sThe High Court of the Federal Capital Territory in Apo , Abuja, ruled on Tuesday, that the Federal Government ’s alleged looters ’ list released earlier in the year does not constitute a violation of the rights to presumption of innocence of those named . Delivering judgment in a suit filed by the proprietor of the African Independent Television and Ray Power Radio , Chief Raymond Dokpesi , seeking the court ’s declaration of the looters ’ list as void , Justice Olukayode Adeniyi , held that the suit lacked merit. The court ruled that the disclosure of the alleged looters ’ list by the Minister of Information and Culture, Alhaji Lai Mohammed on behalf of the Federal Government earlier in March does not carry any force of law as the minister is neither the judge or the prosecutor in the criminal case pending before the Federal High Court against Dokpesi . The judge held that if aggrieved by the possible injury done to the plaintiff , he should rather seek a remedy through a libel / slander suit. Meanwhile , the court on Tuesday adjourned the libel suit initiated by Dokpesi against the minister till November 9 . The court earlier dismissed the minister’ s objection to the libel suit due to non - appearance of the lawyers defending him in court on Tuesday and fixed November 9 for hearing of the substantive suit. https://punchng.com/breaking-looters-list-not-a-violation-of-named-persons-right-court/amp/ 6 Likes

Wish my name was on the list, would have sued the government billions in damages. Even the popular Evans is still presumed innocent till today, yet the dullard published a looters list and some myopic people were celebrating him. Buhari must have threatened this judge. 3 Likes |

Then when APC was in the opposition; When the Economic and Financial Crimes Commission (EFCC) published a list of 135 individuals suspected of looting public treasury in 2007, Lai Mohammed and Garba Shehu roundly condemned the action, with Mr Mohammed describing it as “illegal and a reckless abuse of power” because it was aimed at muzzling opposition. Talking about looting and curruption, did anyone here watch Chennels this morning as Senior SA to the Presidency Garba Shehu was shamelessly holding brief for the suspended NHIS DG. According to him, the DG has worked hard to reform the commission bringing monthly expenditures from 5.b to 3.5b in the last three years. He also alleged that proper investigation is yet to be carried out to ascertain the truth and or his level of culpability on the accusations lead against him. Asked whether the investigation that the VP along with the Minister of health launched during Buharis health tourism in the UK that lead to his initial suspension is not a "prpoper" one, he started fumbling. According to him, the Minister of health has been summoned by the presidency to comprehensively look over the alligations as he speaks. I couldn't believe what I was hearing. OP that's not what the court said. The judges' decision is only related to the case before him that's why he said Dokpesi should separately sue for libel which is a civil wrong. The argument of Dokpesi is that having listed him as a looter, it erodes the presumption of innocence on him. 1 Like |
