The Presidency yesterday reiterated that President Muhammadu Buhari will not order the judiciary to release the leader of the Islamic Movement of Nigeria (IMN), Sheikh Ibrahim El-Zakzaky, because he lacks the powers to do so. This is just as it declined comment on whether the government was considering proscription of the sect as done to the Indigenous Peoples of Biafra (IPOB) in 2017.

Members of the IMN (Shiites) have been staging protests across the country following the continued detention of El-Zakzaky who was arrested with his wife in December 2015 after a violent clash with the Nigerian Army in Zaria, Kaduna State.

Contacted on the latest decision on the group, presidential spokesman, Garba Shehu, said the federal government’s position on the matter hasn’t changed. “There is no latest that I know of. Government’s position hasn’t changed. El-Zakzaky is in the custody of the Kaduna State government. They are trying him in court for several alleged offenses. The Federal Ministry of Justice is not in this, President Buhari has no hand it. “The constitution of Nigeria does not give the president power to stop investigations and trials, he can pardon upon conviction. On the El-Zakzaky issue, this whole thing is in the domain of Kaduna State. If only they know,” he said. Previously, the presidency had said the group was wrong to be in court and resort to violence at the same time in order to get justice for an accused.

Additionally section 140 of the constitution states that when the individual interest clashes with public interest that of the public interest supersedes the other interest. Elsakksaky is a threat to Kaduna state security by attacking the soldiers in convoy of The chief of army staff . This position of the constitution is sustained at the supreme court in the case of Asari Dokubo and Federal government. The supreme court held that public interest supersedes individual interest .The only thing that can make him out is and understanding between the sect and the state government. will the sect not betray the pact?I think the answer is YES.it will

My question is who is the president and who is the presidency? Was it the presidency that got the man arrested or the president? Why is it taking so long to try the man in court, sentence him to death or release him unconditionally. Why is he being detained for this long?pls can someone answer?

He is being prosecuted by the Kaduna State Government for murder. He is not being prosecuted by the Federal Government.

His lawyer, Femi Falana has applied for bail twice, but the court rejected the applications because he is being tried for murder.

He has just filed a fresh application for bail 4 days ago, for medical reasons.

Therefore, the appeals should be to Governor El-Rufai and the Kaduna State Government, not to Buhari and the Federal Government.

A Kaduna State High Court on Wednesday denied the Leader of the Islamic Movement of Nigeria otherwise known as ‘Shiites’, Sheikh Ibrahim El-Zakzaky, bail.

The court refused the Shiites’ leader bail on the grounds that he did not attach a medical report to his bail application.

The court was presided over by Mr. Justice Gideon Kurada.

The IMN leader and his wife would remain in the custody of the Department of State Security until January 22, 2019.

Security was tight within and outside the court located along the Ibrahim Taiwo road in the metropolis.

It is often funny when i rethink and listen to Mr Buhari talking through his mouth piece ,Garba Shehu. It equally beat my imagination how our country came to be here in the first place. And the controversies that surrounds his elected as the president of our great nation, Nigeria.

Was thought in school that they are 3 independent arms of government and each of them has their functions separately but can only checks and balance their functionality but not to be controlled by the other. If the judiciary arm of the government that is the last hope of the common man will compromise to the executive order, that means justice is twisted.

Nigeria judiciary should be scrap off because , they are just punch of figure heads waiting to be ordered. Checking the antecedence ever since these dispensation came on board, it is something i can't say.

Am sensing foretold crises coming due to the continous detaintion of Zakzaky and Dansuki but God will help us survive it.

A wound you sustain through a mistake you will have avoided is always scary and low to heal.

Islamic Movement in Nigeria, IMN, also known as Shiites, has claimed that its leader, Sheikh Ibrahim El-Zakzaky was on the verge of going blind and may also lose his life if not allowed to go for medical treatment.

IMN raised the alarm after the Kaduna State High Court on Thursday, ordered the Islamic cleric to remain in detention.

In a statement signed and made available to DAILY POST on Thursday, by the Chairman, Free Zakzaky Campaign Committee, Abdurrahman Abubakar Yola, Shiites berated the court for allegedly “failing to stand for truth and justice against tyranny and impunity.”

The statement added, “Today, Thursday 18/07/19 the Kaduna state High Court sat to hear an extraordinary application for bail on medical grounds, instituted by counsels to our leader, Sheikh Ibraheem Zakzaky and his wife Malama Zeenat Ibraheem.

“Unfortunately, the court once again shirked in its duties to be on the side of victims of extreme persecution by the government. When it mattered most, the court ducked and failed to stand for truth and justice against tyranny and impunity.


The statement added, “Today, Thursday 18/07/19 the Kaduna state High Court sat to hear an extraordinary application for bail on medical grounds, instituted by counsels to our leader, Sheikh Ibraheem Zakzaky and his wife Malama Zeenat Ibraheem.

“Unfortunately, the court once again shirked in its duties to be on the side of victims of extreme persecution by the government. When it mattered most, the court ducked and failed to stand for truth and justice against tyranny and impunity.

“It will be recalled that the applicants are known to be clearly very ill in detention, consequent on the brutal wounds unjustifiably inflicted on them by the state agents in the name of Nigerian army, the resultant prolonged dehumanizing detention in the custody of the Department of State Security (DSS) and the obvious poisoning of the Sheikh.

“As a result of all these physical and psychological stresses, the Sheikh suffered series of mild strokes and is at the risk of further recurrences. Meanwhile, he lost one eye following the military attack and is at a severe risk of losing sight completely in the other.

“He is now found to have more than twenty times the toxic levels of lead poison in his body! Similarly, the wife has been under excruciating pains with shrapnel deeply lodged in her body for all these years of inhuman conditions in detention.

She now is able to ambulate only with the use of a wheelchair. Even today both were unable to walk to the courtroom and had to wait outside while the case went on.

In spite of all these, the court once again has allowed the government to kill these innocent people by instalments via unnecessary delays.

“We continue to give praises to the Almighty for further evidence that the Nigerian government is both unable and unwilling to serve justice, not even through the courts.

“This further proves to the world that the Movement and its leader have been and continue to be only victims of impunity and mischievous plots by the Buhari-led government.

“We wish to use this opportunity to say a big thank you to all people of conscience, human rights activists and organizations, journalists and all those that continue to be on our side in the dogged campaign for justice for the victims of Zaria genocide.

“We will continue with our unrelenting campaigns to see that the needful is done.”
