I'm facing a very knotty issue here that I would really appreciate your opinions. I just had my contract suspended because the clients' means of payment is unverified. Thing is, I noticed she wasn't verified before starting the contract and pointed it out to her but since the Milestone was already funded, She expressed some confusion at the system (it's her first time) but promised to keep an eye on it. Since it was a pretty easy task that I'd successfully negotiated upwards, I was really keen to see it done so I proceeded only to be told by upwork to stop work as the contract had been suspended 4 days after!

I've reached her (we communicate primarily through email) and she's even more bemused and has sent me the details of her payment even though She admitted not being able to verify her method because the deductions didn't reflect in her CC. According to her, She has called her cc company but they can't help either. A red flag went up when She asked for samples of what I'd done in the midst of the brouhaha, but I weaved my way out of it and she apologised for asking.

Thing is, I've done a background search on this girl and everything checks out. Her naivety seems to be quite honest. I've verified She's a university student that she claimed and by the way, she's an American hottie I swear, like someone out of a Hollywood movie, you know the type that....

Anyway, I'm not considering circumvention, the risk is too great. I'm just wondering if I can encourage her to opt out of the contract and hire outside - she's almost crying to me at this point. Would my encouraging her to opt out be breaking the rules? Secondly, who knows the associated fees to be paid for opting out? Any long-term consequences for me, since I intend to inform upwork if it comes to that. Any knowledgeable advise would be welcome.

Perhaps, but it's a terminal contract constrained by time. The longer it takes to get her verified, the more likely it is that she won't need my service any longer. We've already lost one well and counting.

This is very simple, she might be having issues with here CC. However, I'll advice this, " don't ask her to pay you off upwork" those white folks can escalate issues, she might even be the one to report you, for asking her to pay for the service off the site. Be patient with her, it might take some time to resolve. I have not done the 'opt out' option before though.


Let me share an experience:

To cut the long story, my account was put on hold (for what I know nothing about), Upwork in their usual way asked to verify my identity which I did, well at the long run the project fee was removed from "Pending Status", so I wasn't paid. Since it was taking too long over the course of a month plus to rectify/reconcile the funds from the client's Acc/bank. I just wrote an email that I needed my Upwork profile up and running as only the financial side was put on hold since I'd verified my identity. So I had to forgo the money and move on.(So I did free work) is part of business I understand.

The lesson to be drawn here is, bid and stick to working on hourly projects; you'll never go wrong with hourly projects. It's on fixed price projects that you get payment issues like this. So as a business man I devised a way to increase my hourly rate. Well for big projects, I ask for 50% upfront payment and 50% milestone to release after work submission.

Thanks a lot for the response. On the hourly thingy, I'm just not sure if it'll work for me. I still prefer good ol pen and paper and only transfer to soft copies when I'm done. Typing kind of impedes my creative ideas and at the research stage, I prefer waking up during odd hours to scour through my mobile. Staying up to sit and bill on a PC / Laptop just doesn't work for me at the moment, and then there's the power issue which one can't ignore.
I do think I'll explore the possibility of setting early milestones though, this whole waiting till the end to get paid is such a pain.

I believe upwork would not stop a project unless you or the person who gave you the project decides to pause it.
There is one asking for samples from me too but doesn't want to hire me yet, he confessed to having others he is considering. I believe he is asking us all for samples and then when he gets the sample, he would reject us all and compile his work based on our samples.
Told him that I will not start without a contract.
