It happened that i went to the ATM to make deposit but when i got there the machine was down (hardware error), seeing how depressed i was, one of the customers that wanted to withdraw offered to transfer to me while i gave him cash. That was it, it was not a fraudulent transaction but now he went to report me for fraud.
I further asked how i can clear myself but i was told only if i liase with the account holder or i make the full payment that's the only way they can lift the restriction. Someone i did not know or have his contact. And i believe he owns the account not someone else's account because he used USSD to make the transfer. But why he reported me and the bank easily believe is what i don't understand.

Go to the Bank....Go and meet them and explain yourself, they can't arrest you , go with the credit alert , even if it's someone phones beg the person to follow you there ... It is even possible for that same guy to block your account , there many fraudulent internet bankers now... Go to the bank with your credit alert... I am pretty sure banks doesn't have any right to block your account without a warrant from the court, very sure....it's either u are not telling us the truth, or the guy that transfered to you is a bank fraudster and he blocked your account, ....run to the bank tomorrow with your credit alert. 3 Likes |

Then they call you on the phone, saying that they mistakingly sent to you and blah blah blah, and they want you to send it to another account or whatever (different from the one that sent it to you)
This country and wickedness ehn I don't see myself falling into this traps tho..if you are not my family member or my friend even if you are dieing at the ATM I can never allow u transfer to my account I don't even mind withdrawing money and dashing you.. The truth is that gtb staff conspire with fraudsters that make use of your account without your consent (not even text msg or e-mail). I believe you visit your bank, the branch were the transaction took place and explain to them what transpired between both of you.
Then ask them to call the customer that reported you of fraud to come for a meeting to clear your name. If there is any cctv, you may be Lucky.
But my fear is that he might deny the obvious because there is no evidence to support the cash you gave him.

Get a lawyer, better still a financial litigator who understands the dynamics of case as this. And to still maintain your trust with your clients asked the said lawyer to write them or mail them explaining in layman's language your ordeal.
You are even lucky the said amount is small. If it were to be huge sum by now the police won't give you the opportunity to be on nairaland asking for advice. Lesson learnt from your experience now.
It is only with a good lawyer, and or with a police backing you can get the network to release call logs of the phone from which the ussd was used. But before going to the network the bank has to release log files of the transaction including the phone no that initiated the transfer. With this the network will be contacted to track the owner or user of the no, then you can be to get clarity. All these can't be done by you except you have strong legal correspondence or police backing. Sorry for the inconvenience. |

felzylix: How could you people say he is in trouble? The young man received a payment in his account which no one has a proof that he initiated. It could be a payment for an online transaction, it could even be a give away received from anyone from here on Nl abi any other SM, anybody with itching fingers could just pick an account number randomly from anywhere or even guess it and transfer money to it. The bank has no right or whatsoever to block his account, that's so expedient of the bank, you should sue them if you can afford it. He's in trouble because the transfer was likely initiated from a stolen phone and was not carried out with the consent of the real account holder who reported it. If you need your account for work....it is best you return the money....because the case is not a water tight one and you may end up losing more money trying to resolve it some other way |

@op. You'd better listen to those who are telling you to cooperate with the bank fully. You were the victim of a fraudulent case. The man you met was not the rightful owner of the account. Forget about the alleged ATM card you saw or anything else. You are not an investigator; he could have shown you just any ATM or he could have stolen it along with the phone from a bag or purse. You just don't have the information to identify the person's credibility and you had no business behaving as if you were his bank; conducting transactions on its behalf. Also, nobody who can serve as a witness clearly saw you give him the cash. As it stands now, the only verifiable info available anywhere is that a sum of money was transferred into your account via USSD from a possibly stolen phone. Go clear yourself and if they want you to repay the money, pay up.
If you involve lawyers or the police, they will just escalate the issue to the point where you cannot handle it again, and a N3k issue will become a N500k issue. I have warned you. My task is done here. Words of wisdom. Take it. Never u involve lawyer or the police. They will blow this shit outta proportion, even you would be amazed how fast shit would hit the ceiling. The bank is there to douse the issue. They have a reputation to protect so they'll do everything within their power to guard it. They also don't want police or legal wahala. Bro. Take the advice. Go to the bank. Meet with the bank officers, explain your case, request for CCTV recordings if any, and repay the 3k. Believe me it might look like you're refunding the money but that's possibly the only win win situation you might have, other scenarios would be very unpleasant. Someone close to me was a victim of something similar, I wanted to create a thread on it- but I have been lazy.
You've most likely been used as a PICKER. The person doesn’t own that account. I call them STRANDED COMMUTERS. They will always approach you with a sob story of how they are traveling, they need cash, but not with their DEBIT CARDS for withdrawals.
Then they’ll propose to transfer to your own and have you withdraw for them. Whatever they propose must always involve crediting your account.
People have helped withdraw ransoms without knowing. It is when you enter bank to withdraw and EFCC pounces on you, clear you from the ground with better sliding tackle- that is when you’ll know what you have gotten into.
What you’ll do depends on the severity of the restriction. One needs to see it to advise properly.
However, generally speaking, if there is an apprehend on sight placed on your account- you’ll be picked up the second you step into any branch. I doubt it’ll come in here, this is too small an amount.
If it is just the customer reporting, crediting your account with said sum and giving a written instruction for it to be sent back, would fix it. This doesn’t always mean the restriction will be lifted immediately. You might not be able to do online transactions for a while.
For the first scenario, you will spend more. A police report and court order would come in.
The good thing is, you will learn, albeit the hard way.
