Dec 2019- 9 month.
Jan 2020- 10 month.
Feb 2020- 11 month.

How can a 1year rent that starts on 18 April be due before 17 April of the following year?

Those who are calculating March as 12 months interval are indeed April fools.

I don't know how best to explain this to you. I'm a Lawyer..and I've tried to let you know why the Tenancy agreements are made 11months for first rent payments...after which subsequent rents will be calculated as 12 full months...

Actually the guy you quoted is right.. if you pay on say 8th Feb, the tenacy agreement will read .. renew by 8th Jan next year.

Funny enough, I see no biggie in making payment for your accommodation. I for one like to delay deliberately till after the exact day I made my previous payment.

i have told you how i have been paying my rent not from the same apartment but from different apartments i have lived, and i deal with lawyers in charge of the house rent.
i can never agree with you because you got it wrong.

You are entitled to 6 months notice to quit since you are a yearly tenant. Meanwhile you will pay for the six months, but its enough time to either look for elsewhere or fix things for your self . Your Landlords calculation is correct

@Idowu98, just refer him back to check on the dates on his NYSC awarded certificate. It will be like Nov 8th 2018- Nov 7th 2019. That is if he truely secured one.

January 1st to December 31st = 12 months (365/366 days)

Now, in Op's case, he moved in on 19th of April so his rent should expire on the 18th of April... his rent didn't start from the first day of the month, so his rent ought to expire a day before the day he paid the previous year i.e 12 full months or 365/366 days.
Don't mind the people displaying ignorance.

A calendar year is 12 months or 365 days, irrespective on the day in the month it commenced.

1st February to 31st January the next year makes 365 days

2nd March, 2019 to 1st March, 2020 makes 365 days

If it's on 1st of April, his rent will expire a day before 1st of April i.e 31st of March, because he used the full April but in Op's case he only used about 14/15 days out of April i.e April 17, so his rent will expire on the 16th of April to complete April a full month for him/his rent.

Your counting is wrong bro. From your demonstration, he is supposed to be on his 11th-month by 18/03/2020. If you schooled, graduated and served the nation. Go check dates on your NYSC certificate for clarification.

I disagree with you. From the illustration, it is a yearly tenancy which can only be determined or brought to an end by a valid quit notice which in this case is the statutory quit notice (6 months).
Section 8 and 9 recovery of premises Act.

Well where is the tenancy agreement ?

Im sure you are conversant with tenancy for a 'fixed term' if that clause was inserted in the agreement it is an escape route for the landlord see sections 13(5), 24 & 26 tenancy laws of Lagos.

April 18th 2019 to April 18th 2020 is 12 months and 1 day

April 18th 2019 to April 31st 2020 is 12 months 13 days.



She was basing her calculation to same people that made payment on the 1st..

He said he paid his rent on 18th of April 2019. The rent starts counting from that day. So from 18th of April to 18th of may that's 1 month.... Oppps sorry I now get the drift, if the rents start counting from that 18th the actual expiration of the rent should be 18th of April 2020. I now get the drift.

You're the wrong one please...

1st January to 31st December = A year

2nd January to 1st January = A year

3rd January to 2nd January = A year
And so on.

Maybe your tenants are less informed or illiterate or you are cheating them or you're simply lying.

@brownsugardr, your landlord erred on this. I am not a lawyer. Use dates on your NYSC certificate to settle this argument.

Your rent is supposed to come to end a day prior to your date of payment, same month but the following year.

You all should stop these wrong mathematics and stop confusing the nigga... That guy is right his rent expires on 17/04/2020. One year is from 1st January to 31 December. 1 November.... Just one day short... So if he paid in 18th, his rent is due on 17tg of the same month of next year...... Am an engineer argue with your calculator and see if your own calculations gives you 365 days.....

Oversabi. It's called "Quit Notice" for a reason, you're entitled to that 6 months to quit the apartment. No tenant will pay a dime when quitting an apartment after being issued a court order quit notice.

It can only end in match only if he used the full April but if he did not use the full April, it will end on the day preceding the day he paid... April 18th to April 17th...

Didn't you read where he stated that the LandLord said his rent expired on 17/03 and not 31/03. It's obvious the landlord is miscalculating, perhaps he needs money. If the Landlord had said that the rent expired on 31/03 then your calculation will be right.

If he pays the new rent and agree that it expired on 17/03/2020 what it means that next year, the rent expires by 17/02/2021 and the cycle continues.

So it is better he maintains his ground and correct it now.

You probably have being cheating your tenant, collecting 12months rent as opposed to 11monthd as describe by act you quoted.
