15. You have a student visa that was cancelled last year?

17. How long did you stay last time?
I will approve your visa and you will get your passport and package at your address in two weeks.
On a lighter note that guy denied me student visa last year,I was like not this guy again..lol..

Oooops. That's where the rejection came from I guess.

The next step now is to find a way to clear the marital issue. You can't get a legal divorce certificate since you weren't legally or traditionally married, and you dare not forge one either.

Let the experienced folks here advise and guide you through. After then, you can now go through the CR1 route

Please talk to your fiance quick, you guys need a competent ]immigration lawyer. And secondly, post your experience on visajourney and let them advice you too sister. Dont rush to file CR1, clear this mess your ex made and then you guys can file. I wish you all the best and Gods speed.

This is serious! Can't just imagine someone filling married for someone that's not in something like this. This is so painful dear. There's always a way, don't give up. Jehovah doesn't sleep!

@glorioussugar, I can’t even start to explain how bad I feel about your denial,you’re one of the people I’ve talked to most on here to I’m sorry about your case.

1 you should have told us about your ex and all that Jazz,you were informed enough to understand that previous applications affect this process so you should have told us way before you even filled your form.

2. They just wanted to waste your time with those questions,they already denied you cos of the discrepancies with your forms and all of that.

3. K1 visas are not appealeable so you should start making the next move
A. Go back to your ex and y’all should go to a court and get a divorce letter,that y’all didn’t marry under the law does not mean you can’t get a divorce certificate.you can get it.
B. It’s going to take a very long time so I’ll advice you to be prepared for what’s coming your way.your fiancé is gonna need to come home and marry you and apply for a spousal visa again and it’s a long process but you’ll pull through.make sure that all the loopholes are fixed this time around before he even comes home.

True but it also sometimes depends on the usc job too. CNAs and RNs rarely have that time .

That's your view. They can have the "Nigerian wedding" in the States. I've attended several "Nigerian weddings" here in the United States and the full tradition was observed during the wedding. So you are not making any sense there.
It's also the US embassy view. They know well how many Nigerians lie to their American wives or husbands being traditionally married in Nigeria and hiding it. I was talking about the safest way to show the couple is legitimate. As we all see, sometimes the K1 visa is denied and the relationships needs to be reaffirmed. To marry in Nigeria it's the way to show how serious you are and that you are not hiding anything, all your family and neighbors, friends know you are serious. My point of view can help many.

Wrong. If you wish to come to America, our government have business about all things related to you, everything about the new immigrant is recorded and stays in file forever. New thing is delaying and denying any visa if US government believes you could become a public charge. It includes a person who doesn't want to get a job and may become a welfare applicant in the future.

All correct. And also even if they marry and follow all steps you described so well, they could get denied the spouse visa or delayed for 3-5 years saying this time, if they love each other, they can live in Nigeria or in any other country. Glorioussugar, be prepared for a long waiting time. Good US based Immigration lawyer could help.

Sorry about the Denial dear. Your fiancé needs to talk to an immigration lawyer as I believe they must have felt with a similar case as yours. I can’t possibly begin to imagine how you’re feeling now but God will strengthen you and your fiancé and provide a way out of this situation.
You mentioned that 5people were denied before you, are those people also for the K1 category??

How will We go to court and get a divorce certificate when we were not married. We are getting married this month in Nigeria. I mentioned we should get an immigration lawyer and then file for spousal visa but he said the lawyer might not really be able to do anything since it’s already in the system. And there was no marriage . He’s also thinking of relocating to Nigeria. I really don’t know what he’ll be doing if he relocats to Nigeria. My ex is married now. And lives in Canada with his family. I don’t know if immigration Lawyer can help at this point

Be prepared to live in Nigeria or any other country maybe for many years or maybe for life. Your previous application not matching with the last one is considered a lie, lying to US Government it's a crime and probably only a good lawyer could prepare a file to ask for forgiveness and make it work. It's all your own fault and your own crime because you signed the application where it says you were married to your ex.

Dear glorioussugar,don’t let anybody scare you on here,peoole get denied and they still always end up getting approved,like I said,go to a court and get a divorce certificate.Explain your situation to them,my wife’s mom brought her to the us years ago and it took her close to 5 years cos they kept denying her cos of the marital status of her mom,she wasn’t legally married to her dad then but they still had to get a divorce certificate.it wasn’t until they involved a Congress man that the embassy approved the visa and not to even talk of the tens of thousands of dollars that went into it,lawyers will charge a lot of money but you stand a good chance with them.to the embassy,you are married like you stated in your previous application so how else do you plan to prove that you’re no longer married to them If you don’t get a divorce certificate.it even helps that your ex is now married to somebody in Canada,if you can get a paperwork to prove that then it will definitely help your case.dont just conclude that your fiancé should relocate to Nigeria.to come and do what?in that country lol.its going to take you a long time like I said maybe 2 to 3 years but have faith and fix all the loopholes this time around and you’ll laugh at last.

This means you & Ojo applied as a couple. Same surname on your 2013 Int’l passport which you must have changed on your recent Int’l passport or not.

Sukey’s post up there is the way forward if you both are ready to be patient.

I don’t think I mentioned in that post that I applied for any visa with someone as a couple or that my passport had someone’s name.
