Peace Corps says it wants to be paid N2billion as damages for the harassment arising from the arrest and detention of its members and closure of its offices across Nigeria. – PCN joined the AGF, IGP and DSS director-general in the suit in which it alleged that its rights were trampled upon. – The organisation also wants the departments and organisations the three defendants represent to be restrained perpetually from carrying out such action against the Peace Corps ever again. -The Peace Corp wants the alleged harassment of its members to be stopped. The Peace Corps of Nigeria (PCN) has sued the office of the Attorney–General of the Federation (AGF), the Inspector–General of Police (IGP) and the Director-General of the Department of State Service (DSS), Daily Trust reports. The suit is demanding a N2billion compensation over the unlawful arrest and detention of its National Commandant Dickson Akoh and 49 others last week.According to PM News, PCN, through its counsel, Chief Kanu Agabi (SAN) wants damages paid to it for the embarrassment caused the organisation and its Incorporated Trustees by the arrest and detention of its personnel in what it termed “an unlawful raid of the organization’s new Headquarters last week by a combined team of Police and the DSS”.In the suit which was filed at the Federal High Court, Abuja, PCN also wants declared illegal, unlawful and unconstitutional the arrest of Akoh and other officers of the Corps plus the sealing up of its head office in Abuja and offices in the 36 States of the Federation. According to PCN, the court should also declare that under the 1999 constitution as amended, it has not done anything wrong to warrant arrest, detention and sealing up of its offices across the country. Peace Corps also wants presiding judge Justice Gabriel Kolawole to declare that the organisation and its members are entitled to Fundamental Rights to acquire and own properties, lawful assembly, freedom of movement, personal liberty and dignity of their human persons as guaranteed under sections 34, 35, 40, 41, and 43 of the 1999 constitution. PCN also applied for an order the police and other defendants unseal its headquarters and its offices nationwide and release properties seized during the invasion of its property. They also want the defendant to be restrained perpetually from further harassing, intimidating, arresting and or detaining the applicants in the course of doing their legitimate and lawful duties. Recall that the power tussle between the Nigeria Police Force and the newly inaugurated Peace Corps took a new dimension following the raiding and arrestingof the national commandant of the corps Ambassador Dickson Akoh. Akoh was arrested close to midnight on Tuesday, February 28 after the police raided the national headquarters of the corps in Abuja. http://abujareporters.com.ng/peace-corps-sue-fg-dss-igp-demands-2bil-compensation/ |

y PEACE CORPS OF NIGERIA A Federal High Court in Abuja on Thursday 27th April, 2017 directed the Attorney General of the Federation (AGF), Mr Abubakar Malami, to call the Nigeria Police to order by warning the security arm on the consequences of treating courts with levity. Kolawole’s reaction followed the failure of the police to appear in a case of enforcement of fundamental human rights instituted against it and four others by the Incorporated Trustees of the Peace Corps of Nigeria. At the resumed hearing of the suit, the Inspector General of Police and the Nigerian Police Force, who are the major defendants in the court action, were not in court and gave no cogent reason. The AGF, the National Security Adviser, Department of State Services and its Director-General, who are the other defendants in the suit, were represented by Mr Terhemba Agbe. Kanu Agabi, (SAN), Counsel to the Peace Corps and its National Commandant, had urged the court for an order restraining the police from further taking steps against the plaintiffs in the pending court action. Agabi had specifically pleaded with the judge to order the police to vacate the corporate headquarters of the Peace Corps in Abuja, which had been sealed off since Feb. 28. He also asked for an order of court to facilitate the release of the vehicles and other properties of the corps carted away by the police when the office was invaded. Justice Kolawale expressed displeasure over the absence of the police in court without justifiable reason. The judge said that the police who were the antagonist in the matter ought to have realised that a case for the enforcement of fundamental human rights ought to be treated with deserved urgency. “It is an affront to the court for a party in a pending court action to take any further step in such a manner that may affect the foundation of the case. “To take a further step in a pending court matter outside the court is nothing but self help and the consequence of such action is contempt of proceedings,’’ Kolawole said. The judge said that his ruling should be served on the police through the office of the AGF to enable the police realise the consequences of treating the court with levity. He therefore, ordered the AGF and three other defendants to file processes within five days in response to the originating summons of the Peace Corps. The court adjourned hearing in the matter until May 15. |
