President Muhammadu Buhari earlier this year extended the tenure of the Permanent Secretary, Ministry of Petroleum Resources Jamila Shu’ara in clear disregard of civil service rules. Shu’ara turned 60 years on February 17 and duly served notice of her retirement to the Head of the Civil Service of the Federation, Winifred Ekanem Oyo-Ita. However, in an unprecedented move President Buhari unilaterally extended her tenure by one extra year by a letter sent through the head of service. This happened at the same time some of her colleagues who more years to spend in service were compulsorily retired. However, The Nigerian Times investigation has revealed that the covert reason for which she was illegally retained was to serve as the President’s eye and to check the activities of the Minister of State for Petroleum Resources, Ibe Kachikwu. President Buhari is also the Minister of Petroleum Resources. Recall that The Nigerian Times reported that Kachikwu’s appointment was a product of a pre- election deal between the President and General Theophilus Danjuma (rtd) who is also a major player in the petroleum sector. Despite Kachikwu’s appointment, the President has kept a stronghold on most of the major portfolios in the ministry being the substantive minister. Sources within the presidency disclosed that the President does not trust Kachikwu so much as to allow him operate without close monitoring. This has necessitated the retention of a more ‘trustworthy’ official. A source in the Villa told Nigerian Times that President Buhari trusts no one particularly if that individual is not from Daura. “The President had his reasons for keeping the Petroleum Ministry to himself. He was wants to ensure that at all times, he knows what going on there. To achieve that he knows he needs a trusted ally to act as his spy. That’s why he is hanging onto Shuara who having been Permanent Secretary in that ministry before her present stint, knows the terrain and is also dependable. President Buhari does not fully trust Kachikwu. He considers him too sleek and unpredictable particularly as he is from the Niger Delta. Kachikwu’s recent disagreement with Transport Minister, Rotimi Amaechi, over the Maritime University, would seem to buttress the President’s view of Kachikwu,” our source said. Her appointment as reported by the media generated a lot of disquiet within the civil service cadre as top civil servants and labour unions kicked against the “strange extension” which is in violation of the civil service rules. In the letter, HCSF/351/S.1/76, which extended Shuara’s serviceOyo-Ita said: “This is to inform you that His Excellency, Muhammadu Buhari, President, Federal Republic of Nigeria, in a letter with reference N0. SGF 12/ S.11/C.1/T/2, has extended your retirement period by one (1) year with effect from February 17. “Your emoluments and other conditions of service will remain sustained up to February 16, 2017.” The extension was a violation of the Public Service Rule Number 020810 which says: “(i) The compulsory retirement age for all grades in the service shall be 60 years or 35 years of pensionable service whichever is earlier. “(ii) No officer shall be allowed to remain in service after attaining the retirement age of 60 years or 35 years of pensionable service whichever is earlier. “(iii) The provision of (i) and (ii) of the rule is without prejudice to prevailing requirements for judicial officers and Academic Staff of Universities who retire at 70 and 65 years respectively. “(iv) Provided the officer would not have attained the retirement age of 60 years or spent 35 years of pensionable service whichever is earlier; (a) “a Director shall compulsorily retire upon serving eight years on the post and (b) a Permanent Secretary shall hold office for a term of four years and renewable for a further term of four years, subject to satisfactory performance and no more.” In her February 15 notice of retirement Shu’ara had written: “I write most respectfully to forward to you, my notice of retirement from the Federal Civil Service with effect from February 17 when I shall attain the mandatory age of 60 years, in line with Public Service Rule 100238. “I was employed into the public service May, 1982 as a Lecturer Grade III and rose through the ranks to the position of a Chief Lecturer, and also served as a Head of Department, a Dean of a School, a Deputy Provost and the Provost of a Federal College of Education. Thereafter, I transferred into the Federal Civil Service as an Assistant Director, Education in 1999, and moved up the ladder to a Deputy Director and later a Director in 2008. “I was appointed the Federal Permanent Secretary on the 20th of December 2012, and was deployed to several duty posts including; the Office of the Secretary to Government of the Federation – Special Duties Office; Ministry of Aviation; Ministry of Petroleum Resources, the Federal Ministry of Special Duties & Intergovernmental Affairs and finally back to the Ministry of Petroleum Resources. “I thank the Federal Government of Nigeria, especially His Excellency, President Muhammadu Buhari for giving me the opportunity of a rich employment and founding me worthy to serve in different capacities. I detest leaders who assign you a role but still go ahead to do it or hinder you because they don't TRUST your abilities. Buhari doesn't trust anyone except his own people & that's why is selection of his security officers is from the North. What rule did he break? There is executive fiat which the president is entitled to; which he can extend to an individual or in general by way of a letter or govt circular (in the case of the latter) which happened quite recently with the suspension of the mandatory retirement after 8yrs for directors and perm secs introduced by the Yar Adua regime. At state level e.g. Kano State, the govt exempted professionals in health, academics and education from the 8yr mandatory retirement for directors and perm secs - its as simple as that. |
