Please move this to the front page. 5years ago I rented my bran new house to a tenant who has been staying there till date. 7days ago I contacted him to remind him that his rent will be due by December and that I will appreciate his prompt renewal so that I can add money to rent another accommodation. My rent has expired this august and I have duly informed my land lady to give me till December to park out. She has been a pain on my neck.

My tenant responded by telling me that the borehole has been pumping out sand and he suspects it has failed.According to him, he invited two borehole technician who told him it has failed and there is the need to dig another. He told me they charged him 230k. Right now am confused cos his annual rent is 300k and that can only help me get a one room apartment in the area I currently live. I am now in a big mess cos if he had to deduct 230k from 300k, then I wont be able to rent a place..My intention is to ask him to pay me my rent and at the same time foot the borehole bill, but I will make necessary deductions in his next rent. My worry is that he has been complaining lately of being broke.What do I do if he refuses to accept my suggestion? Should I send him a notice to quit? I cannot afford to be homeless cos i want to make my tenant comfortable. Please advice me before I make a mistake.May I remind us that I am the only landlord that still charges 300k for my 3bedroom apartment within that locality. What of a situation he falls sick nd uses the rent for medicals, u won't pay ur landlord's rent..

If he is complaining of being broke while his rent expires in december nd u re planning on quitting him, then ur landlord needs to bundle you to dungeon locks the door nd throws the key into river Jordan since ur own rent expired in August..

honestly it has been tough getting a job for a long time now. I built that house so that i dont ve to be facing landlord palava. But robbers chased me out of there. I didnot regret moving out cos i suffered a great deal cos on two occasions they had to hit me with their gun on my head. To answer ur question that house has been my saving grace. In as much as i have something that can pay for my rent at the end of the year, it makes me feel less stress. You are not in my shoes.

So he should collect the lil change left after d drilling and sleep outside or send the tenant packing OFC there r alot of families without borehole and have being surviving..Just to get a tank and fill it with water tanker from time to time or if he has xtra he can fix d borehole and still pay d landlord a negotiable amount

U re only left with this option, negotiation.
Before negotiation, get some borehole professionals nd go down with them to check the root cause.
You must show concern to the plight of the tenant if u expect him to consider you.
If it's bad beyond repairs, plead with him to consider ur plight which am sure 90% of tenant would turn down cous nobody is born to suffer nd not when u re paying...

Next option, instead of moving out from ur current place, stay put since u ve some fund nd with the balance u pick from ur own tenant, pay ur landlord nd endure pending things change..

Lastly, it's not every tenant u threaten with quit notice especially if he has fund cous my type will want to go to court nd will do everything to frustrate you.

inasmuch as i dont want him to live without water, i will not want to be homeless too. .What i handed to him was a new building with bran new borehole. That the borehole failed is unfortunate. I thank you all for contributing .I think i ve options. one to ask him to fix the borehole and also pay me my rent. However i will issue him a receipt for the repair with an agreement to deducting it from when next he is gonna pay me. Another option is for him to live without water after all were i am now i do buy fetch water from next nebor. If disagrees with all this, then he wants me to be homeless. I will quit him and find a place to stay with a friend pending when he lives my house. Finally , when a new person comes in and pay fresh payment , I CAN then rent a place and also fix the borehole. Mind you 3bedroom in that area goes for 500-600k now. with agreement etc I will be getting 800k. Remove 230k from it , the balance will be more than enough for my accommodation.

That u enjoy living a slum does not confer that happiness to another man..
I came back home last saturday nd discovered the pumping machine was bad, saturday night, sunday night, it was not funny knocking on gates inorder to fetch water.

An area where people pay 500 - 600k for 3 bed, is no place for a married man carrying bucket all ova the street/close looking for water..

Did u say the tenant gets a tank nd buy water from time to time

In fact i was not the only one they robbed in that area.it was so bad that we have to send a petition to the police. Even the opc in charge of the area are being attacked by the robbers then. I had to run for my life. Immediately i rented it out, same robbers visited my tenant and robbed him. Ever since then i was told that some of them were caught and killed so the place is calm now. I will negotiate with him assuming am not looking for a new accommodation, i would have asked him to use the rent and dig another borehole. In the past he installed security wire on the fence and when his payment was due , i refunded him what he spent.

Give a notice informing him that the new rent (600k) will take effect after his leased time is over in December. He will have to renew his lease on the new terms if he decided to RENEW. He'll leave the house for you.

The failure could have emanated from his negligence and lack of proper maintenance of the borehole. That not withstanding, I wont be happy to be homeless while he fixes borehole with my rent. The best i can accept is for him to fix it while i issue him receipt with and agreement to make necessary refund in his next payment after this one.

OMG!!! Meaning the tenant would also renovate ur house nd the cracks on the wall is due to his negligence

Oga ur issue still boils down to negotiation..
