Isaac was arrested for stealing 32 liters of diesel worth the amount belong to Etoo at Maza-maza area along Badagry Expressway, Lagos, sold it and converted the money to his own use.

32 litres worth N6m. Must be golden diesel

Good observation. I suppose it's one truckload 32,000 kinda.

If he has any property, the court should sell them to repay his debt.

Just on point of law the reporting is false. In law the owner can take civil action against him and if he gets a judgment can enforce it with bailiffs if he identifies his property anywhere. This is such an elementary thing.
This case was a criminal case and the court did not have a mandate for property recovery. This case was about theft prosecution period. The judgment of this case is what would for the basis of any civil matter
It really is a shame the kind of intellect and knowledge level in our young people who go around claiming to be "graduates" [/quote

I thought as much though I am not a lawyer but I felt if truly that was the verdict passed by a sound lawyer then the judgement is really loop sided.

Actually, accordingly to the criminal procedures act 2015 , the guy will not get to leave the prison until he pays back the money he stole! Also the complainant can institute a civil case against the convict and not only get his money back but also claim damages and will be awarded cost against the convict. In total, the guy will not pay the money, he will pay the money plus cost before he leaves prison!

The issue is this a court is not a father Christmas. t onlyy deals with the matter in front of it and it would not make sense to consider civil recovery especially as the funds were not recovered fro him.

We see it happening with Ibori in the UK at this moment . He has been to Prson and now there is another case targetiingg the money.

if civil recovery procedures are successful and a judgment is granted this is what will happen next.

At anytime he could be walking down the streets bailliffs willl apprehend him take his watch and auction it .If it is worth 100000 and it fetches 10000 then 10000 is removed from his debt judgment and the process is repeated for as long as it takes it could be land, a car , house his electronics, jewelry the shirt he is earing anything.
So illiterate fools should stop celebrating him as some kind of hero.

the emboldened is NONSENSE but in a civil action he could even claim for more than what was stolen as damages and also claim interest

What are you on about? If he doesn't have the money or any hope of getting it, what else would be the result? Of course he is going to jail.
Re: Man Prefers Prison Than To Refund N6m He Stole by excanny: 11:39am On May 06, 2017
I am in a similar situation. Someone damaged my property worth 200, 000 naira. I gave the option of refunding me or we proceed to court on Tuesday. But this person refused payment and prefers Kirikiri.

I have researched similar cases and found out its usually 18 months in Kirikiri if the litigation ends.

But deep down, I feel cheated, knowing I will never get my money back.

I think our justice system is seriously flawed.

Sometimes I just feel the prison system will be more worse than it is because of wicked folks who prefer jail than return what they stole or damaged.

And the prisoner in question can't pay the same warders? At Ikoyi prison, if you pay just 50k a month, you would have access to dstv, cold drinks and stay with the white prisoners in the vip session.

So nothing go do the new convict if he knows his way.

mansakhalifa:
For all those applauding the convict, look at it this way: The guy just made it easier for the man whose money he stole to get him. All he has done is make himself an easy target for the owner of the 6 million. A couple of envelopes to the right warders and...you know the rest. Beep, does anybody think these days? Heck no.

Let's do the math.

6,000,000 / 18months = 333,330 per month. He is already a convict anyway, so nothing to lose.
Who else thinks this guy is smart?
is fela not a convict? is obj not a convict? is mandela not a convict ? abeg forget dat thing. the dude is smart.

Smart. For 18months he won't incure any expenses, the government will house & feed him, and when he's released, his money will still be waiting for him
Yeah, the money will be waiting for him ,so also will a richer partner be waiting to sniff his life off with a 200k assassin. That money may be spent afterall for his burial....... Think!

Sometimes, I support the use of assasins in cases like this. People like these are too wicked to be left running around. Murder is bad but I approve of it in these kind of cases.

He can only keep the money if the person he stole it from is ignorant of his rights. All he need to do is file a case to get back his money using the conviction as a basis. The case is even a simple one. Just present the conviction to a court and ask t court to give you an order to recover your money. I the guy no get money, his properties will be sold. The victim can also trace his bank accounts and claim the money there

Imagine what this money means to a graduate who has no job for the past three years. How many workers earn this every month in Nigeria.
