How is it different when someone who send money to your account can still went ahead and report you that the transfer is fraudulent?

Ok. Thanks for ur contribution
HazzanTazzan:

They cant arrest you...

I have had such case before from a trade here on nl where a sister filed a fraud case on a joint acct operated by her and her brother...

It was her bother who transacted with me and paid me but the sister who wasnt in the country wasnt in terms with how the brother was moving money and thus filed fraud transfers...

My acct was restricted and i had to visit the bank and they showed me the transaction and i explained...

Told them to hold the value involved from my acct and free my acct ... they did so.

Once they resolved the issue, they shld release back the value to my acct...

And that was it... when the brother and sister came to terms a week later, the value held was released back to my acct

If I were you I will go to the bank and demand to see the person that reported me, he needs to explain how is account number and ATM card got to someone else's hand, GOD helping you, you said the transfer was done via USSD that means his sim was also at the wrong hands if you've done no wrong you have the right to explain yourself even if you will be arrested still tell them thesame thing, if you go there with the aim of paying back that easily they might hold you for fraud

This is different because you already have the clients details and probably a chat with your client and you can present that as a proof that the transaction is genuine but in this guys case there is no way to prove he parted with cash with the guy.

In this case the real owner of the account might show up and you won't be able to recognize him coz the money was fraudulently transferred from his account. Most cases I've seen the account owner might even be in maiduguri and you will be in lagos. How do you expect him to come see you?

What if the person transfer to you from someone else account? How will you clear yourself if this kind of accusation is always valid?

I am have the instinct it was the guy who owned the account but be it as it may and for what it is, i will walk into the nearest branch to clear myself and not with the intent of paying the money. This happened in Port Harcourt.

What am trying to say is that the real owner has some explanations to make if the transfer was done via USSD, I doubt you can carry out a USSD transaction without the SIM you used in registering with the bank as with this case the account number and password of the account including the sim are with the person that transfer the money how come? But as you've said the banks might not be bothered

Good day All, please how do i go about this issue i am into. On Weds 11th, March, 2020 i log on to my GTworld to make transaction but i got a response that my account has a debit/credit restriction.

I reach out to my bank via twitter DM to know what is going on the response i got was that my account was reported for fraud hence i should make full return of alleged fraudulent transfer i made on 3/4/2020. Without wasting time, i log on to my GTworld to check and i saw the said transaction which was the only credit i received that day.

It happened that i went to the ATM to make deposit but when i got there the machine was down (hardware error), seeing how depressed i was, one of the customers that wanted to withdraw offered to transfer to me while i gave him cash. That was it, it was not a fraudulent transaction but now he went to report me for fraud.

I further asked how i can clear myself but i was told only if i liase with the account holder or i make the full payment that's the only way they can lift the restriction. Someone i did not know or have his contact. And i believe he own the account not someone else's account because he used USSD to make the transfer. But why he reported me and the bank easily believe is what i don't understand.

Please dear Nairalander, how can i get out of this. I cant make use of my account all this while, people who send money into the account unknowingly are on my neck to carryout there services for them, and this is becoming too much for me.
if the person that reported you is the account owner , and is different from the person that transfered to your account then before the law bro, you are as good as a dead rat right now because you allowed the transaction to take place . The best options available right now is to tell the whole truth to your lawyer so that he can teach you how to get out. Hope you haven't withdrawn such money for anybody yet cos that is a huge dent on your credibility for the question would be' why didn't you report to the law immediately you noticed the 'strange' deposit if you ain't part of the supposed fraud?' Right now ,you an accomplice before the law so allow your account officer or a banker friend and your lawyer to guide you.
But if the same guy that reported you is the one that did the transfer and also the owner of the account, then don't even loose a sleep as the history of the transactions is there to bail you out. Request for your statement of account immediately because you would sooner than later need it.

The ATM too, he was having the ATM card and he was having the phone reason why i believe he owned the account. If they would allow me to proof my innocence i will surely see means to get out of this.

What is this one saying?

Looking for a lawyer by visiting courts and through agents may sometimes not be a good idea. In any legal proceeding, it is necessary to hire a good lawyer with sound experience and knowledge. There are various online platforms where you can find good lawyers and hire them at a very minimal cost. You can also consult American lawyers in Mexico online and book an appointment.

They will surely hear your own side of the story. Go to the bank on monday and explain to them. Did the person's phone number show on the remark of the transaction?

That may be a great indicator that you truly went there that day, take note of the person who transferred to you. If he or she is there too, the footage alone wins it if the person is the true account holder.

Here is my understanding:
The guy who transferred the money to you is not the rightful owner of that account. The rightful owner is the one who made the complaint at the bank concerning the said transaction. Go to the bank and first describe the person you helped. Make sure they take note of your description. Then ask to see the real account owner. You may just find out that the real owner is not the guy who transferred the money to you.

Man you nor get sense. How dare you tell him that wen e don enter trouble. He can't sue the bank. The Original Poster acted like a bank to another bank customer to receive money on his bank account in order to give his "bank customer" cash. The thing is, this guy didn't do know your customer (KYC) before he decided to turn his account to a deposit money bank. Now that the cash has been withdrawn from his account, he has to pay back the said funds no question asked.

If he can find the person who made the transfer to him, then fine, otherwise he should just take heart and be wise next time. This is a lesson for every person reading this message.

The only reason u are typing this now is that the money is not up-to 150k. Post no debit orders usually come with an arrest on sight order for large sums.
U would have been behind bars
Ur bank figures u can return the money and that's why they are being gentle with u.
The person stole someone's account details and transferred money via the account to u. It's a common scam most guys play on university students.
Forget how he did it... Go to ur bank with the money... Meet ur banker/account manager... He already sees the transfer thread. Explain urself and offer to pay it back.

Sometimes... Even after u paid back, it's a long road to recover ur account.
Goodluck

Most likely the owner's phone was stolen..so just ask the bank to show you the cctv at the atm point.

Let them show the cam recording of the day and you might be lucky if the camera got his lying ass. Let him show the proof that his phone was sent to you, yes, but yond reasonable doubts. Let mtn or the network provider provide logs for IMEI change, call logs of the said number (to know if phones were changed) on the day the transaction occurred for the jury's perusal.

The person that transfered money to your account is a fraud.

The account he transfered money from does not belong to him.

The person is a fraudster but the account is his. That's what happened to a Paga Operator in my area. Some guys will come over to him, after they had gotten the money from him, they'd go to lodge a complaint to their bank and the Paga Operator have to return the money; double loss.
