Individually we called the accountant who from the discussion we had made it point clear that there was no provision for us in the payment voucher and every attempt the reach the management has proved abortive as they have kept posting and at a point not taking our calls.

I decided to bring this here in other to get the best solution to this problem and also to know the various agencies to get involved.Apart from the call which i made to the accountant and the center manager, i have not taken another step as i don't want to make a mistake in dealing with them. I have seen problems of this type get solved here and i believe that mine and that of my colleagues will be solved. Thanks as I wait for HELP.

1. Read the company policy regarding disengagement and terminal benefits
2. You stated that in the letter they stated that you will be paid then you should find out what payment you are entitled to, ie. leave days, notice period, Gratuity etc
3. Wrote a letter to the company and ensure you have proof of delivery.
3. If you do not get a response then you should approach the National Industrial Court in Ikoyi for redress. They are very pro-employees and judgments from the Court can not be appealed.

OP. after speaking with the company accountant, also speak with the legal department of the company.
base on the position of the legal department you can take your decision.
if their decision did not favour you or contrary to what was stated on your employment, letter, then get a lawyer and head to the National Industrial Court.
the court will always rule in your favour and the company will pay even more.

There is a difference between termination and dismissal.

OP a lawyer is needed to help interpreted if this is termination. I believe in a termination you are entitled to your benefits

Hang on bro. I know u feel down at the moment but a sack can do either of two things, make u or break u. Ive been sacked before and i know exactly how it feels but i ended up getting something better.

Regarding your pay and benefits, i think its still too early to accuse the company of reneging. Severance packages usually take some time before they get paid. U may wanna hang on a lil bit more and keep following up with ur finance team atleast for a month or two.

Also, there is a difference between resignation and sack. In the case of an outright sack or dismissal, you usually loose all benefits. However in the case of the 5k monthly deduction, i would expect that to be paid regardless of the mode of the dismissal since thats your money.

Dont dwell upon it too much and move on as fast as u can

It is tricky on the ground of under productivity and insurbodination if there is any proof.

I will advise you guys to be patient till you hear from an authorized source of the company before you take any step.

The 5000 caution might be there in case you leave and might not include the provision if you are outrightly disengaged by the company.

Try get a lawyer to explain the content of your terms of engagement, policy you signed and disengagement letter.

Accept my sincere empathy on the disengagement. It is not good for this period.

The company understands that he cannot afford a lawyer. This is the same shit Trump pulled on contractors that did business with him.

So please stop giving him wrong advice.

Go to their Surulere office (HQ)

They will help you free of charge.

does the company have a staff manual?


what does it say about the following issues;

1. dismissal;

2. termination of appointment &

3. disciplinary issues?


the common practice is that when you are 'dismissed' from service, especially for an offence, you are not entitled to any benefit or compensation...


if your appointment was 'terminated', you can be eligible to receive compensation...


also, for the offence you were alleged to have committed, what does the staff manual say is the maximum punishment?

if its dismissal, you have no case... if its termination of appointment, a lawyer might be able to aid you...

My brother, if u really mean that you were dismissed from the company, then forget about being paid. To be dismissed is no joke!! You are not entitled to anything. In fact, the period you spent there is wasted as you have to remove it from your CV if not it may destroy ur career in future if a potential employer makes any background checks on u. Best of luck.

Op... If it clearly stated in your dismissal letter/employment letter that you would be paid.. Then you have a serious case against them.. Read your appointment letter and dismissal letter.. Everything you need is there..

Lets stop protecting people or institutions oppressing the hapless, rather lets put them all on full blast and see how quick these oppressors repent. Cant you see the effect that public shaming is doing to SARS?? I bet you they will be more cautious on how they interact with the public in the future.

So please encourage the brother to discretely public shame them.

Hmm you have all made a very good point. But I think the young man should exercise a little Patient, the management might be working thing out. It is not even up to one month. Otherwise he might not win the case. You can see the allegation they already have against him.

Thank you all for the advise and contributions. Having read through everything said here, i'd like to point out few things to clarify the situation.

Go to the office of public defender in Alausa Ikeja. Na only one letter they need to drop at your former office for them to contact you. Pele.

Hold number three with you. It shows that there was a prior inferred engagement and a subsequent disengagement of your service. That's more than enough. The general labour contract will then play as you two didn't exactly draw up any at the onset. They are toast...just report them.

Shoro intended... it's so funny how people never listen,shebi when they sue him,you will follow him to pay them compensation.the amount of money he will pay them will be more than the legal fees you are worried about
