Moment after General Muhammadu Buhari was declared winner of the march 28 Presidential contest,19 APC members of Ekiti State House of Assembly instituted impeachment proceedings against Governor Ayo Fayose and his Deputy Dr Olusola Eleka. The offence of Fayose and his deputy according to the 19 APC Lawmakers bothered on alleged "gross misconduct".

Constitutionality And Illegality of The Process
1.The embattled Speaker and leader of APC 19 Dr Adewale Omirin was "impeached" last November. He filed lawsuit filed on November 26, 2014, at the Federal High Court Lagos, with file No: PHC/L/CS/1823/14 challenging his impeachment as Speaker of Ekiti State House of Assembly. The court is yet to decide on the matter. That alone nullifies the action of his group because they need to wait for the outcome of the suit.

2. The Clerk Mr Joseph Esan and the "incumbent" Speaker Hon Olugbemi wrote the Chief Judge of Ekiti State Justice Ayodeji Daramola to disregard purported impeachment notice by Omirin group citing that Omirin remain impeached as Speaker and his case is still pending in court. The Clerk who is empowered to serve impeachment notice on the Governor has said there is no record of such deliberation by the Parliamentarians.

3. The so-called G-19 did not sit in the Assembly Chambers and the maze was not present. They sat outside the state capital, which renders such sitting illegal, null and void. The Chief Registrar of the Ekiti State Judiciary, Obafemi Fasanmi, was even quoted by the News Agency of Nigeria as saying the Chief Judge had not received any directive from the lawmaker to set up an impeachment panel against Ayo Fayose and his Deputy.

Until after judgement is passed, irrespective on where it swings, they will have to start the process all over(that is if the judgement is passed anytime soon which we all know is impossible). Their tenure ends first week of June, they have to pray that all legal bottle-necks are escaped before the end of their tenure.

Conclusion
Pending the judgement of the Federal High Court, Hon Olugbemi remains Speaker of the House as stated by the Clerk of the House. The Clerk and Office of the Chief Judge of Ekiti State through Ekiti state Chief Registrar has made it clear that they are not aware of any impeachment. It's like you don't understand. Neither the Chief Judge nor the Clerk recognise Omirin as Speaker. The matter is a legal one that Omirin and his group are aware. Remember, it impeachment process involve both the Judiciary and legislative arm. There are many hurdles that need to be crossed.

The slaughtering of dogs and baboon they promised was averted by the clever machinations of the pdp to keep Nigeria together.
What they failed to get at the Ekiti polls they want through violent means. This would be resisted, the Ekiti mandate was freely given to Fayose.

Fayose is very hard to protect. He has messed himself up everywhere he turns. There is so much more that he can be chased out with. He has put the sharp knife under his own stomach, all he needs is a small push or little wind to blow and he impales himself with the knife.

My brother, I just de laugh them. They have tried every means to stop Ayo Fayose without success now they are resorting to illegality. They are aware of the impending 26-0 that will befall them tomorrow, they are doing all they could to "pull down Fayose". This reminds me of their navigator when he was in power.

I smell hypocrisy in the topic.

You should have started from how 7members of the state house of assembly illegally impeached Ominrin and how his security aides were withdrawn and the illegal speaker got security aides attached to him,then how Fayose used the 7members of the state assembly to illegaly govern the state.

If the 19lawmakers cannot perform their legitimate duties in the house of assembly complex,blame it on Fayose who use thugs to harrass the lawmakers.

Why suddenly was Ominrin's security aides restored and that of the illegal speaker withdrawn? Doesn't it tells you that Ominrin is still recognized as the authentic speaker?

Fayose must be impeached whether it is from now till May 29th or when Buhari is sworn in. He must not escape the punishment!

Moment after General Muhammadu Buhari was declared winner of the march 28 Presidential contest,19 APC members of Ekiti State House of Assembly instituted impeachment proceedings against Governor Ayo Fayose and his Deputy Dr Olusola Eleka. The offence of Fayose and his deputy according to the 19 APC Lawmakers bothered on alleged "gross misconduct".

