ABUJA-Determined to make the federal government comply with court judgment on elections, the All Progressives Congress yesterday wrote a letter to President Goodluck Jonathan and the chairman of the Independent National Electoral Commission, INEC, Professor Attahiru Jega asking him to give heed to the judgment barring the involvement of soldiers in elections.

The letter, dated February 16, 2015 emanated from the Director, Legal Services of the APC Presidential Campaign Council, Chukwuma-Machukwu Ume (SAN)

Though it was addressed to Jega, copies of the letter were also made available to President Jonathan, the National Security Adviser, the Chief of Defence Staff, the Chief of Army Staff, Chief of Naval Staff, Chief of Air Staff and the National Chairmen of the APC and the Peoples Democratic Party.

APC in the letter called the attention of the federal government to a judgment delivered on January 29, 2015 by Justice R.M. Aikawa of the Federal High Court, Sokoto and another by the Court of Appeal, Abuja, on February 16, 2015 which overruled the use of military in elections.

The letter read in parts, “I am sure all well-meaning Nigerians share your deep seated concern on the militarisation of our elections.

“It is therefore imperative your good office and commission ensure, henceforth, and until there is an enabling Act of the National Assembly, the court orders are obeyed and armed forces personnel are never again deployed in any form of security supervision of our elections.”

Justice Aikawa of the Federal High Court in his judgment on the suit marked: FHC/S/CS/29/2014 among others, restrained the President and Commander-in-Chief of the Armed Forces of the Federal Republic of Nigeria and INEC “from engaging the service of the Nigerian armed forces in the security supervision of elections in any manner whatsoever in any part of Nigeria, without the Act of the National Assembly.”

Justice Abdul Aboki, in his lead judgment in the Ekiti State Governorship Election appeal on February 16, held that “even the President of Nigeria has no powers to call on the Nigerian armed forces and to unleash them on peaceful citizens, who are exercising their franchise to elect their leaders.

“Whoever unleashed soldiers on Ekiti State, disturbed the peace of the election on June 21, 2014; acted in flagrant breach of the constitution and flouted the provisions of the Electoral Act, which required an enabling environment by civil authorities in the conduct of elections.”

To engage da military or not during elections or wherever is not for da courts to decide,its exclusively for da CnC to decide..so if those roguessgot nothing evil up their sleeve,they ought notta be gittery or losing sleep over da deployment of da military, n other security agencies,during or after elections..

Did u read the part where a COURT ORDER was mentioned? D 'Ekitigate' tape has dented the integrity of the military if not, I won't have any problem with soldiers being deployed on that day. The truth is, there are more Gen Momohs waiting to do biz with Fayose and Obanikoro. smh

Considering the current state of the nation, anyone who says soldiers should not be used to help beef up security during elections is worse than the devil.

APC wants to repeat 2011 massacres. Even when there was no election ( during campaign), the president was attacked at least 4 times. How much more when they know they would loose?

Army or Police?

Infact I have a question.....why can't we use the police for elections?

Because in fifteen years of PDP rule...the Police has not been properly funded. Recall that it took Channels TV to make the govt renovate the Police College, in Ikeja.(and having seen police colleges abroad...our own college is a mess).

The Police is in a mess. By asking for the Army to maintain peace in this elections....the govt over the years(because this is not the first time BTW)...has admitted that the Police has failed.

High time, I think that the National Assembly increased funding for the Police. Infact....forget about State Police....our National Police is on life support! If the Police and Civil Defence cannot maintain security when the Army is otherwise occupied....what do we have a Police force and the Civil Defence for?

Abuja better step up and improve the police.

Below are excerpts from the court judgement:

It however reiterated that the use of Armed Forces in the conduct of elections was in violation of section 217(2)(c) of the Constitution and section 1 of the Armed Forces Act.

It cited and relied on a judgment delivered by Justice R. M Aikawa of the Federal High Court in Sokoto ‎on January 29, 2015 barring the use of the armed forces in the conduct of elections.

The appellate court therefore barred the use of the Armed Forces in the conduct of future elections in the country as such constituted a violation of both the Constitution and the Electoral Act.

Justice Aboki held, “Even the President of Nigeria has no powers to call on the Nigerian Armed Forces to unleash them on peaceful citizenry who are exercising their franchise to elect their leaders.

“In the event of insurrection or insurgency, the call in Armed Forces to restore order must be with approval of the National Assembly… as provided in section 217(2) and 218(4) of the Constitution as ammended.

Mr Chukwudi, even President Jonathan (if at all he has respect or regards for the Electoral Act and the Constitution) has no right to unleash the Military for any elections.

The only reason, people dont turn out to vote is the violence always associated with elections. How can one guarantee safety and other sharp malpractices if the military is not there to maintain decorum?

The letter will not get to GEJ. It will die on Abati's desk.
