May 1, 2010: Telecom operators in Nigeria were mandated to start collecting biometric and non-biometric personal information for each new subscriber in an effort to improve information gathering towards enhancing national security. This was initiated by the Office of the National Security Adviser (NSA) in collaboration with other security agencies and the Nigerian Communications Commission (NCC).

November 7, 2011: The SIM Registration Regulations came into force. Section 19 of the SIM Registration Regulations sets out a fine of N200,000 for every SIM card which is found to be fully active without proper registration details while Section 20 of the Regulations also stipulates a fine of N200,000 for failure to deactivate any SIM Card without proper registration details.

November 2013: Operators were directed to fully bar any newly registered SIM card, which failed to perform a voice or data communication within 48 hours after its registration.

September 2014: The NCC, to whom operators upload registrations every month, shared details back to the operators of registration records that the NCC judged as invalid on the NCC system. Operators were directed to clean up their registration records through deactivation or reconcile the records within a 30-day period.

July 8, 2015: The NCC directed operators to deactivate all pre-registered SIM cards (SIMs registered but without a record of activity) within a period of 21 days - from July 8, 2015 to July 29, 2015.

August 4, 2015: Operators, representatives of the NSA, Director State Security (DSS) and the NCC held a meeting to discuss issues around SIM registration in Nigeria. The issue of invalid registrations was highlighted as a major threat to national security and a directive was issued to all telecommunications operators to deactivate all SIM cards with improper/invalid registration details by August 11, 2015.

August 17, 2015: The NCC and security agencies conducted a compliance audit on all operators between August 17, 2015 and August 19, 2015 following the expiry of the deadline of August 11, 2015, for deactivation of improperly registered SIM cards. The NCC disclosed, at a press conference on the same day that despite sharing a list of invalid registration details with operators, MTN had made little or no effort towards compliance with the deactivation directive whilst other operators had largely complied.

September 4, 2015: A high level meeting chaired by the Chief of Staff to the President of Nigeria was called at the presidential villa. This meeting is unprecedented in the Nigerian business industry as the telecom CEOs were brought to meet the heads of the main security agencies and the Executive Vice-Chairman of the NCC, in order for the compliance with the deactivation directive to be emphasised.

Operators were advised that continued non-compliance would lead to the imposition of penalties of N200,000 per improperly registered SIM card, and that all businesses must respect the law or risk licences being revoked. The Chief of Staff to the President of Nigeria implored operators to take the matter seriously noting that (i) security and safety of the people is No. 1 on the president's agenda; (ii) 70% of kidnappings, violent crimes and insurgence are facilitated using unregistered SIM cards making it impossible to trace the perpetrators; (iii) government supports the private sector but companies must operate within the law; (iv) in other countries heavy fines are levied on the private sector for non-compliance (e.g. JP Morgan’s $20bn fine).

It was also agreed that (i) operators were to immediately reconcile the records of their deactivations against the list of invalid registrations earlier shared with operators by the NCC by September 7, 2015; and (ii) a penalty of N200,000 per unregistered/poorly registered SIM card would be imposed as stipulated in the SIM Registration Regulations 2011.

Despite the above detailed entreaties and warnings over a 12-month period (from September 2014), on the importance of ensuring that only SIM cards with valid SIM registration details are active on telecommunications networks, MTN failed to comply with the directive to deactivate improperly registered subscribers.

September 2015: Following repeated warnings and compliance enforcement visits as detailed above, MTN only made a partial attempt to bar unregistered subscribers in selected areas over a few days in September 2015. Other operators had fully complied and reconciled their deactivations with the invalid registrations shared by the NCC up to four weeks earlier.

October 22, 2015: Having reviewed the registration records of all the telecom operators and having taken into consideration their compliance records, the NCC imposed a fine on MTN alone for non-compliance with SIM registration. This unprecedented fine is indicative of the magnitude of the transgression and the seriousness with which the NCC and the authorities are approaching this issue. It is also more likely to ensure that the willful non-compliance by MTN ceases.

MTN’s non-compliance with the directive is unfortunately not an isolated incident. It needs to be seen in the context of a general pattern of non-compliance with regulatory directives that actually predates the current SIM registration infractions.

we both know it is for show. The final fine to be paid by MTN wont be more than 1billion naira or 5million dollar.

The fine will be reduce from 1005dollar per sim to 1dollar per sim finally. just my opinion and wishful thinking.

