This and more should be expected as many PDP moles in the APC will want to play their double standard. For a lawyer it’s amazing to argue that the actions of the then national chairman is void forgetting that there was also an appeal courts ruling for a stay of the order of the high court pending the determination of appeal before it.

Looking at APC and PDP one may be tempted to conclude that PDP has a better understanding of how the courts work. PDP seem able to take advantage of some careless errors of APC to deal with them. This may be one of those cases.

For any matter concerning primaries or election,it must be filed within 14 days.all decisions taken by either oshiomhole or giadom or apc nwc is subject to nwc just like buhari appointments of ministers is subject to Senate approval

Can u pls quote d law that supports ur claim of 14day filing period?

I didn't ask u whether d decision was taken by oshiomole or giadom or apc NWC or who it is subject to. D question I asked is how does d decision of apc NEC make d case to lack merit?

U still haven't told me if it was obaseki that filed d case before d court

I asked the question because you claimed there is an 80% possibility that Osagie Ize-Iyamu will be disqualified by the court. From your answer, it is obvious you don't know what you are talking about.

To correct you, the chances of POI getting disqualified by the court is less than 5% if there is any chances at all. Nominating a candidate by a political party is simply the internal problem of the party. The court can not chose a candidate for the party. POI was duly admitted as a member of the party. He followed all the internal procedures laid down in the party constitution and was validly nominated by the party. Why will he then be disqualified?

The chances of Obaseki getting disqualified is by far higher than POI. Obaseki has three very strong issues to contend with in court. One, the issues relating to him and his deputy's qualifications. Two, he obtained PDP form after the party had ended sales of nomination forms and screening. Three, he participated in the nomination processes of two different political parties for the same election. I doubt if he can manage to scale through these three legal obstacles.

Bros I won't argue with you but it's obvious you don't have the facts of the matter. But let me put it straight POI was not duly elected. I will leave it at that let the court decide there faith but I still insist POI as 80% chance of being disqualified. The reason why you have to follow the background of the matter.

On the points you raise on Obaseki I only agree with you on issue nos 3 but other issues can be contested based on facts I have read.

Check section 285 of the constitution and section 33 of the electoral act.

In the case of the apc primaries, according to apc constitution the nec is the final decision maker and ratifies all decisions taken by the chair or nwc...therefore the court case is dead.

Oshiomhole was suspended by the high court.the appeal court lifted the suspension temporarily which means he remains national chairman and all his decisions are legal.later, the appeal court now suspended him.a primary was conducted and giadom rejected the primaries.the party nec which has the power to decide on primaries overruled giadom and ratified the primaries....case closed

You seem to forget NEC decision came after timelines for primaries had elapsed, what that simply means is that there was no primaries ratification doesn't matter. Best bet settle out of court and promise that chap something juicy else that guy fit break all the plates for the table.

The primaries according to apc constitution is conducted by the apc nwc not chairman.. Decisions are taken by the nwc and ratified by NEC...therefore the primaries are legal and going to court is useless...

Again based on the supreme court decision in alaibe vs diri delivered last week, internal affairs of a party are its internal problem and not justiciable.any matter that happened before primaries are not justiciable

You are not experienced with electoral cases.this matter has been settled last week in alaibe vs pdp where the supreme court ruled that the candidature of a party cannot be challenged based on matters that happened before a party primaries except his qualifications.you can only sue on matters that happened during and after primaries.it is non justiciable...

If you are challenging pastor candidature because of what happened to oshiomhole and Giadom, it is a waste of time except you are filing it as a civil case and pastor or the apc primaries will not be a party to it.it Wii never be binding on them.the court has settled this matter

In synopsis, I posited that the primaries was conducted by oshomole and won by POI and then affirmed by NEC and that since the process leading to the primaries is in dispute, it then means there was no affirmation because u can't affirm what never happened. That affirmation came when time for parties to conduct their primaries has elapsed.....

Point of correction, I am not from Yoruba, I am a core Edo Guy... and for you response it is invalid. Before the ruling of the Appeal Court there was an order of the same court that states "all status quo must be maintained pending the decision of the court" and that was what reinstated Oshiomole. So, whatever decision(s) the NWC led by oshiomole took before the final ruling of the Appeal Court is valid. And to give more credence to the whole issue, the NEC also validate that through the RATIFICATION .

I have been patiently waiting for a case of this nature to hit the court, considering the ilagality perpetuated by APC as it grappled with the suspension saga and Edo State's governorship primary election. As it stands now, Ize-Iyamu will need serious fasting and prayer to retain his candidature of APC in this coming election.
