Sometimes I wander if there is any integrity left in the judicial system of this country. If policy don't take part in the election, would that means the election is illegal. Is police now inec that is supposed to conduct an election. Why not direct inec not to conduct the election If your judgement has no bigmanphobia and the favoured me agenda. |

blowjohn:It's not about elections per se, its about providing security if and when there is a breakdown of law and order. So what the court is saying is that if there was a crime being commited or there is break down of law and order during the elections, the police should not step in and make arrests. Even if its a birthday party and there is a possibly of a breakdown of law and order, the police should just be onlookers and not interfere. |

blowjohn: Once again the courts have no say where and when elections are held. The courts cannot set date and time for federal, state or local government elections. It can only litigate about the legality of elections after they have been held. It's like setting the date of your birthday or wedding, and the courts ordering the police not to provide security at the venue. You might have asked for police protection because your enemies have insisted that you must not celebrate your birthday on a certain date, and that they would cause mayhem if you do. 1 Like |

All the human rights lawyers along their axis, very popular SAN Lawyers defended Jonathan government ridiculously. One of them defended Yahaya Bello against EFCC on print and electronic media recently. The election of Paul Usoro, Olumide Akpata and this present Osigwe are purely political. When Afe Babalola and his kinsman Wole Olanipekun from Ekiti both very experienced Lawyers were fined for challenging Supreme Court judgement in Bayelsa few years ago I know something happened in the background. People said Mary Odili acted against IMO Supreme Court judgement. It is not surprising that NBA can ask Police to provide security for an election the Court had restricted INEC from participating . Is there no difference between maintenance of order and security as encapsulated in the constitution and defending illegality. In 2015, Presidential election was postponed on Security Reason. Events have been suspended or postponed based on Security report . It is the duty of Police and DSS to determine the security situation of an environment. It is the duty of the Court to give judgement and the duty of Law Enforcement agencies to enforce court judgement. |

blowjohn: I believe you and the other person are in the same room or might even be the same person. The analysis he gave you is for kindergarten pupils. The Interpretation of Laws is done by Judiciary and not Social Media miscreants. The duty of Law Enforcement agencies is to enforce Laws delivered by the Judiciary. If the judgement is not fair to any party it can only be challenged in Law Court anything contrary is against the law as delivered by the last Court of competent jurisdiction. |

It is unconstitutional for the courts to order the police not to perform their constitutional duty of providing security and its unconstitutional for the police to obey an unconstitutional court to obey an unconstitutional order. BondRiv:The police is not in any position to support any election - legal or illegal. They are only to provide security to elections or any other situation that requires security. There are ample provisions within the law to determine the legality or otherwise of election after they have been held. |

professorPABX:It was not the courts or the police that suspended the 2015 elections. It was INEC itself that rescheduled the elections based on advice by the government. The courts and police don't have any role in determining when elections are to be held. Are you guys insinuating that INEC can determine a date for general elections and a high court judge can then declare the elections cannot hold on the said date, and then the police would prevent the elections from holding? |

wirinet: Hmm... Those are valid points. My premise was( I may be wrong) that the rivers state government was prevented from carrying out the election by a court ruling.... Hence the further directive that the police should not take part in it too. |

Am of the opinion that the court is above the police. Wether the judgment is fair or not is another thing. The police in this case acted frm the point of a court ruling. If they ca challenge it before the election, then fine. |

The supreme court of Nigeria which is the highest court in the land instructed all states involved to ensure their LGA election is held within 90 days. How on earth will a high court in Abuja counter such order? Moreover, Fubara also got a counter court order from the River state high court to go on with the election, supporting the order of the supreme court, mind you, the Abuja high court is not superior to the River state high court.