They better discard this useless fine. NCC are jokers doing more harm to the Nigerian business environment than they have realised.
Foreign investors will be deterred by the treatment given to one of our biggest investment partners. And this will affect investor confidence. NCC are extremely corrupt and should fix that first, they should fine for better service and coverage and not for this nonsense.

How come nobody is asking why MTN did not respect the laws on the registration of the SIMs as instructed? If they are fined for breaking the law then its okay. They should have known better. We have gotten so use to giving excuses when the law is to be enforced or wanting to get some bending of the enforcement.

If MTN has violated any law or regulation they should simply comply to its punishment like any other person or organization. We can't keep amending laws or regulation when ever it suits a cabal,a clique or a selfish organization.We are all equal and they (MTN) should have known better and acted in accordance to laid down regulation.If i was to try and make an unpaid call,i believe it won't take MTN or other providers long to place a negative bill on my SIM balance or prompt me i need credit.Its about priority!

The Government and regulatory bodies are trying to secure the telecom sector to prevent exploitation by criminals and the same operators are reluctant to follow through.The simple none compliance may have caused a life or caused some loses. Again how do you put a price on that? If the real objective of registration is to assist in curbing crime ,particularly terrorism and kidnapping. angry angry angry

The Nigerian government needs to stop disgracing the country. Yes, MTN disobeyed an order but N1trn is way too high.


MTN would pay that amount easily, but who is MTN Nigeria? It is WE the populace who patronize MTN services and job openings. Directly or Indirectly, Nigerians will pay N1trn. And that money would be "JUDICIOUSLY" spent by the Kings and Queens of Corruption in power.

When it was about generating revenues for empty hen through the said sims, empty hen carried on.

Now that is it about bearing the full brunt of regulatory sanctions for willfully violating the regulators directives, empty hen is now hinging its intentional flaggarant disobedeince on severe disruption for customers.
1. Where was customers concerns when empty hen when was busy making money from customers on dropped call?
2. Where was customer concern when they were busy milking customers with deductions for unsolicited and unsubscribed caller tunes?
3. Where was customers concern when they sold ordinary sim card to yours faithfully to the tune of N46,000?
4.Where was customers concern when empty hen and her sister, DSTV makes huge revenue from Nigerian customers yet disqualify the same Nigerian customers from awards and rewards systems to loyal customers just for their xenoloving south african people?
5. Where was customer concern when all appeal to empty hen to offer the same Nigerian customers quality and affordable service as applicable in Ghana, SA and other places empty hen operates?

In the words of Diego of Telemundo, empty hen should 'shut up" and pay the fine already!

Its actually the federal government that gets the money straight because of the the single treasury account.

Majority of the posters don't even know the reasons for the fine.

These lines were to disconnected due to dirty data and not because they were not registered. They were not registered properly. So what constitutes dirty data?:

-house address that cannot be verified (as if Nigeria has a well planned towns and cities where all houses and street are properly numbered and named)

- Poor facial feature capture. Or outright fake picture.

- Not capturing all the fingerprints properly

- some customers linked one registered line to several others etc.

These are the reasons why some were asked to come and re-register. The first phase when Mtn disconnected around 1.8 million lines, we all saw how all their service centers were crowded up. All mtn is asking for to be allowed to do this in phases. Imagine what would have happened if they disconnect 5 million lines in one swoop

Anyway, before now, underground politics has been under way to frustrate mtn so Nigerian politicians can take it over.

By the way, mtn is also a victim of a country without a working system. In developed clime, the moment u tender your id to buy a sim, the information is automatically uploaded into central data base which we lack.

Mtn is registering, inec is registering, nimc is registering, frsc is registering, immigration is registering..etc when are we going to harmonise this separate data's and save companies like mtn the wahala. A legit id card is what would have been required at the point of purchase.

Thanks NNC cos I also have some laughing out time at the silly outlet, for the money taken frm my mtn line and the useless multi-choice (DSTV) of a thing. Next is shoprite, bet I got spoilt berkuda fish frm auntie fries.

To be sincere, i have mixed feelings on this issue..
One part of me is willing to deal with South Africa because of thier hatred for Nigeria and Nigerians. Remember during GEJ era, deporting our people for no just cause, frustrating the arms deal, xenophobic attack, delibrate hike in rent once you not white in colour or a south african etc. But the the other part of me is saying NCC pls temper justice with mercy.
