Nigerian law is a thrash. Someone stole a fowl and was sentenced to six years imprisonment. Another person stole 6 million naira and was sentenced one and a half years imprisonment. Our constitution needs a serious review. |

It's a shame how everyone here is saying the man is smart, blah blah, and not one iota of pity or Commiserations with the victim. This is what Nigerians have become, people who celebrate criminality on a gargantuan scale and then call it being smart. 1 Like |
Smart. For 18months he won't incure any expenses, the government will house & feed him, and when he's released, his money will still be waiting for him[/ The stolen fund can still be recovered from him after his 18 months jail term. The owner of the diesel can bring a civil action against him for unjust enrichment or on any other ground, depending on the nature of the transaction that brought them together. The State can also appeal against the sentencing to have it varied. The complainant was not properly advised, what he should have done is to maintain a civil action against him whilst the state prosecuted him. The Rule in Smith v Selwyn; to wit, criminal and civil action can't be maintained concurrently, doesn't apply in Lagos. |

The guy he stole from won't loose anything at the end of the day as he could now go for civil case suing for the refund which the court will likely agree with . The suspect is a looser both ways as he is both a confirmed thief and having the badge of a convict around his neck for life except he is an iboman the same is enough for some people to even consider suicide !

loomer: If you steal $45m, the owner will follow you inside that jail so he can kill you with his own hands, and when he goes out will murder or poison your whole lineage (mother, father, brothers, sister and any kids you or they may have) Any fool thinking that he can steal someone's money, and go free, after spending a few yrs in jail, is dreaming! Here is a question for you all: if you had work damn hard all your life to get WHATEVER amount of wealth, and tomorrow someone robs it all (and go to jail without returning your money), wouldn't you kill that bastard?! 1 Like |

Ignorance is not an excuse it is good to know the law,he was charged by the police and taken to a magistrate court on a criminal charge, when he finishes serving his time Mr Etoo should take him to a High Court for monetary restitution which will not be too difficult to prove on the balance of possibilities since he already has a magistrate court verdict which has a high level of proof since it is criminal. Just a little food for thought Mr Etoo when to the wrong court,he should have gotten a lawyer and gone to a High Court from the very start, magistrate courts are limited to 1 million naira damages but the cops filed the case under the police act and most likely must have collected their share from the 6 million Naira. |
