olamide0147: Thats a nice one. But like i said, it depends on what you want. Visa approval is at the discretion of the Consular so if he/she is convinced that your relationship is genuine and has all evidence or information needed concerning you both, then all should go well. Meeting in dubai with a part of her family is cool but to be on the safer side, you should take her to your family too so she gets to know like one or two people from your end. Assume the consular is quite convinced and ask to see a picture of your fiancée with your family so he/she can approve your visa. Then what are you going to do?? Note: Every case is different, they might even approve you without asking for so many documents or proofs as long as they see what they want. So it still gets down to you and what decision you want to make. I wish you good luck. 1 Like |

Mayorr89:thanks bro she's wants me to come over soon and with what I've read here it seems the K1 is faster than spousal visa which is why we opting for it and I might have her come with me after our trip to Dubai we might both come to Nigeria so have a strong evidence |

Under the section 212(a)(5)(A) 212(A)(5)(A) INADMISSIBILITY DUE TO LABOR CERTIFICATION ```Labor certification (not to be confused with the Labor Condition Application - LCA) is a United States of America immigration process step. Its stated goal is to "protect U.S. workers and the U.S. labor market by ensuring that foreign workers seeking immigrant visa classifications are not displacing equally qualified U.S. workers".[1]``` The consular officer saw on my DSform that I'm a graduate of psychology and the year of graduation was stated. So he maybe felt its a coincidence that I'm getting out of the university and entering the United States on the basis of marriage. Most skilled workers are denied visa application that are not centered on working visa's. They feel it's a sham. However, myself and fiancé wants to appeal on IMMIGRANT WAIVER Section 212(k) provide for a waiver where the foreign national is able to demonstrate that he or she did not know and could not have known a labor certification was required and otherwise holds a valid immigrant visa. |

```ANOTHER NEWS, I got an letter from my senator Barbara Boxer. Because I got her office involved into the case. New Delhi visa cheif emailed her office and said the same story that visa was refused and petition was sent back to NVC. But addition to that they also said the visa was refused because "There were serveral areas of concerns including that Ms.__________had first met the petitioner in 2008 when he had not yet divorced his first wife. So that make our relationship invalid".``` Shit!!! I saw this on visa journey. My petition was invalid from the start. I got her engaged on the 27TH of August 2018 and her divorce was final 21st of February 2019. Lol please don't make this mistakes guys!!! We are withdrawing our petition. |

From what I know, married couples who wants to divorce have to be separated for a duration of time, depending on the state of residence. However, you are free to date or even get engaged while separated, you just cannot get married. |

Pretending to be an American if you are NOT, it's the biggest crime you can do to be banned forever. The part of her not divorced until recently, sounds very bad and may be understood as a sham marriage. Inside US she could be separated and go to live with a man, the Immigration application needs to very correct and no dating or engagement before the divorce is final. |

Get your facts right and don’t speak out of assumptions. It is perfectly legal to date or even get engaged while separated. I know sometimes you think you’re telling the truth but you don’t always have to be very brash when delivering your message. |

@frypuffpuff I'm so sorry for the denial. I think the reason you were denied is because they don't believe your relationship with your fiance is genuine. It has nothing to do with your profession. If they feel that a relationship is not genuine, then their conclusion is that you are simply coming over to the States to get a job...which is why you got that section 212(a)(5)(A). Also there's nothing wrong with meeting your fiance when she is still legally married. However the requirement is that you must also meet your fiancee when she is legally single (divorced) within two years before she files the i129f petition. If you guys didnt meet again after she finalized her divorce papers, then that's a ground for denial. What the section 212(a)(5)(A) simply means is that you are not eligible for the fiance visa and since you intend working in the US, they cannot allow you to go to the US because you will deprive US Citizens of jobs. Note howevrr that even if you say you don't intend to work in the US, they will look for another reason. 3 Likes |

True legitbachelor. Hahaha disguy1 no mind that smartkitty. I was quoting a VJ experience. The thing is can you engage a woman who is still legally married? So it will be considered a sham. We are withdrawing the petition for future petition filing. It makes sense that you cannot engage a woman who is not legally divorced. I engaged her when she hasn't filed the divorce on her first visit. Worst case scenario that will be going in the visa officer's mind; we both conspired so you could divorce your husband. Since the time of engagement was not after the divorce and was even on the first visit. |
