thundafire: That is the point many has not reckoned with. SC was more concerned with time frame within which to resolve election matters rather than examining all the issue raised at the tribunal and lower court. In other words SC narrowed the arguments and even over looked it own decision on Nwosu. No mater which divide you sympathise with, the truth must never be muddle up with politics. eventhough PDP did not provide a result, should the result provided by APC not be subjected to test and interrogation. Runaway: Very foolish write up. Im surprised people are even engaging and it was even pushed to the front page. @racoon if two lower courts could see through the forgery of the APC in Imo , why would the Supreme Court not see same? They have no other choice than to reverse itself. This particular technicality they tried to play , they ended up shooting themselves in the foot. Supreme court goofed with IMO judgement, Hope never campaigned....He just lodged in a hotel on election day to write results and then hired some senior SANs to achieve his deadly mission beside even with the fake results he presented, it is not up to the geographical spread required to be declared a Governor 1 Like |

anonimi: Even if he is not, the post is still senseless. The Supreme Court reviews the decision of the lower courts. The courts saw reason to throw away the doctored results. Inec rejected the results, only two parties were captured on the results, some of the sheets were for an older election, the turnout was astronomical. What exactly did the Supreme Court see to change the verdict? Aeroplane technicalities? Modified: the post wasnt his after all. But it's a senseless post by the author. 1 Like |

tempest01:Of course the decisions of the two lower courts still stand correct.Only that the supreme court was simply out to do a hatchet job hence the senseless dispensation of justice in this case. slivertongue: How was Supreme Court wrong in Imo? PDP rigged election in one zone got it's candidate APC devised it's survival list The two parties argued before the courts till its over. The Supreme Court judges handed out judgement. PDP group says it shall not agree. |

The Supreme Court based its ruling on erroneously exceeded the Total Accredited Voters by INEC in the elections, Senator Hope Uzodinma may also not have fulfilled the Constitutional requirements for a validly elected Governor of having to score at least one-quarter of all the votes cast in each of at least two-thirds of all the Local Government Areas in the State. The ruling also raised the question of double standard in the supreme Court judgement “If their Lordships have already declared Uche Nwosu as the validly elected candidate, of APC, it’s then illogical to again declare Hope Uzodinma as the validly elected governor on the platform of same APC, since there’s no provision for independent candidate in the Nigerian constitution, “Since, it’s not possible to build something on nothing, it may amount to approbation and reprobation on the part of the Apex Court to declare Uzodinma whose candidature of the APC has been initially rendered a nullity. |

The bottom line is electoral reform. As an institution you either reform or die when the demands of good governace and best practices are tabled. Folks like us cried to high heavens for electoral reforms but INEC stuck to its guns to favour the incumbent. This is the result. Elections have gravitated from INEC to the courts. INEC is losing its relevance and its credibility. Very soon if this trend is not bucked 100% of our elections will be decided in courts then we will call on the Judiciary to conduct elections and save us the billions wasted by INEC on so called elections. Nigerians should consider the fact that court cases are expensive and waste scarce resources. It is not in the interest of the taxpayer for his resources to be wasted on matters that border on good governace. Nigerians must demand that INEC reform positively and INEC must demand that Mr. President sign the electoral bill asap to save us from this needless mess. The Judiciary determining electoral matters IS NOT NORMAL. It should be the remote exception not the rule. |

Staro: I am just vehemently against that Imo judgment not necessarily that I am for PDP or Ihedioha. I mean, how hard is it to write on INEC documents and trash the originals. Yusman316: Stop being obtuse. How hard is it to obtain INEC documents, write any results u wish, keep the carbon copies, and destroy the rest?? Or is it that it is so hard to obtain INEC documents?? The ONLY way to checkmate that is to accept INEC’s word, UNDER OATH, that they never issued those documents! INEC swore, UNDER PENALTY OF PERJURY, that they never issued the Uzodinma documents! “INEC had in their reply to the petition disowned those result sheets and averred emphatically that no results were generated from those polling units as elections in those polling units were cancelled by presiding officers as a result of violence, over voting, snatching of electoral materials etc. INEC stated that any result from those polling units presented by any of the candidates must be fake.” Not only that, a mere cursory examination of the documents would have shown them as obviously fraudulent. Not only were they full of ridiculous figures that exceeded number of registered voters, they were also incomplete, smudgy, full of alterations, signed only by APC, and showed results for only APC and PDP out of 70 parties! |
