Oyo Council Chairmen: IG Orders Implementation of AGF’s Directives


Reprieve has come the way of the elected local government council chairmen in Oyo state as the Inspector General of Police, Mohammed Abubakar Adamu, has directed the Commissioner of Police in the state, Mr. Shina Olukolu, to initiate appropriate actions that will reinstate them in office.

A letter dated January 23, 2020 and addressed to the Oyo State Chairman of the All Progressives Congress (APC), Chief Akin Oke, asked him to liaise with the Commissioner of Police to facilitate the implementation of the legal opinion of the Minister of Justice and Attorney-General of the Federation (AGF).

The AGF had written the People’s Democratic Party (PDP) led state government to demand the dissolution of the local government caretaker committees and the reinstatement of the democratically elected council chairmen that were illegally sacked within hours of Governor Seyi Makinde resuming office.

The IG’s letter titled “Re: Unconstitutionality of Dissolution of Elected Local Government Councils And Appointment Of Caretaker Committees: The Urgent Need For Compliance With Extant Judicial Decisions” has now directed that the Police Commissioner take actions to implement the legal opinion of the AGF.

The signed by DCP Idowu Owohunwa, Principal Staff Officer to the Inspector-General of Police, was in response to a petition by the Oyo APC Chairman.

The letter reads, “Your letter dated 23, January, 2020 on the above underlined subject, refers. I am to inform you that the Inspector-General of Police has directed the Commissioner of Police, Oyo State to initiate appropriate actions in line with the legal opinion of the Attorney-General of the Federation and Minister of Justice on the matter. You may accordingly, liaise with him to facilitate.

Audio Governor has no choice. His illegal Caretaker chairmen would be uprooted from the council to go back and take care of their homes cheesy

Any form of unconstitutionality must not be condoned. How could any state government dissolve duly elected local councils. As much as it is obvious that Governor Seyi Makinde is riding on the populist agenda this is a joke taken too far. E get some political fights wey make sense, this one no follow abeg cool

If Makinde does not comply, Fg should seize his Lg allocations immediately. This should apply to every other state governor in Nigeria

IG is overstepping his boundary.
The case is still in court and Malami has no power to issue orders to any state governor.
The caretakers will eventually be removed but not by the IG.

Hope Uzodinma has also promised to remove Imo chairmen and conduct new elections.
The solution to these problems is to really separate the accounts of Local and State government
and also transfer chairmen's election to INEC.

There will be no need for dissolutions if the governor cannot access local government's funds and
the real election actually takes place unlike the landmine that outgoing governors plants for their opponent.

Even now, the state governors can't access Local Government funds as a result of the NFIU. Same with the Caretaker chairmen.

When you talk about case still being in court, there's already a precedent for this kind of case that the supreme Court already ruled on. The appeal court will definitely not overrule the supreme Court hence the case still in court is a waste of time.

Man, their case has no merit. They are arguing on the assumption that a court stopped Ajimobi from conducting elections as a result of a litigation from some Baales. This issue was eventually resolved before Ajimobi went ahead with the election cheesy However, the PDP will refuse to tell their members this just to give them false hopes. It's obvious that the state government wants this court case to last for as long as their tenure. APC is not dumb hence they forced their hands. The elected chairmen will resume and the court case would be thrown out.

He's not the court of law, however, there's already a judicial precedent for this type of case and he has the right to remind any erring state government.
