The decision of the court is neither a victory for INEC or APC. The court just said the matters brought can only be dealt with by the Election Tribunal
It's a victory for APC and INEC. Faleke and Wada gad wanted court to halt tomorrow's election but they failed to get that. I am dead sure both will lose at tribunal too.

No Governor contests an election without a valid Deputy: it would be an injustice if APC deny Faleke his entitlement.

Faleke is the one denying himself.

APC is being cautious in giving the mandate to faleke due to the the Taraba judgment. However he was offered the DG slot under bello but his greed is blinding him.

It's only in Nigeria candidates defy their party's wishes.

The case of Boni Haruna and that of Amaechi or any other similar ones are clearly different from this Kogi's case. In Kogi, no winner has emerged and it's the reason Faleke is unfortunate here.

In my opinion, you are miles off-point and very wrong in your assertions.

This is not primary elections which is a party affair. It is a state election conducted by INEC. Bello did not partake in it. In my opinion, you are miles off-point and very wrong in your assertions.

This is not primary elections which is a party affair. It is a state election conducted by INEC. Bello did not partake in it. Faleke was never a candidate in this election even though he was a running mate. He could only have been a beneficiary if Audu had been declared winner in which case he steps in as a duly elected deputy governor.

I repeat, the Electoral Act clause which states that no one may be elected as a governor if he had not gone thru his party's primaries as a candidate is the reason APC couldn't field him as Audu's replacement. Doing that would have given Wada an edge in post election tribunal. Hope you're clear now.

For rushing to the courts against his own party in the middle of an election that had not been conclusively decided in favor of his party, how is Faleke's anti-party case any better thought out than the similarly-unfortunate adventure Yahaya Bello earlier engaged in? Didn't Faleke learn anything from the terrible mistake Yahaya Bello earlier made by going to court and campaigning against his own party before the same elections?

And to think that Faleke does not even have one quarter of the political influence/clout that Bello had? Faleke simply tried to ride on the sentiments and coattail of James Audu's demise, by unilaterally proclaiming himself Governor-elect and picking Audu's surviving son as his own deputy single handed.

These politicians will never learn. You heard it here first... Faleke's political adventure in Kogi is finished.

Now what is going to be the gain of Faleke who pulled out from the race because his party did not allow him to be the Governorship candidate..forgetting zoning formula of the party in the state..? Wada & his party are trying to use the judiciary to rob Apc of their hard earned victory...the man by so doing has proved himself unfit to govern the state for second term..he wanted to use legal abracadabra to validate his blatant rejection & failure at the poll. What a man !

Governorship Candidate is a joint ticket between Governor/Deputy. As long as Audu participated, it equally means that Faleke participated. That Augument that Faleke didn't participate is non and void. Bello didn't participate in the main election, he is just participating in the supplementary election which means how can INEC announce that that Bello having polled so so no of votes is declared elected when obviously about 240,000 is not his vote.
This judgment is not in favour of any of the concerned parties. In fact Faleke can claim that the court has okayed him as APC flagbearer for the supplementary election same as Bello.Wada can also see hope in it. Remember that the court says that INEC should go ahead with the supplementary election as if nothing happened and announce the winner and then wait for tribunal on post election grievances. In fact any one of them boycotting the supplementary election would be doing himself a lot of harm. This lockjam will only be resolved after the completion of the electoral process.

The case in Kogi State is between Faleke and Bello. Wada should wait till 2020. Faleke and Bello's case itself is not for INEC to determine, but the Supreme Court.

As far as INEC is concerned Faleke is still the APC running mate despite his purported withdrawal. INEC will only accept the purported withdrawal if APC informs them and presents a new running mate for the elections.
I don't even know to blame for whats happening in Kogi now and what will still happen after now

Wrong. The court only said they had no jurisdiction to instruct INEC on what to do. Only the tribunal, Appeal court and Supreme Court can, following the proceedings.

1. Even though your point 1 is plausible and fair it is inappropriate for the time because the doctrine of necessity should have been implemented instead of wasting tax-payer's money to conduct UNNECESSARY supplementary elections.

2. Absolutely flawed. GEJ didn't participate in primary elections in 2007 but was sworn in as the president. Audu being alive or dead right now is immaterial. What role would he have played leading to the supplementary elections? INEC should have gone on to conduct the supplementary elections as though Audu was still alive and then declared him the governor whilst Faleke is sworn in.

3. In Kogi a winner should have emerged. Audu met all the conditions as stipulated by the constitution and electoral act. INEC should have declared him the elected Governor whilst disagreeing factions should have gone to the Tribunal to challenge it (which they would have failed).

INEC caused this mess.

on no.2, what is d meaning of joint ticket. Again d electoral act/ constitution stated that a candidate election(primary) remain invalid without a running mate even if he won d election because of dis, d electoral act/constitution assume that d running mate is part of d whole process frm d beginning. It is a pity that am lazy at typing if not, I wud v explain things better to u. Though, dis is a new development in our democracy and it is so difficult for anybody to bak up his claims constitutionally but, if smbody asked me who is closer to d seat, I wil say it is Faleke. Again, when it comes to legal issue, Bello can easilly b removed because there ar lot of loopholes Lawyers can capitalise on. Dsame thing wit Faleke but his loopholes ar very few.

No it is not greed someone is claiming what is rightly his. From all the people jostling for that mandate Faleke is only person that his claim is close to what is constitutional. The only other way is annul the election and conduct fresh primary and general election. I will feel disenfranchised if I voted for Audu and sb is allocating my vote to Bello. With Audu not on the ticket my second choice may even be Wada not Bello, but I voting for Audu means I am equally voting for Faleke.

The court (or judge) says these are post election matters, meaning the election is concluded. only the tribunals can adjudicate on the matter.

I will challenge the highlighted again and again.

-Know that the whole election process is in phases.

-The phase of primaries ended with the nomination of Audu/Faleke as flag bearers.

-The election proper belongs to Audu and Faleke. With the demise of Audu, which is a force majeure, Faleke automatically becomes the main flag bearer. To complete the APC election team, Bello should be seconded to be Faleke's running mate.

-Faleke as main flagbearer and Bello as deputy/running mate is more appropriate and legal.

- I urge Faleke not to be part of the supplementary election if he is not made the main flagbearer. I hate used and dumped politics.
Exactly wat I told smbody on dis forum. I told him that as a winner of primary election, ur votes remain invalid without a running mate meaning that to complete d process of primary election, there must b a running mate and daz wat is referred to as 'joint ticket'

In ideal environments, people identify with, and vote, parties. Because parties usually have manifestos and ideologies. For instance in the US, whose system we largely aped, democrats always vote democrats, as republicans vote GOP (even though now Left and Right or lib-dems and conservatives are the preferred terms)

In the case of Faleke, the APC wants him only to deputize, not as as the flag bearer. Like i said earlier, the APC doesnt want PDP to pull a "taraba" on them.

In any case, i dont have a horse in this race, so i could care less who eventually carries the baton.
