I need not finish reading your submission before I can tell you it'll be on purpose of study delay.... you want to study because you just started a trade That's not the way pls... and who is this top lawyer who supported such a reason for study? I feel you may have done better without this your lawyer!! 1. If it is Canada, Your study route... choice of program MUST be in tandem with either your employment or course of study. 2. Your level of proposed program should be somewhat progressive... although I have seen people with bachelors getting study Permit for colleges... but pls be on a safe line. 3. Cherryola: This email composition is really disturbing! Sorry to say, but I can't help but wonder how you'll actually write your final thesis for whatever program you're going for. Also, I can't fathom how you'll cope with rigorous assignments that are meant to demonstrate your critical writing skills. Honestly, if I could get a 'headache' reading this, I only wonder how the recipient felt. I think you should work on your writing skills and I believe you pretty much speak the same way you write, so, work on that as well. Trust me, it'll go a long way here in Canada, especially when you speak in class discussion sessions or conferences or on a day-to-day basis. Issues such as this, for example, are part of the reasons a VO would question an application (e.g. how's it that you got an admission if you can't write properly in English, which is your 'national language'?) OR most likely shove it aside because it is too complicated to understand what you're trying to convey in your SOP (if you had one - I didn't bother checking your previous posts). Sorry, but I just have to say facts here! Even ESL students here in Canada write and speak way better! Dude or dudette, whichever you are, you've got to work on yourself. I'm not bashing you in any way, I'm just letting you know facts. Trust me when I say this, you'll command attention speaking eloquently here. I know how far my speaking and writing skills have taken me since I got here, and how many opportunities I've had, just by that...not to mention my performance as well. So, you just imagine. Food for thought...same goes to anyone else struggling with English, perfect yourself as much as possible! If ESL students can do it, how much more a Nigerian with English as first language! Dwebb55: Sorry for your delays. Why are you spending money unnecessarily? You don't need an immigration lawyer to help you file an application. You have a big study gap I am imagining? Meaning a long time since you last attended school. It is an incessant problem. People who have left school, 5-10 years of study gap, face serious problems with CIC and are often marked down for purpose of visit. So in your next application you might want to work or demonsrating to the VO the seriousness of your intent to be bona-fide student. If you are denied again, I will definitely recommend judicial review if you have the cash for it. Costs bout $3k and it's a two part process of challenging CIC's decision before the federal court in Canada. I will definitely recommend it. Part of why CIC continues to act in ridiculous ways to Nigerians, not processing our application in a timely fashion and denying us eventually in arbitrary and capricious ways, is because they know we do not usually take them to court. Nigerians say they don't have money and yet go on a repeated circle of reapplying to CIC when refused and trusting in for a miracle. While I will tell you of a lever that needs to be pulled also--the lever of judicial review-your miracle might also lie there. Trust me, if they know a lot of people take them to court, they will read applications carefully before they utter one jargon. From some of the decisions I have seen out here, I am of the personal beleif that CIC sometimes doesnt even read people's SOP. Something someone spent a lot of time and effort venting their hearts out only to be ignored. God help these people. Long story short, if anyone is refused, take CIC to court. Yes visa is a privilege and not a right. But there are times when it becomes an abuse of people's privilege and it's appropriate to take them to court. I have seen one person who after repeated denial took them to court and succeded and her visa was issued after 10 minutes interview in Lagos. Just imagine if a lot of Nigerians did this. It would be a movement and the visa officers would think twice and do a thorough and well thought out and reasonable review of files and never take us for-granted again! 8 Likes |

Don't judge someone simply because of their online ramblings which might not be indicative of the way they would use English in a more formal and business setting. And why would eligibility review reverse back to the background check? Dem miss road at first? Cause when both of they complained initially I was thinking it was an internet glitch (honestly these VOs are making this visa thing completely unpredictable) |

jnyuwa02: Thank you Jnyuwa for the comments. I am seriously thinking of the judicial review. You are right about the study gap. I want to also correct the person above who said the application wasn't well packaged. It was even though I say so myself. Each of the four reasons for denials were totally tackled and explained thoroughly. Funding was more than enough. I paid my fees and my spouse and I showed deposits that more than covered accommodation and feeding for the duration of the course. We have extensive travel history together and separately and I lived in the UK for a considerable period of time. We have our own property fully paid for and my home ties are my spouse and children who are not going with me. We also have considerable pension amounts which we will not abandon to go and slave away in another country. The reason I started a trade was because I saw a gap in the industry I'm in that isn't being addressed and the training is comprehensive and will benefit me immensely and this waa well explained in the SOP as well. If you feel the review will be better then I'll consider it. 3 Likes |

Dwebb55: Review in your case will definitely be better. But in a court of law, there is this principle called exhaustion principle. A court would not review or you may not stand a strong chance before the court until you have fully exhausted your remedies before an administrative body. In compliance to this principle, I would suggest you file one more application with CIC exhausting your administrative remedies. That purpose of visit and any other reasons of refusal needs to be argued well before CIC to stand a good chance with the high court when you file judicial review. If CIC still refuse you, then at that point you are totally justified and have a good reason to hire an immigration lawyer to begin judicial review. 1 Like |