Constitutionality And Illegality of The Process
1.The embattled Speaker and leader of APC 19 Dr Adewale Omirin was "impeached" last November. He filed lawsuit filed on November 26, 2014, at the Federal High Court Lagos, with file No: PHC/L/CS/1823/14 challenging his impeachment as Speaker of Ekiti State House of Assembly. The court is yet to decide on the matter. That alone nullifies the action of his group because they need to wait for the outcome of the suit.

2. The Clerk Mr Joseph Esan and the "incumbent" Speaker Hon Olugbemi wrote the Chief Judge of Ekiti State Justice Ayodeji Daramola to disregard purported impeachment notice by Omirin group citing that Omirin remain impeached as Speaker and his case is still pending in court. The Clerk who is empowered to served impeachment notice on the Governor has said there is no record of such deliberation by the Parliamentarians.

3. The so-called G-19 did not sit in the Assembly Chambers and the maze was not present. They sat outside the state capital, which renders such sitting illegal, null and void. This Chief Registrar of the Ekiti State Judiciary, Obafemi Fasanmi, was even quoted by the News Agency of Nigeria as saying the Chief Judge had not received any directive from the lawmaker to set up an impeachment panel against Ayo Fayose and his Deputy.

4. On realising the illegality of their actions, the APC G-19 Lawmakers on April 9, 2015 applied to the Federal High Court, Lagos seeking to discontinue the suit they filed in November 2014 which is still pending. thenationonlineng.net/new/19-ekiti-lawmakers-seek-to-withdraw-suit-against-fayose-others/. By this action, they have admitted themselves that all they have done so far amount to illegality and nullity. They will have to be patient for the Judge to rule on the matter.

What Next For APC G-19?
The APC G-19 will have to wait for the Court to decide on their application, and ofcourse there will be lots of counter application to delay judgement. Until after judgement is passed, irrespective on where it swings, they will have to start the process all over(that is if the judgement is passed anytime soon which we all know is impossible). Their tenure ends first week of June, they have to pray that all legal bottle-necks are escaped before the end of their tenure.

Conclusion
Pending the judgement of the Federal High Court, Hon Olugbemi remains Speaker of the House as stated by the Clerk of the House. The Clerk and Office of the Chief Judge of Ekiti State through Ekiti state Chief Registrar has made it clear that they are not aware of any impeachment. Governor Ayo Fayose and His Deputy have nothing to fear. I hope the G-19 Lawmakers sheath their swords and embrace peace for the interest of Ekiti State. There is No Way a Governor can be impeached without the CJ and the Clerk's involvement.

I hope the G-19 tow the path of reasoning.

let's get to the crux of the matter,7 members (which does not form a quorum ) of the ekiti house 'impeached' the speaker, whether the case is in court or not, it is very clear,7 members can't impeach the speaker and suspend 19 members in a 26 member house,it is can't stand
Churchill Adedipe, majority leader, confirmed on channels tv that the case has been withdrawn, so that renders that particular point mute.
now to use your tactics against you,you said the motion was moved in the absence of the mace, without the clerk,etc. inspite of this, fayose has filed a case to stop impeachment proceedings!
let's leave the legal details and parties aside, if in truth you want our democracy to be deepened and want the best for the nation like you always claim,how on earth do you believe the impeachment of the speaker should stand?

People's mandate after the video of illegality that was planned and executed in Ekiti. I laugh in spanish. Or you think that video has been forgotten. Fayose will spend the rest of his days battling one misdeed or the other. Thank God you resent illegality, because all the illegality will soon be the very bane of Fayose. The impunity, use of military like house boys and the threatening of others. What about the rumors of murders that need to be investigated. There is no statute of limitation on murder. My brother, I just de laugh them. They have tried every means to stop Ayo Fayose without success now they are resorting to illegality. They are aware of the impending 26-0 that will befall them tomorrow, they are doing all they could to "pull down Fayose". This reminds me of their navigator when he was in power.
my God, I can't believe what I am reading,where is your sense of morality and fairness. let's assume pdp wins the 26 seats on Saturday, and apc with their new found federal power ,poach 7 of the lawmakers lock out the remaining 19 and then impeach fayose,would you still come up with the rationalization you put up here? supporting a particular party shouldn't result to losing all sense of decorum and fairness, common! we all criticized obj for these kind of things during his administration, 8 years on, you are trying to rationalize it. this is trash
