The ECOWAS COURT OF JUSTICE has given so many judgments in the past. These are its challenges:::
1. The court is an abnormal court. It is a trial court of first instance but also a final court because there is no appellate court or chamber. If it makes mistakes or the judges act arbitrarily, there is nothing a litigant can do.
2. It solely interpretes the law, including the law that grants it jurisdiction. In situations where a litigant disagrees with its interpretation of the law, there is nothing he or she can do.
3. ECOWAS court, like other regional courts, operates on the principle of litigants fully exhausting domestic or local remedies as a basis for assuming jurisdiction. But, this court acts as a busy body. It is too anxious to assume jurisdiction in the most trivial of cased. Member countries should device means to curtail this unmerited exuberance.
4. This court has no enforcement mechanisms or powers. To enforce its decisions, it relies on the goodwill of the governments and judiciaries of member states. As it is now, the court is on collision course with Nigeria.
5. Taking an overly activist stand could jeopardise the independence, integrity and longevity of the court. For it to succeed, it needs to navigate its path adroitly. For now, dark clouds are gathering and a storm is an expected corollary
