I also expect you to anylise the effect of being an ex convict. Am sure as a convict, especially if he is educated, which am sure he is not, will not contest etc. abi?

The stolen fund can still be recovered from him after his 18 months jail term. The owner of the diesel can bring a civil action against him for unjust enrichment or on any other ground, depending on the nature of the transaction that brought them together. The State can also appeal against the sentencing to have it varied. The complainant was not properly advised, what he should have done is to maintain a civil action against him whilst the state prosecuted him. The Rule in Smith v Selwyn; to wit, criminal and civil action can't be maintained concurrently, doesn't apply in Lagos.
