I greet all landlords and tenants in the house. Pls I need your opinion on whose responsibility it is, to empty or sort out the issue of filled up soak away/septic tank.

It should be the responsibility of the landlord. Unfortunately, Nigerian landlords are very corrupt and greedy, they're only after collection of money and rent increment. They leave all house maintenance to the tenants!

Below are landlord responsibilities;

- Maintenance of the building like cracks on walls, roof leaks, general electric circuit problems, flood water removal, cutting of grasses (if any) etc.
- Security, like making sure the gate (including providing the gate's key) and fence are secure. If there's a security guard, it's landlord's duty to employ and pay guard's salary.
- Borehole. If the rent includes borehole, then the landlord is responsible for its repairs and maintenance.
- If the building collapses, the landlord is fully responsible for the loss of life and destruction of property.

When looking for a place to rent, make sure you know all your responsibilities. And if you want to put a borehole, inform the landlord and arrange to deduct your expenses monthly until you recover your money, because you're not going to take the borehole with you when you leave.

Those shouting it's the Landlord, I am sure you haven't bought Block and Cement before to be waiting for your Landlord to help you empty septic tank, when PHCN cut your light, also wait for him to come and reconnect it.

Tenants move in and move out . so if move into a house and 1 month after you moved in you are asked to pay for evacuation of the septic tank you have barely even used
it means you are to pay for another persons waste

The simple truth is that its the landlords duty

I was really shocked by the series of comments that came before yours, most Nigerians don't know their rights and that is why oppression and intimidation endures. How can evacuation of soak away pit in a rented apartment be a tenant's responsibility?

You need to grow up or the world will leave you behind. You own a house? Good for you. Other people own houses too and do rent them to people not from their tribes. No tribe is perfect. We all have our flaws. When you travel, will you carry the house to where you are going to? When your children move to new locations, are they going to go with that your precious house? They will definitely live in houses built by others. Your purile, archaic and tribalistic way of thinking won't take you anyway. Enough said.

it depends on the agreement signed before rent or lease, a tenant moved into our compound and not up to two weeks, the septic tank got filled. The landlord didn't ask him for any payment.
I personally feel this should be built into the rent as you don't pay to use the garage, why should you pay to use the septic tank.

Evacuation of filled septic tank is the sole responsibility of the landlords. A septic tank fills up in more than 6 years so if a tenant just moved in when the tank fills up, is he/she going to pay for the emptying? This is basically common reasoning but due to lack of understanding most Nigerians are gullible and Landlords prey on their ignorance.

My brother is not what u feel, but what is obtainable in law.
it is the redponsibility of landlord to evacuate septic tanks, repairs any damage of his building. repaint the outside while tenants repair some minor damages inside & also paint inside. if the roof is leaking, is landlord that repair it.

It is the Landlord responsibility to empty the Septic Tank, because there must have been tenants before the present one. And it takes years for Septic tank to fill up.
But in Nigeria Landlords take advantage of their tenants except the tenants know where they stand

It depends,If it is shared soak away by both landlord and tenants then it's fair that the cost of evacuation is also shared between landlord and tenants in a ratio of number of occupants.However if the soak away pit is exclusively used bY the tenants then in that case the tenants should bear the cost of evacuating the pit.

I don't think so...if I could rembr vividly...all outgoing such as utility bills ie electricity bills water bills et al including septic evacuation should be d responsibility of d Tenant. .. even exterior repairs as a result of usage or wear nd tear shld be done by d tenants so long d repair is not a major one. Divide the bill evenly according to the number of flat.

Every occupant must pay accordingly.

So long the tenants do not pay a service charge annually then it is their duty to collectively evacuate the septic tank once full.

However there might be exemptions in cases where the landlord also utilises the facility or the tenant is in his first year of tenancy.

Do you know how many tenants must have come and gone before the soak away get filled.... So I don't share your opinion. The landlord ought to have added the extra charges in a well structured cases.
