Hello gurus in the house, I want you guys to enlighten me about Canada study permit. I'm a graduate of b.sc zoology. I want to progress in life in the healthcare division(Nursing). Have always had the passion when I was much younger. According to my research online, I saw a programme called practical nursing and occupational therapists i.e it's a pathway two year programme according to the school website. Guys, touchdown Toronto ! Very clean and beautiful country from the little have seen. For the guys who haven't paid fees or have funding and going via Egypt Air, pls hold like 1k dollars, although non of their business the guys at MMIA might ask for it. POE, was super chilled,just be bold, confident and honest. Might also be good to keep track of ur luggage in transit points to avoid stories upon arrival at final destination. Apparently baba @thesoj is on a mission to relocate his entire family to Canada, met another of his brothers on the plane. TRV fall on all hopefuls and refused applications. 23 Likes |

likeababygirl: I think some of the assertions here are wrong as well, just like the person who said first class intimidates VOs into thinking someone would not come back to Nigeria because they are most likely to be employed by a Canadian employer. To the contrary they look at first class students as having not only intelligence, but the compassion and thoughtfulness of wanting to make a difference by returning home. And on the matter of home ties not been that important, I have to respectfully disagree. It is probably the most singular important criteria for obtaining a visa, second only to one's ability to foot his educational bills. You ignore home ties only at your own perils. If it appears someone who is single and has no landed property or company ties got a visa, he may simply be one on scholarship who is so bright you gotta wear shades. In that case, his perceived intelligence is an asset that in itself can convince the VOs that such a person is more likely to return and help develop his country. First class is perceived as such and not the other way around. Even the first class students are required to show one tie or the other and we have seen first class students here denied many a time for failing to show ties. Personally I have yet to see anyone with no ties granted a visa. Tie does not have to be concrete in the form of land, employment, family. Sometimes its can be amorphous like your perceived intelligence and desire to want to make a difference in your homeland, supported by evidence of such participations in your past history. In fact sometimes what you don't know is a tie, a VO would perceive as a tire. And what you think is a tie, a VO would perceive as not a tie. Its the nature of discretion. That is why Canadian courts don't review the denial of visa by a VO because there is nothing to go by. Discretion simply means a decision made out of the abundant goodness in the heart of a VO. They have blanket authority to rule however they deem fit, even out of mere emotions. That is why prayers is important that your application bypasses the evil that lurks around the corner by a VO who woke up on the wrong side of the bed. 4 Likes |

jnyuwa02:I quite agree with you largely on your points, this issue of hometie is HIGHLY discretionary. I always encourage people to work around what the have at the time of application. There is no rule of thumb to home-ties. Officers deduce these things from an overview of the applicant's case, situation and circumstance. Get documents and evidence to show you are established at home. Establishing that one has close home ties for the duration of any category of temporary resident visa which includes the study permit can be from a variety of thing.(social, family, assets, employment, etc). It is just standard for the VO to make sure it is evidenced in one way or the other before a study permit is approved because it is part of the provisions of their requirements for a temporary resident visa. More and more perfectly good visa applications run into difficulties due to a failure to outline strong enough home ties. Therefore, each individual should make every effort to submit as much information as possible to establish that you do indeed have these ties. Add documents in simplicity that will firstly portray you as a genuine study(Purpose of visit) which to me is the MOST important thing, established your financial capability and show you are established at home in any of the form highlighted above. |

Well, on the contrary, the federal court in Canada have on cases successfully ruled that a refused application be re-opened and a different visa officer reviews the application. This most times happen when there was an error in fact(s) and judgement, the visa officer overlooked certain documents presented at the time of application or a wrong application of the provisions of the IRCC act in reaching the final decision. Visa officers DO NOT completely review application on discretions. They are guided by the law and the provisions of the act. Since they are humans, they may make errors which may result in a refusal. The judicial process in federal court in Canada often times address these errors but only on merit of the application. So in most cases, it is very difficult to overturn a visa officer's decision in Federal Court with the judicial review process, mainly because this process is a 'judicial review' process, and not an 'appeal'. Even if the judge disagrees with the decision of the visa officer, that is not enough to overturn the decision. There needs to be more than disagreeing with the outcome based on the merits. Based on what I have read about the federal court cases, there have to be more than disagreeing with the outcome based on the merits and some cases are reopened and reviewed by a different officer but the risk is that the new officer can refuse same application for an entirely different reason. Conclusively, officers don't apply total discretion in their review. The requirements of a temporary resident visa provides that certain things be established and home ties is one of such. Discretion may apply in what holds strong in the applicant's profile in this regard. 2 Likes |

Darrelah: I think now is the right time to start escalating this kind of rejection to all interested parties in Canada and all over the world. I guess they have taken WE Nigerians for granted. I can bet that the VO already made his/her decision within the first month of application but why waiting for 19wks/5 months to be rejected??.. This is sad and emotional. What if this girl has resigned from her work place with the hope of travelling to Canada next week for schooling??. Come to think of it, they can kill someone's destiny by creating false hope for 19wks. @deralleh, sorry about the delay. Austinpee4: I actually agree with you. In the United States, the judgement of a visa officer is unfettered and unreviewable by a federal court. This is based on the premise that an alien who is not within the justiciable territory of the country, has no constitutional right to demand. That is my area of specialty and I assumed wrongly that it applies for Canada due to similarities of law. Based on my knowledge though, even though federal courts may review discretionary decisions, it doesn't mean that the authority is not totally discretionary. It only means that even though the VO is free to make his decision however they deem fit, some of the decisions made may not escape judicial review when there is a fundamental miscarriage of justice. That appears to be why in certain extremely rare cases, Canadian courts would sometimes intrude and overturn the decision of a visa officer. 1 Like |

OmalichaUC:Any officer can review a reapplication including the visa officer who initially denied previous application. Actually, in a reapplication, it is usually must likely the reviewing officer would first see the conclusion of the previous application through the GCMS/CAIP database to ascertain if the reapplication have addressed the concerns as well as meeting the requirement of a study permit. So even if a different officer reviews a reapplication, he/she will still see the conclusion of the previous officer which will in turn inform areas to look out while carefully reviewing the reapplication. |

OmalichaUC: Sure, depends on the reason of the denial and what the federal court found out. The VO may be asked simply to simply reconsider. Most of the times such a reconsideration would yield an approval, but the visa officer may decide also to deny it a second time and there would be no harm. In cases where an applicant is able to prove bias from a VO and a court actually agrees, it definitely goes to a different VO. All of these scenarios are all very narrow subsets, most people don't appeal for a visa denial due to lack of funds to pay a lawyer to undertake a project where your chances are so slim to prevail with the the courts. |
