It is very simple , the case is bailable , he will be granted bail at the next hearing , but if he has any proof about all the allegations he made against afe Babalola then he should present it to the court and Nigerians when the case finally gets on
You should not be arrested in a defamation case absolutely not it's a civil matter... U sue for damages... U can't go to prison for defamation

Why can't the judge set the bail today ? Since this is a basic matter?... The plan has always been to send him to prison for a few weeks

Depending on international jurisdictions, defamation is treated as a criminal offence instead of a civil wrong

Illiterate, defamation has been decriminalized in Lagos state but very much effective in Ekiti state where the plantiff filed the suit.

last I checked...u can go to jail for defamation according to Nigeria law...what nonsense are u saying, is Nigeria now using Biafra or USA law ?

That is the due process in Nigeria. If a case is filed in the wrong court or wrong section of the law, the court will throw the accused into prison until the prosecutor does the needful.

If the case is being delayed, the defence counsel can go to the state ministry of justice and demand that the accused be released. The ministry will grant the plea.

However, this case now is dicey because Mr. Dele accused the Supreme Court of being corrupt. Politicians (specifically Peter Obi) need to get involved or Dele should provide the evidence he said he has. Afe Babalola seems to have a soft spot for PO.

As a senior lawyer, I wish to state categorically that the Allegation are weighty and its a criminal defamation case and not a civil matter.

Hence the involvement of the police is justified.

It is left for Bar. Dele to defend himself with strong evidences and not hear say evidences.

How can there be evidence... How can you claim supreme judges are bribed and you don't have evidence but proceeded to publish it in a book for the whole world to see.

The law allows for both civil and criminal suits to be filed by the complainant.
