC can determine a date for general elections and a high court judge can then declare the elections cannot hold on the said date, and then the police would prevent the elections from holding?

Hmm... Those are valid points.

My premise was( I may be wrong) that the rivers state government was prevented from carrying out the election by a court ruling.... Hence the further directive that the police should not take part in it too.

I don't get what u meant by ur first paragraph o. This is me and me only.

I replied someone who called me out and made some valid points.

Am of the opinion that the court is above the police. Wether the judgment is fair or not is another thing. The police in this case acted frm the point of a court ruling.
If they ca challenge it before the election, then fine.

The supreme court of Nigeria which is the highest court in the land instructed all states involved to ensure their LGA election is held within 90 days. How on earth will a high court in Abuja counter such order? Moreover, Fubara also got a counter court order from the River state high court to go on with the election, supporting the order of the supreme court, mind you, the Abuja high court is not superior to the River state high court. In such situation, the police should have obeyed the order of the highest court in the land, but, they took a political side by supporting Wike , this àct by the Nigerian police is a total disgrace , should be punished by the court and the presidency, unfortunately, na Dem Dem.
