twin,the first one comes out by 11:54pm of December
31st, the second @ 12:03am January 1st,

Now my questions are :
1, are they age mate?
2, which year will they claim?

In Islamic way, both of them were born on Jan 1st. Because any time from after the Mogrib prayer that's (the fourth prayer time of the five daily prayer) we are now in another day.

Technically, they were born in different year but in reality, the were both January born. They can only have separate birthdays if they have over 24hrs between them

They were given birth to on Jan 1

Life just aint fair, Life is a game but human might just be the referee sometimes to regulate the unfairness of Life, It should be adjusted to the same day but maintain the hours by which the senior would be older than the junior.

If I was the mother, I would choose Jan 1st as their birth date since that was the day the birthing process was completed.

To me from 11:54pm december 31st and 12:03am january 1st is not up to 24hrs, its just 9mins late or 9min difference, so they are twins. And you can't rate the first child one year older because it takes 365days to make up 1year or even 366days to make up one leap year, so you cant compare just 9mins to 365days or 366days.

God is great!... Since the placenta aint out as at when the second baby came out, of course they re of age mate despite the time differences. IMO!
