slimmy05: at least he should be 21, cause most of the laws here in US requires you to be 21 except for the working age. He will also likely get someone with lots of financial responsibility |

ttmacoy: I don't think it is necessary for the guy to return to Nigeria, no complications will arise and the wouldn't be the need for a lawyer sef. Talking from experience, I overstayed my B1/B2 visa. I was over a year out of status... got married to a USC and I got my temporary green card four month after filing my petition. The interview was a breeze. 3 Likes |

ttmacoy: Do you know the wait time and the trouble associated with filling the spousal visa while the other party is in a different country, forget legal or illegal its better if that individual stays back in US while the paper is filled it dosent take up to a year, spousal visa interview and procedure is really tight in Nigeria (i cant say for other countries) because everyone is peddling the same story line "i was visiting and i fell i love with him/her" "i meet her on twitter" different stories and you think the VO dont know whats up. am not saying they dont approve but sometimes the processing takes a lot of time, they even do home trip in some cases (going to visit the beneficiary of the visa) you can go to the immigrant section and see how long people have waited. |

Fell in love on twitter got me cracking lol. I get what you and slimmy are saying. As I said from my perspective if they already have a straightforward case I would rather go through the normal straightforward process, but as you said things are tight from Nigeria so maybe overstaying and applying makes more sense. It's the poster's call. lordoftherings: |

Thanks everyone. I saw this post which is similar to my case on this thread where a consular answered a poster.pls see below : Please I am presently in the US with a B1/B2 visa and I just proposed to my girlfriend who is US Citizen I would like to know if it's okay to get married here in the US or it's a must we wed in Nigeria. I have no intention of doing Adjustment Of Status while here for a vacation as I have a business back in Nigeria so a CR1/IR1 petition will give me more time to handle my business. Can I get married in the States and return back to Nigeria while she files for me? Second question, me and my fiancée not planning to have a child but instead have a plan to raise first daughter(3year old presently) of my blood brother whose parents are alive and of course agreed to allow us raise her. If my fiancee filing for me can she file for both of us or how to go about it. Here is the consulars response: You can get married in the U.S. and return to Nigeria. Then your wife will need to file the I-130 on your behalf. Your wife would need to file a separate petition for any child you had. It does not sound like your niece wil qualify, though. She is not your future wife's stepchild nor her adopted child; at this point, she is not your adopted child. You see, a child is considered "your child" only if the child is your biological child or if she is legally adopted *and* meets the criteria to be defined as an orphan under U.S. immigration law. It does not sound like your niece will qualify for this definition, as her parents are alive and well. |

Guys, quick question about WES for those that have used them. : I plan on using WES Basic(Course-by-Course (with GPA & course-levels) is it OK and accepted by US schools? And hope overall GPA conversion be done? Also the schools I am applying to that need WES evaluation, will WES send it to them or I have to pay for it to be sent? |

afroxyz: You do stand a strong chance of being made a lecturer on completion of your PhD. For many universities, a PhD is the minimum requirement to have to be considered for a lectureship position. So yes, you do stand the chance. 1 Like |

DeeTus: Sometimes, we cannot know everything and this equally applies to people in public service as well. It is in the lady's fiance's best interest to remain behind in the US while his spouse files for him. The whole process does not exceed 6 months tops. Returning to Nigeria will be a bad idea for him and I do not recommend that. Having both of them present in the US ensures that the process goes very quickly for them. Green card by marriage to a citizen is the only route that forgives one's 'trespasses' such as being an illegal immigrant to the country, overstaying on one's visa, unauthorized employment etc. It doesn't matter if the man over stays on his visa before he files or while the case is pending. Once the adjustment of status has been filed on behalf of someone, the status of the recipient changes to 'semi-resident' status just until the green card is finally approved. |

Mekurexx: The course by course evaluation is what you should go for and is the regular translation type required by American scores that need the WES translation. After the translation is complete, WES sends your US equivalent transcript to the schools and it does cost for each additional school you forward your transcript to. |