What is so hard to beleive? Even the most well packaged application can get denied by CIC. It is not a game of who packaged his application the best, but favor and luck play a huge part also in the process. Get off your horse shoe bro! What is wrong in after a year or two of starting a business, going for advance training that will prepare you best to carry your business further in serving your country after living abroad so long? Dwebb55: My major concern with JR is the 4 pointer. If it was a single reason or 2, it may be easier. They may have thrown many points so that one may hook you even if you scale the rest in the JR process. Sometimes, the multiple reasons may be joined at the root which makes it easier to knock off with a single successful strike. Perhaps, you should reapply through an immigration lawyer because the lawyer would have prepared the grounds/foundation to challenge any negative decision in your application ab initio. No new details or documents can be introduced at that stage because they will be looking at the facts available to the VO at the time the decision was taken. |

Folaroyal:I humbly disagree with points 1 and 2 especially as you used the word ''Must". Career change is not a crime. People may develop love for a new career as they progress in life. Some of us were almost trapped in the career bubble because we had little input into what we wanted to do early in life. It can be frustrating if you are continuously coerced to maintain the same path which provides no sense of fulfillment for you. I graduated almost 20 years ago, Masters 15 years ago... But going for BSc in completely different field. I resisted the temptation to stay on the same part for visa approval having made that mistake only to end up unsatisfied in Australia and abandoning my studies there 4 years ago after a Semester pursuing another somewhat related Masters Programme. I made up my mind and said it's what I want or the highway because I was searching for fulfilment which had always eluded me in spite of my academic pursuits. Middle age crises can get more pronounced as a result of inadequate guidance counselling services when we were making career decisions. For instance, a major factor at play after our JSS exams was the notion that Science were for brilliant students whereas art classes were for dull students who couldn't excel in the sciences. This kind of impression we had must have destroyed so many dreams as people will grow up realising they may be square pegs trying to fit into round holes all their lives and then it gets further compounded when VO's supported by yours truly give the impression you MUST continue in that line. I salute the individual for trying to make a career change and encourage him to stay the course. If our Politicians can scream PeeeDeeePeeeee in the morning and APeeCeee by evening why can't we pursue a more moral course of action? 12 Likes |

I received this letter from my prospective school yesterday in response to my letter that I have missed my resumption again because CIC has not processed me. I also wrote a member of parliament and received a response from his secretary that she will forward my letter to him. Dear Jeremy, Thanks for the update. This is a ridiculous situation indeed. I’m not sure whether it might be possible for you to start the MPP program in January (the fall semester started a month ago so the earliest you could start is in January) so I CC Amy, who might know. Oga, Just go ahead and submit the same very thing that you submitted, no alteration. The problem here is that you used a consultant, I am not sure the complexity of what he did for you, but most times, Just like you said the application was well packaged, it may simply be the VO, Maybe he/she was having a bad day. I know someone who submitted an application, "Self-done", well packaged , submitted and got a rejection after 3 months long wait, He resubmitted after 3 weeks, same very very application another person rejected, it took 2 weeks. #fact NB- MAke sure you are being sincere, CIC is going a little further with review of applications this days, Massive Denials everyday. My brother,as for me and I doubt anybody can change my perspective towards this. There is no blueprint as to follow in applying for a student visa, no pattern or no "WELL PACKAGED APPLICATION". We have seen applications that you would expect to be thrown out,but got approval, and we have seen applications that looks like a VO's "MANUSCRIPT" and yet was denied. vibrant99: Reapply for what? I have not been denied. My application has been pending one year now is what makes it ridiculous from the school's point of view. Might be bacause I have a lot of travel history, lived 18 years outside of Nigeria. This fall 2018 was my last possibility of deferring my admission. It was also my last chance to show up or have my highly coveted scholarship cancelled and given to someone else. I was a no show cos CIC refused to process my application despite numerous emails. It was all generic replies that your application under "active processing." It appears from the school's letter that they may be willing to have me resume in January 2019. If so, praise the Lord! What a year it would be to enter 2019 starting school in Canada. God has been so good to me in my lifetime, this would be another big testimony when it happens. 4 Likes |

Complexity is the first reason for rejection. I have said this before..... Co-sponsor, .. My mother's brother sponsor... My sister's husband sponsor... Sponsor of sponsors.... This guys know this things, If you don't have one solid sponsor, make sure you have a strong ties to your home country. They know you have to work off your ass to pay fees over there, unless those directly sponsored by parents or Spouses, others na route. Louisanc: |

sorry about this...i think you should review ur application again, not necessarily because there was a mistake or like it wasnt well package but because its the first stage in re-doing any failed process. Then i dnt believe these Visa officers work on their own discretion there must be certain criteria for them to make a decision on applications though some might take theirs unnecessarily too serious,i feel like they do with the PR applications, they try to control the number of people they issue visa to, so alot of scrutiny will be done...and i noticed most of us here have entirely different application status(age,travel history,marital status..etc)...so we cant score or rate someone's application with another...so reapply with a renewed positive mindset, not the mindset of just one last application before u take them to court, thats like expecting another setback.. work with ur religious faith...i came to NL saw alot of new things i didn't put in my application... my sop was barely a page...graduated since 2011, didnt know of anything like family ties... my application was "not well packaged"..but got my visa.. wish u the best !
