Court says Enugu striking doctors risk contempt charge

The National Industrial Court, Enugu Division, has said that the Enugu State Government could commence contempt proceeding against the striking Resident Doctors of EnuguState University Teaching Hospital (ESUT-TH) Parklane, if it so desired.

The court had restrained the doctors from embarking on industrial action following an application the government brought against them earlier this year.

Regardless, the resident doctors on April 25, 2020, withdrew their services from the teaching hospital, claiming that the state Government reneged on their last month’s agreement with them.

Justice O.O Arowosegbe while ruling on a motion exparte brought before the court on Wednesday, by one Mr. Oscar Mba, on behalf of Enugu urban residents, seeking for an order against the doctors to stay all actions in connection with the resumed industrial action, said that there was a valid and subsisting injunction restraining the medical doctors from embarking on industrial action that could be revisited.

According to the court, it would amount to abuse of court process since the defendants were the same doctors and the prayers same as that of the government application.

It averred that the state could invoke Form 48 and 49 to commence contempt proceeding against the defendants.

Therefore, the court declined to grant Mba’s prayers since the employers of doctors, which is the government, was not joined in his application.

Justice Arowosegbe ruled that since Mba’s action and that of the government were the same, he would hear the substantive matters together on May 20, 2020, earlier scheduled for the matter.

In his argument, counsel to the plaintiff, Mr Princewill Agu stated that his client, was devastated when on April 27, his wife took their twins to the Parklane hospital for medical check-up only to discover that the resident doctors had withdrawn their services.

He contended that since the resident doctors were engaged in the provision of essential services, they cannot take part in any strike, particularly during the present Coronavirus pandemic."

This is the time they mostly needed,they shouldn’t embark on any strike for now , besides governments should do the needful, these guys are the heroes of our time now

Now is not the time for the doctors and governments to start fighting. They should sheath their swords until we put the virus behind us.
Until then, the government should do their best to provide adequate equipment and welfare package to these doctors.

Threatening these doctors with contempt proceedings is not the way to go. You do not threaten a man who has a knife on your neck.

Nigerian doctors are some of the most appreciated all over the world but here in Nigeria, we treat them like shiittt!!!
Are they being paid appropriately?
Do they have sufficient PPEs?
Do they have the tools they need to work efficiently?

We can criticize our doctors all day long but come on guys, we need them and they are here for us.
Was it not too long ago that Ngige said that doctors are free to leave because we have enough in Nigeria?

Was it not too long ago the minister of health, Isaac Adewole said that doctors that not all doctors will be specialists and some of them will end up being farmers??

We have treated our nurses, doctors, and medical professionals, so unfairly in this country!!

Adadevoh bravely gave her life to prevent what could have been a disastrous outbreak of Ebola.... Where is she today? To the best of my limited knowledge, no federal recognition, no scholarships and grants for her children! Absolutely nothing to immortalize her!!!

We want these people to be our first line of defense, then its time to treat them fairly.
Otherwise, get out of their way and let them strike in peace!![/b]

The man is mad, u sued the doctors because nobody attended to ur wife and twins when u took them to the hospital.
Why not sue the govt that refused to honour her part of the agreement it had with the doctors?
After u don belleful and probably staying at home and still getting paid by govt because of corona, u expect them to serve in empty stomach under the pretence of essential services.

Where was the court when government fail to fulfil their own obligations ?

Best thing is to resign and let them get doctors that will risk their life for a government that does not value them

If the reason for their strike is lack of PPE or inadequate facilities that creates a situation that endangers them much more than should be the case, then I am in full support. Nigerians would castigate health professionals for not being willing Matryrs, yet would go on to make illogical arguments in the defense of the leaders whose actions and inactions is the cause. If you must charge doctors to court for contempt, then charge all the politicians to court too. Whenever it involves the common man idiots remember the law but once it involves the fools in govt, everyone turns a blind eye.

Nigerians are probably the most confused people on planet earth. I remember vividly at the beginning of this virus in Nigeria, you all started shouting, lock down the country, and once the country was locked next was my business o, hunger wants to kill me as if you didn’t think of that when you were shouting lock down the country.

Now that the lockdown has been lifted so that hunger will not kill you again, you’re still complaining. Wailing headquarters of the world.

Anyways, as for me and my household, come May 4th, we won’t step an inch out of this house. Who wants to go and die can do so.

It's so painful to work in Nigeria. my younger brother who happens to work with a Federal Government Teaching Hospital has not been paid for about three months since he resumed duty as a House Officer. And you expect him to keep working on daily basis about 13 of them have not been paid,you still want him to work. When workers who are not working are paid for staying at home and you want someone working to continue because of humanity services. Let's not forget this are human beings. I keep sending him money to manage but does it make any sense? Even this lock down they have not done to see they pay this young man his salary and yet they keep working as frontline Doctors,Doing Casualty calls at Accident and Emergency. It's so pathetic to be Nigerian. It's very annoying to be working and yet you won't receive a dime salary and we want to them to work tirelessly. How can a Doctor be working this period and yet don't receive any payment? Isn't that wickedness in the highest places? If the hospital don't have human sympathy at least do the needful on this young man who is working during Corona Virus outbreak. God should save our souls. It's so terrible......don't be annoyed if you hear Dr's don't attend to patients or striking at this period most time the hospital no try and it's nothing to live for it.
