The boy with step mother denied due to information issue, which later made the Embassy to request for my DNA along with my half sister, please we will be coming on Wednesday ma, what are the needed items to come with ma? And please help check or include our names on the list ma, Semiu and Hameerah ma. It has never occurred to me that you are a white woman, anyway best of luck any where you go. |

veecee29: I'm assuming you can send a photocopy -- because when the petitions arrive in Lagos, they contain photocopies, and the beneficiaries then show us the original documents (which we return to them at the time of the interview). |

richposh: You're the person whose wife entered the U.S. on a Diversity Visa, claiming to be someone else's wife, right? I would not compound that fraud by committing more fraud. She should file an I-130 for you as her husband, if you are legally married, and then if it turns out you have an ineligibility, you'll be given instructions for applying for a waiver of the ineligibility. |

ezychris: It does not sound like you are eligible for an immigrant visa. Your aunt is not one of the relatives who can file an immigrant petition on your behalf. Furthermore, it sounds like you're planning to try to get a non-immigrant visa and misuse it in an attempt to remain permanently in the United States; if that's the case, you don't qualify for a non-immigrant visa, either, because you are an intending immigrant. You might look into studying in the United States (and you can ask questions about student visas on the non-immigrant thread, https://www.nairaland.com/1792662/u.s-non-immigrant-visas-listening ). But you can't immigrate permanently to the United States just because your aunt lives there. |

She entered the U.S as single, we were not legally married but we had kids as at when she was selected. |

Oh dear VO u will be greatly missed. Cos u are God sent to us here on nairaland... thanks for leading us right.. a quick question ma. u sometimes said immigrant visas expires when our medical does. Pls does this mean my k1 visa which was issued to me and given six month will expire before then cos I did my medical last year November meaning my medical expires next month does this have effect on my visa also?? |

richposh: Thanks for clarifying. She can file the I-130 for you, and the kids can be included as derivatives. Technically she entered the U.S. fraudulently, as she didn't list the children on her original entry and therefore was not entitled to the Diversity Visa... but that's not the category of fraudulent immigrant that immigration officials are interested in prosecuting these days. (We might suggest DNA to show that the kids are really hers, since from our perspective she didn't seem to have kids when she left.) |

bewaji25: Thanks for asking. Your visa will not expire, but you need a new medical exam or you will have troubles entering the United States with your expired exam. We would prefer that you brought us the new medical exam and let us include it in your immigration packet -- but in this case you can also hand-carry it and explain to the Customs and Border Patrol agent that we made a mistake and failed to match your visa expiration date to the expiration date on your medical paperwork. In any case, if you attempt to enter with an expired exam, you may be delayed for several hours or more than a day and will certainly have to get a new exam, which is very expensive in the U.S. |

Thanks for that response, my kids miss their mum and would like to be where she is and even if she files for us am of the fear that I might ruin their chances of the kids reuniting with their mum because of my previous and many refusals. So my question is, can she file for the kids alone and leave me out for now and since the DNA would prove if their hers or not? I am not bothered about going to the states for now but my kids are the ones that am bothered about. |

richposh: Honestly, your previous and many refusals will not have a detrimental effect upon your children, and as long as the officer believes you have a bona fide relationship with your spouse, you'll end up with a visa too (even if you have to apply for a waiver of whatever ineligibility you may have). We don't condone visa-related misbehavior, but we won't keep a family apart permanently unless the misbehavior was much more serious than using a different identity or submitting false documents or whatever. (Now, if someone was using a false identity in an attempt to conceal a dangerous criminal history... but it doesn't sound like that's the case here.) Also I should mention that if she files for you with the children as derivatives, she only has to pay for one petition; which is less expensive than filing for each child separately. But, ultimately, it's up to you and her! |

So when is the appropriate time for her to file in the petition because she just moved there about a year ago. She will be starting her RN program in june/July whicj invariably means, she won't have enough funds to help the petition |
