@Vibrant99 As at mid last year, you haven't seen anywhere outside the shores of Nigeria "Mr. Bigboy", why then are you now forming "Mr. been there, done that" all around NL? In most of your previous posts, you are always either "behind, beside or around" someone during visa interviews, a hallmark of failed visa applications or make believe lies or an agent, simple. Good day all. Please I need help with this. I have a valid visitors visa. It will expire on 14th of May 2019. I have an important event to attend in the US on May 10th and will spend at least 3 weeks. Should I renew my visa or travel with my current visa? @ladyguniverse |

groovychik: The OP can actually use that visa to arrive at a US POE up until 13th of May I think or even 14th without issues especially if he has previously used it for the purpose for which it was first issued. It's however up to the CBP officials to determine whether to let him in or not, and for how long too. He could get the standard 180 days still despite his visa just having a few hours to expire as at time of being stamped in, it's normal. Overstay officially is when you do a minute more than the number of days the CBP officer stamped you in for if you didn't apply for extension (you fall out of status immediately and the visa in your passport even if it has more time to expire actually becomes cancelled) and you earn yourself a 3 years ban, if you do more than 365 days you get a 10-year ban. Do note that you can be stamped in for as short a time as the officer determines to be appropriate too. 2 Likes |

seyewest:Forgive my impertinence, but I believe they will treat an F2 application like she wants to move there and stay for the remaining duration of her husbands study as this is the actual purpose of an F2. I am no expert but I'd guess that if she states that she only intends to visit for a short while and return, they may ask why not apply for a B2? I suspect this may be why her original F2 application was denied as the stated intent does not match the visa category. |

seyewest: Truth is that either visa category may work. She just needs to get her story straight in line with the intent. If she says she wants to do a short visit and come back, then B2 is preferrable. If she wants to state that she is going to stay for sometime say like 6 months+ with her husband, then F2 works too. In that case, she should get a leave of absence from work and go stay with him. But at 9 months to the end of his program is kind of pushing it (Her F2 will expire when his F1 expires). I wonder why she did not do this from the get go and stay with him for a while then could have been coming and going on an F2? With an F2, she could have started part time courses and even converted to F1 through 593. It was even possible before to get a work permit on F2 (not sure about this anymore). They could also have had their childern in the U.S. with no future problems on an F2. Okay... I am saying too much , I am spoiling market for imigration attorneys... the game is to be sold, not to be told 2 Likes |

Greetings to the House: Is(Are) there any person(s) that can provide my family with insights on how to proceed with my children's application. They were granted visas in 2016 and i(their mom) was present at the interview where we expressed our intention to head to New Jersey to visit a family friend. This was in July. Co-incidentally, i was very busy with work and could not travel that year. The following year, i was granted an F1 visa and had to head out to graduate school. Their father was to take them that year and he was denied a visa...sadly and i was still in the US studying and so, their visas expired. Currently, i am flexible enough to be able to fly in to pick them up for their vacation and so we applied for the drop box and in two weeks we received an email to pick up the passports and saw that we have been asked to show up for an interview. Honestly, i did not know when the drop box system became a gamble but we are determined to show up and the concern is that i do not know what documents to show up with other than my visa and study documentation. At this point my husband will be appearing with them but with my documents. Will this impair their chances because he has been denied? Do we go with a bank statement? what are the documents required under the 221g section? Can they be penalized for not honoring their initial visas? They are both minors and travel is solely determined by me and their dad and our circumstances were not very convenient and favorable at the time. Please can i get some view, opinions or advise? |

Mancala:While I understand where you are coming from, F1 and F2 visa does not expire once the F1 holder is still in status. The student can undertake OPT of three years after his graduation (for STEM courses) and he will still be in status. Someone got F2 visa recently on the student visa thread despite the fact that her husband had graduated but will be doing an OPT. She presented the letter from the company to that effect. Is that not already strongly suggesting immigrants intent? But Alas, the visa was still approved. Like you said, it is about getting her story straight and finding the best way to present her case. |

Time2Smile: Yes you are correct that the F2 expires only when her husbands F1 is expired, technically when he completes his OPT if he can get a job to that effect. As to the bolded statement, no, that does not in itself disqualify an applicant by intent to immigrate although that is a sure pathway to it. The system is extremely partial to uniting families. It is almost like she has a right to live with her husband and the system is very kind in this regard especially when the spouse can demonstrate financial capability. It is considered a hardship to keep keep husband and wife separated. If I was her, I will get my ducks in a row and go for the F2 and stay for an extended period of time. 1 Like |

Good morning everyone. My baby sister is having her graduation by May at Maryland and I am willing to visit her (as her only family left) to celebrate with her. I am 26, a federal staff and not married. My salary is above 200k. I am willing to spend just a week so I can come back to work (got a leave for that). Please I'm looking at the probability of getting the visa. I've only been to Ghana before as I've never had any reasons to leave Nigeria. |

Please i have a question, A friend is married to a US citizen. Her husband filed for her to come over. Due to marriage she will be a citizen. The plan is to file for her parents to join her. After which she or her parents will file for her siblings to come to the US. Some of which are married and well into their 30s. Question is: how can her parents get citizenship by virtue of thier daughter being one? Is it even possible? Also can she or her parents file for the rest of the siblings? |

toniauj: If you check the US website instructions on dropbox they have ALWAYS said you MAY be called for an interview so it is not unusual. The best you can assume is that they want to know if your kids are actually in Nigeria. Your kids would only be able to travel with either you or their dad since their dad doesn't have a visa in my opinion Im not sure how this new application will work unless you are around for their interview. So documents would have to show who's taking them to the US and how to prove they are coming back. My two cents |
