Nigerian law is a thrash. Someone stole a fowl and was sentenced to six years imprisonment. Another person stole 6 million naira and was sentenced one and a half years imprisonment. Our constitution needs a serious review. embarassed

It's a shame how everyone here is saying the man is smart, blah blah, and not one iota of pity or Commiserations with the victim. This is what Nigerians have become, people who celebrate criminality on a gargantuan scale and then call it being smart.

The stolen fund can still be recovered from him after his 18 months jail term. The owner of the diesel can bring a civil action against him for unjust enrichment or on any other ground, depending on the nature of the transaction that brought them together. The State can also appeal against the sentencing to have it varied. The complainant was not properly advised, what he should have done is to maintain a civil action against him whilst the state prosecuted him. The Rule in Smith v Selwyn; to wit, criminal and civil action can't be maintained concurrently, doesn't apply in Lagos.

The guy he stole from won't loose anything at the end of the day as he could now go for civil case suing for the refund which the court will likely agree with .
The suspect is a looser both ways as he is both a confirmed thief and having the badge of a convict around his neck for life except he is an iboman the same is enough for some people to even consider suicide !

Wow, that would be some pretty messed up game, to finish serving jail term and then still lose the money. Its like living in Nigeria and still ending up in hell after death.
