Or at a "stop" sign for cars, you expect me to run across the road? Even at a stop sign and you are not sure whether to cross, even then car owner will signal to you to cross. In chicago, even if you are not at a stop sign, once cars see you are strugling to cross the road, the sloooow down to avoid hitting you. Not all cases but I have seen this countless time I don't know how it is done in new york but in Connecticut, ohio and chicago which I'm very familiar to, this is how it is done. moststylish: Well nothing is guaranteed and life is all about risk but think it all over again. Like I said, the process doesn't guaranteed it will be successful at the end of the whole thing. Someone reading will now believe anywhere in the US... you can cross the road anywhere anytime.... cars will stop for you. In your above response...you're saying something different... crossing at the cross walk..... crossing when the lights signal you to cross.... crossing the road when corteous motorists allow/signal you to cross. In some States.... some local communities.... motorists are super courteous. .. but this is not so throughout the US...especially in NYC where motorists are almost always in a rush. I have personally witnessed more than once...."courteous motorists" slow down and signal pedestrians to cross infront of them only for the pedestrian to be hit by the car coming along in the next lane. Almost always.... you try crossing any other place besides the crosswalk.... the motorist will not be charged...nor successfully sued. 1 Like 1 Share |

Even on very busy highways they expect motorist to slow down if they unexpectedly come across a pedestrian trying to cross the highway. The motorist will have to show signs and attempts to have slowed down and avoid hitting the person by brake marks on the road. Hint: A tricky question is asked in most states drivers license computer testing asking motorist who has the right of way if they found a pedestrian crossing any other road aside from the designated crosswalk...you should guess what the correct answer should be. 2 Likes |

Beautyaddy:Really?... on highways... pedestrians and cyclists are not allowed to be there so are not expected to be there. Pedestrians trying to cross such are often run over by multiple vehicles. Even when a car breaks down on the highway.... you are advised to try and get it on the shoulder of the highway....and to remain in the car. Why?....motorists on highways are not expected to make sudden stops.... their lives will be in danger since the car is most likely to be rear ended by the following vehicle. It happens here all the time.... people get hit and the driver not charged. 1 Like |

Originalsly: Okay, so how do you know they are not charged? I will make a slight exception to the highway pedestrians but that is still debatable. Every other road that driver will be charged. There will be a police report and the motorist will be charged. The motorist will have to take it to court to have those charges either dropped or avoid it being shown on the drivers driving record. |

Beautyaddy:They first investigate..... most times..the driver was not in a position to avoid the hit.... no charge. But at times...they will be charged for other stuff but not with causing death.... driving with broken tail lights...operating a vehicle with tinted windows... not sure...but think leaving the scene of an accident.....driving with a suspended license or being unlicensed period or Driving Under the Influence and over the speed limit can result in some serious charges.... including vehicular manslaughter. @how do I know they're not charged?...the news...will say all that. |

Originalsly:That conclusion will not be determined by just the police report at the accident scene. A police report is not to determine who's guilty or innocent. The police reports what's at the scene and might even call for witnesses reports and not just what the driver says. Either way, it will be on the drivers driving records either found guilty or innocent. |

Some whites guys are just in the habit if being dickheads especially when they drive their big pickup trucks. One dude was on the speed lane heading down slowly and i pulled up behind him waiting for his stupid ass to change lane so i could pass him. Dude refused to move and went parallel to other dude on the slow lane effectively blocking both lanes. This could fetch hima ticket like 250 dollars if catch by the cops but he was lucky that stretch of road is usually devoid of cops. Luckily dude on slow lane moved faster and i quickly switched to slow lane and pass the goat by the right. I looked at him and saw he had stuck his middle finger at me. To beat the fool just de hungry me but i gat to calm as i no want spend new year for jail. Jail no be big deal for them but it is a bit deal for we immigrants as it will spoil your record. 17 Likes 1 Share |

There are many news stories of pedestrians dying and drivers not being charged. It's all about what the law states. Eg, if you are a jay walking pedestrian, the driver will likely not be penalized, at least in most states. Generally, whomever is breaking the law is the one that faces prosecution. Driving with due care and in obedience to traffic rules is very unlikely to get you into trouble if a pedestrian dies because they broke the law. 1 Like |

^^ In some states that follow the contributory negligence standard, if a driver hits a pedestrian who was jaywalking, the driver can't be liable to pay for all the costs associated with treating the pedestrian's injuries. The driver (or the insurance company) could, at most, be liable to pay 50-60% of the associated costs of the pedestrian''s injury, while the injured pedestrian will cover the rest. Moreover, the driver could be sued for intentional infliction of emotional distress by the pedestrian, although most courts will be hesitant to award costs to the defendant because IIED is very speculative in nature. 1 Like 1 Share |

Some days back, I got a feel of why I need to get winter tires. See, like I said some time ago, my car gets me from point A to B and is warms up really fast when you drive. So, most times, I don’t have to start it up some minutes before I leave the house, I just jump in and start driving. At the back of my mind, I knew I needed some new tires though, the thread of the ones currently on my car were currently thin and had failed the coin test. The more threads you’ve got on your tires, the more gripping power you have and the shorter the braking distance. (read: http://www.tireamerica.com/research/the-penny-tire-test) Sunday, last week, I had to drop my sister at church, and head to work;. Over the previous days, it hadn’t been snowing that much so I figured I would be fine driving my car even with my “bad” tires. I woke up that morning and looked outside, it had snowed the night before. When it snows, the roads become caked up with snow and become very slippery. You have to drive way below the speed limit so as not to lose control of your car. You accelerate really slow, you decelerate even slower, cos the tendency for you to lose control of your vehicle increases when you’re driving on ice, your car is in motion and you slam on your brakes suddenly. On a normal day, when it snows at night, the snow-ploughing emergency services department kicks in. Before 6:00am, special trucks carrying ice-melting salt would already be on the roads followed closely by trucks with big “shovels” in front to plough the snow from the road so as to make them motorable. For some reason that day, they hadn't ploughed the roads. Ice and snow were on the roads, perfect recipe for disaster. I got into my car along with my sister and started driving, on getting to a red light at the end of the road, I misjudged my braking distance and slammed my brakes on too suddenly.
