Nairaland is one of my favorite things! My tour in Nigeria is actually getting close to its end sad and I'm trying not to think about it because I'm really, really, really going to miss Nairaland and all things Naija.

Good day VO, My husband petitioned for a CR-1 for me but my marriage is now over 2 two years will I qualify for an IR-1 visa? Thanks.

Yes! But please remind the officer to update your case, as the computer does not do this automatically.

Hi VO,
U can't possibly leave us now that am about to start my own visa journey.Who will answer my questions calmly and patiently.Maybe I should start asking all my questions now. My passport is still in my maiden name.In filling out the form I-130,should I use my husbands name or my maiden since I've not legally adopted
my husband name and since my passport is still in my maiden name? Thanks in anticipation of ur reply.

You should use your legal name, whatever that is -- but your visa will match the name on your passport.

Hi VO,
Please I also want to know if I can send out my petition using photocopy of our marriage certificate?I don't want to risk the original copy. Thanks in anticipation of ur positive response.

I'm assuming you can send a photocopy -- because when the petitions arrive in Lagos, they contain photocopies, and the beneficiaries then show us the original documents (which we return to them at the time of the interview).

Dear V.O since the mother of my kids can't file an i-130 petition to enable us reunite. Can I apply for a fiancé visa? I have applied for a non immigrant visa severally and i have been consistently denied am even of the fear that I might have been banned for misrepresentation and may not have been duly informed. What can I do?

You're the person whose wife entered the U.S. on a Diversity Visa, claiming to be someone else's wife, right? I would not compound that fraud by committing more fraud. She should file an I-130 for you as her husband, if you are legally married, and then if it turns out you have an ineligibility, you'll be given instructions for applying for a waiver of the ineligibility.

Dear V.O, please I am really confused about this visa stuff. I have an aunt who is a citizen of the US. I told her about coming over to live with her and she agreed. I plan to work and after which I would further my studies and finally settle there. My questions are as follows:
1. What kind of visa do I apply for?
2. What are the documents I'll be needing from my aunt that will show she invited me and is capable of taking care of me over there?
3. What are my chances of getting a visa using a virgin passport?
Please, I'll be so grateful if my questions are answered.

Thanks.

It does not sound like you are eligible for an immigrant visa. Your aunt is not one of the relatives who can file an immigrant petition on your behalf. Furthermore, it sounds like you're planning to try to get a non-immigrant visa and misuse it in an attempt to remain permanently in the United States; if that's the case, you don't qualify for a non-immigrant visa, either, because you are an intending immigrant.

You might look into studying in the United States (and you can ask questions about student visas on the non-immigrant thread, https://www.nairaland.com/1792662/u.s-non-immigrant-visas-listening ). But you can't immigrate permanently to the United States just because your aunt lives there.

Unmarried child under 21 years.

That's the F2A visa category, and we are now interviewing F2As that were filed before August 1, 2013 -- so you have a few more years to wait.

Hello VO,Thank you for the great job here.I applied for a US diversity visa in 2010 in Finland and was rejected after a long wait.Obviously, the VO then sent my Nigerian certificate to Lagos for verification,Lagos never responded according to the information from the embassy here.Along the line,I sent an email requesting to change the address I gave in the US as where I will be staying. To cut the long story short ,I was denied without further interview on the ground of what was called discrepancies on your application. Now I am applying to Canada for my Masters and I was being asked if I have ever been denied A visa before in any embassy ...obviously yes (UK twice and US once) but it was just me not been able to satisfy the VO.I can not lie on the Canadian application form but just want to know if the previous denial could affect my study permit application in Canada.I am applying together with my wife and my little son.I am tensed and I hate to feel this way.Thank you.

This is a question for my non-immigrant visa colleagues at https://www.nairaland.com/1792662/u.s-non-immigrant-visas-listening .

hello!! VO, well... i have been quite a longtime out of nairaland but i am back now to express my worries. My brother back in the United state wants me to come and do post graduate studies in the US.MY worry is the permanent back on my status i narrated to you,i am still wondering though i was a minor i was still ban to enter the US.I acknowledge that it is true i submitted fraudulent documents but i didn't make them. Those responsible to take care of my file fabricated them and gave them to me to summit at the time of my interview and they even trained me on how to answer question at the time of my interview. my brother back in the US wants me to apply for a student visa but i keep telling him about my permanent ban but he says i cannot be ban to enter the US because the incident happened when i was a minor,so im just confused on what to do now,i don't want my brother to lose his money in the process to obtain a student visa,so VO i wish to know if really i still have a chance to obtain a visa? my permanent ban as a minor is it an error or what? please i need clarification on this point because i still wonder on this point.thanks for reading looking forward for your response, stay blessed

This is a question for my non-immigrant visa colleagues at https://www.nairaland.com/1792662/u.s-non-immigrant-visas-listening . But if you are permanently ineligible, the officer should have informed you at the time of your interview.

Greetings! Yes, I do remember you. All you need to bring is your photo ID -- we'll take care of the rest.

I see you both on the list for Wednesday.

Thanks for the good wishes! It didn't occur to me that I was a white woman for a long time either. smiley

Thanks for clarifying. She can file the I-130 for you, and the kids can be included as derivatives. Technically she entered the U.S. fraudulently, as she didn't list the children on her original entry and therefore was not entitled to the Diversity Visa... but that's not the category of fraudulent immigrant that immigration officials are interested in prosecuting these days. (We might suggest DNA to show that the kids are really hers, since from our perspective she didn't seem to have kids when she left.)

Thanks for asking. Your visa will not expire, but you need a new medical exam or you will have troubles entering the United States with your expired exam. We would prefer that you brought us the new medical exam and let us include it in your immigration packet -- but in this case you can also hand-carry it and explain to the Customs and Border Patrol agent that we made a mistake and failed to match your visa expiration date to the expiration date on your medical paperwork. In any case, if you attempt to enter with an expired exam, you may be delayed for several hours or more than a day and will certainly have to get a new exam, which is very expensive in the U.S.

Thanks for that response, my kids miss their mum and would like to be where she is and even if she files for us am of the fear that I might ruin their chances of the kids reuniting with their mum because of my previous and many refusals. So my question is, can she file for the kids alone and leave me out for now and since the DNA would prove if their hers or not? I am not bothered about going to the states for now but my kids are the ones that am bothered about.

Honestly, your previous and many refusals will not have a detrimental effect upon your children, and as long as the officer believes you have a bona fide relationship with your spouse, you'll end up with a visa too (even if you have to apply for a waiver of whatever ineligibility you may have). We don't condone visa-related misbehavior, but we won't keep a family apart permanently unless the misbehavior was much more serious than using a different identity or submitting false documents or whatever.

(Now, if someone was using a false identity in an attempt to conceal a dangerous criminal history... but it doesn't sound like that's the case here.)

Also I should mention that if she files for you with the children as derivatives, she only has to pay for one petition; which is less expensive than filing for each child separately.

But, ultimately, it's up to you and her!

So when is the appropriate time for her to file in the petition because she just moved there about a year ago. She will be starting her RN program in june/July whicj invariably means, she won't have enough funds to help the petition

As long as she's a Legal Permanent Resident, she can file. When she files is up to you and her -- I can't advise you on that.
